DUI in VA? You're Screwed

Under a new law passed by the House of Delegates and the Senate, EVERY

(yes every)

Person who receives a DUI will have a mandatory ignition interlock device installed on their car if they want to continue to own a car.

Cost for you: $600-$800 for the device, and a monthly payment so that the company can track you.

By no means am I condoning drinking and driving in any way.

But this law is just complete BS-

It was defeated year after year by the Senate: not because they like drunk driving, but because they knew that this law would just clog the court system.

Now everyone who wouldn't go to trial and plead guilty will go to trial.

At lease they knew the judge could give a level of leniency for a 1st time offense or a so called 'baby dui.' Not anymore!

THANKS REPUBLICANS FOR SELLING OUT TO THE IGNITION INTERLOCK LOBBYISTS!

They're gonna get a lot more money now that every person in the state that has received a dui, even one at .08 or BELOW .08 will have to pay to have an ignition interlock installed and monitored in their car.

Furthermore, you could simply have someone else blow in the tube! Whaddya think of that!

This is the best news I've heard all day. Thanks for the info.

Excellent. This is a great law and all those killed or injured by drunk drivers and their families who carry the pain, should feel some comfort from this. Way to go for once a good law

Pretty sure they only get that if their license is suspended and they get a conditional license to drive, so it's not like "interlock for life," and this is standard for repeat offenders and those that blow over 0.15 already.

I don't like a lot of drunk driving laws and enforcement policies but anyone with a brain knows it's illegal and knows they are risking a possible financial disaster and legal nightmare if they break this law so if you get caught you just have to pay the price. You are a criminal. That's what happens.

Good! Much as I hate the Virginia Republicans, they finally passed some meaningful legislation. I hope that this causes some drunk to think twice before driving. And if he/she has to pay to learn that lesson, then all the better.

And somehow, I don't think your outrage is from the Government intervention or potential revenue stream that this represents.

somehow I doubt this is going to do anything to curb drunk driving- can't someone else just blow into the tube to get the car started?

Meh, they are also passing a law that requires vaginal probe ultrasounds before you can have an abortion and they want a law that will make birth control pills illegal.

I get drunk and drive around all the time.

Dont blow if you get pulled over and get a lawyer. Itll cost a little bit but with the right lawyer you will have no problems. You may get a moving violation but not a dwi/dui

IF YOUR DRINKING AND DRIVING AND GET PULLED OVER DONT BLOW OR SUBMIT TO ANY TESTS.

Note: To dramatically increase your chances of getting away with being hammered and driving take the physical tests the officer wants to perfom. Do the walk the line thing, do the following his finger with your eyes thing, and do whatever else you feel you will pass. DO NOT DO ANY TEST YOU DO NOT THINK YOU WILL PASS.

In court, it will be a lot better when the Judge sees the video of you easily walking the line and passing other "tests" they give on the roadside.

NEVER BLOW OR GIVE A BLOOD SAMPLE!!!!!

THE POLICE WILL TRY TO INTIMIDATE YOU INTO SUBMITTING TO AN ALCOHOL TEST. DO NOT LET THEM.

Probably. But let's say your car is stopped, and the drunk driver blows a .1. Meanwhile, you're sitting happily in the passenger seat. What do you think the cop is gonna think? I don't know if assisting in circumventing a breathalyzer is a chargeable offense, but I wouldn't want to risk it.

So the drunk convict is behind the wheel and you are A)stupid enough to be in the car with him B) Sober enough to start his car for him C)about to let him either drive you or drive off drunk? Almost no one could be that stupid.....almost.

i'm willing to bet there are far more fatal and non-fatal accidents caused by drivers distracted by a cell phone, on a yearly basis, than there are by drunk drivers. raw checkpoint data supports me in that assumption. how else would you explain a checkpoint with over 1000 checks only catching 1 to 3 DUIs? i dont condone drunk driving by any means, but lets face it, it's the easiest thing for the pol's and such to home in on.

be happy about this potential drunk driving preventative measure/law now. but how happy will you be when VA mandates some type of device that renders a cell phone inoperative unless the vehicle is at a complete stop, if at all in a car?

the pol's wont crack down on cell phone usage due to the fact they do it, as do their wives and children of driving age.

Christ!!!! The bastard republicans are making more laws and regulations. That's all VA needs. I thought we elected republicans to get rid of regulations?

Now we have new guns laws, birth control regulations, road fines, sonogram regulations and now ignition locks.

What a bunch of phonies!

For first time offenders you only have it during the time you have a restricted license if you are able to get one under this new law. Its only for life if you get another dui after that showing you didnt learn a lesson

A coworker has one ( second offense I think ). Yes anyone can blow it and start it, but if I understood her correctly you have to blow on it again at set intervals. Maybe 20 - 30 minutes ? I forget but I think if you blow and it triggers, it will set off a timer that the car will shut down in XX amount of time giving you a chance to pull off to the side vs shutting down instantly. If that was the case it would cause an accident which is what the whole thing is designed to do.

Sounds like a good idea. I've been advocating for chopping off of DUI driver's hands, but this is a start.

DUI ignition interlock limitations. Provides that a person who is convicted of DUI may drive only with an ignition interlock after the first offense, as a condition of a restricted license and is required to have an ignition interlock installed in each vehicle owned by or registered to him after a second offense. The bill also provides that the court may authorize a restricted license for travel to and from the interlock installer and a person can pre-qualify for an ignition interlock prior to conviction. Currently, the requirement for an ignition interlock is imposed only upon a second or subsequent offense or when the offender's BAC is above 0.15 percent. This bill incorporates HB 467, HB 951, and HB 1258.

"At lease they knew the judge could give a level of leniency for a 1st time offense or a so called 'baby dui.' Not anymore!"

Just FYI: that is NOT the correct use of Baby DUI. Baby DUI/DWI refers to a person under age of 21 caught driving withe between .02 and .08 BAC under http://leg1.state.va.us/cgi-bin/legp504.exe?000+cod+18.2-266.1
