My reckless driving charge..did I make a smart choice in court?

I was at court the other day with my attorney, over my reckless driving charge and pleaded not guilty. The sherrif requires all radar guns to be calibrated every six months, but the state trooper who pulled me over used one that was 10 days overdue. When my attorney brought this up in front of the judge, the state trooper let out a nervous laughter and claimed that the calibration-every-6-months requirement isn't strict. He then requested some time to do "research".


My attorney talks to them (trooper and prosecutor), and informs me that they don't seem to have any justification for using overdue radar guns, but that they're willing to drop the charge to regular speeding. However, the charges could've been dropped completely if we went to trial.

Not wanting to roll the dice, I accepted the deal - it cost three demerit point and a modest fine.

Did I make a smart choice?

If you were guaranteed to avoid the reckless this way, I say it was the smart choice.

By law the judge has to dismiss. Same thing happened to me, except the lawyer pulled out his copy of the Code of Virginia and showed the judge that there are no exceptions, out of calibration is out of calibration. Case dismissed!

The cop made some dumb excuse in my case to but it didn't work. He was PISSED.

That said, lay off the gas dude. This was many years ago when I was 19 and had a turbocharged sports car. I got lucky, really lucky.

Yeah they got over on you but what the hell. Now if you have matured a little after this experience maybe you will stop driving like a little bitch.
