I was reading up on Virginia DMV points assesments and I found out that even non reckless speeding over 20mph will set you back 6 points and will be on your record for 5 years. Assuming that one DOES NOT take the driver improvement clinic and was convicted of 3 speeding over 20mph violations, normally you would get 5 good points back on your license over a course of 5 years. So by having 3 of those charges on your record you should have -18 points(assuming you started accumulating at 0). After a period of 5 years, the points should be down by 5 leaving you with still -13 on your record. My question is since those charges no longer appear on your driving record, shouldnt the points be drawn out as well or do the points still stay on your record even though the charges are no longer there?

Another questions, does the time start from the date when the actual ticket was issued or from the date of conviction???

The fact that it stays on your record for 5 years has nothing to do with the points themselves. Regardless of the infraction, any points on your license go away 2 years after the date of the infraction. The offense is still on your record in that it shows up on the printed report you can get from DMV, but the points are gone in 2 years.

No the fact is the points do not just go away after two years. For every year you drive without a conviction you get one good point. If your in the negative IE: -6 and dont get any further convictions, it will take 6 years to get back to 0 regardless if the actual conviction is still showing on your record. It is possible to to have a so called clean driving showing no convictions but still have negative points.

DMV demerit points remain on your record for two years from the date that you commit the offense. The dates that demerit points are removed from your driving record are not related to the dates that convictions are removed from your record.

huh, so the points go away 2 years after they are assighned for such and such offence? what do you know, I thought you get one good point back a year and thats it. SRE is right, since it clearly states on their website that points go away within2 years from the date of offense. There is hope after all :)

The demerit points come off after 2 years, but the ticket itself stays on your record longer.

You earn a "safe driving point" for every CALENDAR* year you go without a ticket (up to a maximum of 5).

*That's January 1 thru December 31

Absolutely wrong. Points don't disappear 1 per year as you claim. Like said above several times, ALL points are gone 2 years from date of infraction. You get a positive point (a good thing) for every calendar year witout any tickets. The best point total you can have is +5.
