How come my criminal history didn't show up in background check?

Got a felony about 8 years ago and a few misdemeanors 10 years back, all in va. I had filled out background check info for my job and found out it came back with nothing. I'm pretty happy but gotta ask: How come nothing showed up?

Really the only way that would happen is if they only did your background check for a certain time period. Like they only did the last 3 years, but if you are a convicted felon youre supposed to tell them that anyway

Most applications ask if you have been convicted of any crime dating back 7 years. Since op stated his crimes were from earlier, he's not obligated to state. I'm sure the majority of background screenings only go back a certain time period (7 yr, 10 yr, etc) though I'm not sure. Even though thread starter is a douche, he's kinda right in that if it isn't a govt position, why the hell would you state you had a crime before. You might as well tear up that application.

I think you're in the clear.

The standard job application asks if you EVER have been convicted of a felony. You have, and you should have reported it and would have immediately been disqualified. You didn't, and you got far enough in the process that they paid to do a background search. I would have done the same thing if I was in your shoes. There are many squeaky-clean people out there looking for jobs.

Government job or not, about the worst you'd get is fired if they found out. If the job really mattered to the point that they would prosecute you for that lie, they would have searched back far enough to not have to trust your answers.

Good luck in getting the job. Also, congratulations on having a clean record for the last several years.

Nowadays most job applications I've filled out ask if you were convicted of any crime within the last 7 years. The reason why he didn't show up is that they only search back within a certain amount of time and he was under no obligation to put down his record since it was over 7 years ago

It will show up when you don't expect it. If they do an follow-up, recurring or more detailed (local verus national check) investigation it will show up and you will be on the skids for lying.

I know a person we hired with a supposily legit degree (Information techonlogy), turn out degree came from the online off shore place. A follow up investigation on the degree statement was all it took and the person is gone. The contractors in this area seem to hire you off the bat to get the job immediately filled and then follow up with a detail investigation.

Lie at your risk about your education and criminal background. States, schools and LEs are becoming more networked in sharing people information. I listen to my scanner and the FFPD and you will surprised how much information they get on people they call in except them illegals.

Background checks that I see clearly say the time period searched, and it is usually 7 years. So before 2005, and it won't show up.

Seriously? Statue of limitations on what? That's for being prosecuted for a crime, not someone lying on a job application. Firing you for lying is different than prosecuting you for a crime.

Just because the OP skated on the original background check does not put him in the clear. Where I work (IT), we have get new customers all the time that require different background checks just to be placed on a project. That means current employees who probably would never get re-checked otherwise are going through updated checks all the time. Law enforcement requires one kind, banking requires another, and so on. So the check you did ok on to get hired could be the first of many done over time.

Hello,
To be honest, I don't blame the guy for lying. He would still be unemployed like the rest of us! I have been honest since I got laid off, and it have gotten me nowhere. I've answered the dreadful question on app. Still no phone calls. Recently I applied for the same job months later and was called for an interview. I have sick with regret about the stupid misdemeanor I have. It's been over 10 years. My credit, home, and my sons education is in jeopardy. I want to get my life back. In my state you can not get expungements and it doesn't matter how long it's been it will always be public record. I have written letters thru bill Hr2449 fresh start. I hope they get it passed so I can have my life back. This should not be public record forever. How do they expect you to live or provide? If anybody can or know where I can apply and at least get an interview so explain my 1 misdemeanor, then pls post. I'm in va.

It depends on what exactly the employer considers to be a "background check".

Sometimes it is just an arrest record search at the local police department, which if it's a city or county PD, will only have records for arrests by that department.

FFU's arrest/ticket search is a good example. It is purely arrests made in fairfax county. If you murdered someone in Arlington, it isn't going to show up there.

In the early 80's I killed a guy in Texas, and did my time. Paroled in 1985. Got my degree courtesy of Texas while doing my time. Got out and applied for a job with the Federal Gov't. They asked, I lied. I figured they would find out sooner or later and I would enjoy the federal employee gravy train while it lasted. They never found out. I have worked as a fed for 27 years. I will retire on a federal pension at the end of this year and move to Florida.

VA does not have a "statute of limitations" for felonies. And convictions in VA cannot be expunged. Period. Most applications ask if you have "EVER" been convicted on a felony. Regardless if it's Fed or requiring ANY kind of clearance for contract working or bonding/insurance..etc.

Usually, a standard check is 7 years, but being a felon... especially if it was a crime of "moral turpitude" (lying, stealing, sex offense, drug use..etc) can haunt you forever.

I was convicted of a felony in 1996. I have had many jobs since then. I have always been honest about my conviction.(not proud of it). Most of the jobs I have had ran a background check & nothing came back. I have worked in schools, nursing homes & financial institutions.I am trying my best to get a lawyer to try to have my record sealed or expunged.

Just an observation: Some vocational counselors advise people who can't answer the "have you ever..." question with an honest "no" to write in something like "Will discuss." That way you're not giving them grounds to reject you out of hand, you're not lying, and if you get an interview you can put your transgressions in the best possible light ("I was young and stupid, I paid the price," etc.). But saying "no" when the honest answer is "yes" could come back and bite you in all kinds of ways.

Your just lucky, some states dont report, some counties dont report to states etc etc, usually an employer will just go with state you live or lived, state you went to college and actual county you live in now.

For example, when i run a background the options for DC are:

DC State full crim
DC county full crim
DC police

the background check companies dont clarify or take responsibilty as this increases their liability, and companies just check to tick a fucking box.

put it this way, if i was going to commit a felony i know exactly which counties in which statess to do it in, and no one would ever know.

go figure

sex offenses are different however.

I know this post is a year old but I started reading it and couldnt stop because of all the idiots talking about crap they dont know....

The convictions didnt show up for one of two reasons

1 less likely.... The people that did your check are idiots

2 99% this is why... It happened so long ago, most checks are done in 3, 5, 7 or 10 year periods. Even with a felony that doesnt come off your record if your company only paid for X years back thats all they get. That being said, there are also state laws put in effect that limit the amount of time a 3rd party contractor (which most companies use to do checks) can go back and disclose to an employer, state laws vary on time and some have certain specifications but there are there..

The same thing happen to me. I got a job where they checked my backround. I was honest with my employer and told him I had to felony convictions 8 years ago and when it came back I was happy to hear it came back clear, but this is only because the company I was hired at only goes back 7 years

It'sreally bad when no matter how hard you try or how good you are it's never good enough. I've been to job after job after job and I'm honest and I never hear anything back. I know you going to laugh but I can't even get a job at McDonalds flipping hamburgers. All I want to do is move on with my life. A felony conviction is no bar to getting an IT job. I once worked with a guy who was arrested on felony drunk driving ON THE WAY TO commit an armed robbery.

Once you get out of Mom's house/bed, you'll pick up on what matters and what doesn't.

That is why they perform background checks in the first place because they can't ask outright.

According to the EEOC, there is no federal law prohibiting asking about arrests or convictions, although such information may not be used to discriminate against a member of a protected class. "Convicted felon" is not a protected class. State laws vary, but Virginia apparently does not prohibit asking about convictions, except convictions that have been expunged.

Many employers don't ask about arrests because many arrests don't result in convictions. But I don't know how anyone could imagine an employer wouldn't be entitled to ask an applicant whether he has ever been convicted of murder, rape, robbery, embezzling, assault etc., etc. Asking the question saves them the cost of running a background check on an ineligible applicant.

If an application states "have you had a felony in the past seven years" and he states no then he is not lying. People get off your high horses people with felonies need to work too. problem is they lied to produce "juicy records" so that employers would be impressed with the database. sometimes just no legal backing to content: but also straight out fabrications in data were found.

Its no wonder people w criminal historys 7yrs or older lie when there's no hope to land a job when your honest about It. At least you might be employed for a little while to somewhat provide forn your family. When a person struggles to turn their lives in a positive direction and feel good about leading a positive life to be constantly denyed even to get an interview to give your explination, is jus shoving that person back down emotionally. Its no wonder Americas jail and prison system is a revolving door. Half of the people who responded to this are lacking empathy and juus come off as arrogant assholes.

I have the same problem. In 1995 just before my 21st birthday I was fined for a class 4 misdemeanor (public intoxication) in a night club 2 blocks away from my college dorm. Yeah, I was young and stupid. That was 18 years ago. I recently did a search on the Central Criminal Record Exchange (CCRE) with the Virginia State Police and no data conviction was found.

How come my record did not show up in the background check?

My felony use to show up but now it don't...after so many years it becomes sealed from employers but is still there jus not to be viewed..jus thank God and leave it alone...I didn't question it..I jus thanked him and moved on...if it say no record then it will be a no on the application..and I served prison time for it back in 2004...

A felony conviction for manufacturing several illicit drugs in virginia earned me a job as a ligitimate drug chemist for a respectable company; however, this company needs to be registered as a drug producer that sells (legitimate) drugs in texas, the question of felony convictions is part of the drug licensing application (page 2 on texas form DRUGS OOS-OTC 2502).
I would hate to be the reason that this company cannot sell drugs in texas... that would be the end of my job.

It was a sting operation and never had any intent to meet, see, or touch any minor but they responded to me in an adult classified ad section and because in the email address the name was calicools13 they said I knew it was a 13 year old girl... fucking calicools13 my life was almost completely ruined but my high priced attorney got me 5 year probation and registering as a sex offender for 25 years until I can challenge and have myself removed. Dont you get it everythings about money in this fucked up country. I never had a charge prior or since and would never touch any child in a sexual way but yet im labeled a sex offender.I own my own business and bust my ass everyday to support my self and my wife while doing everything required by the biggest money baggers, the law. And I pray the day comes when a close minded prick says some dumbass remark to my face about being a sex offender so I can stomp the the asshole into the ground. And yeah it enrages me to that point because I was one of you weakminded fucks until I experienced truth first hand... Yeah there's people out there that are animals and need to be put away but for alot they were just a dollar sign to keep this wonderful counrty with its fucked politics, blind unfair judicial system and brainwashed sheep who are being led by a one eyed, crippled selfish greedy shepard. When I was looking for work, my background check was not an issue. If you are looking for a job where a background check is not going to be an issue, you really should look at another job search option. If you are working at a place where it might be a problem for your background check, you really should think about getting on board with another job search company like granted.com. Granted.com was the best option for me when I was looking for jobs in Virginia.

Some people think that committing a crime is the worst thing possible, your not innocent just haven't gotten caught yet....Jail isn't paper made...its very easy to land in there with a blink of an eye....Ex felons has paid their dues to society...everybody deserves a second chance..
There should be a statue of limitation on how far a company can go back on a persons background....Maybe if the do the crime rate will go down because if a company isnt willing to give second chances people has to still survive, take care of their families and their going to do what they have to do to do it...whether it be selling drugs, robbing and or stealing...it is what it is....

I am enjoying this thread and all the responses. It seems everyone is very opinionated on this subject, myself included. I had a very nasty drug addiction and in the late 90's and early 2000's racked up a very extensive non violent criminal record. Since then, I have cleaned up and have learned to live without drugs and crimes to support my habit. At resume building classes and job interview preparation we are always told to answer the felony question with a "will discuss at interview". This way, you can't be penalized for not disclosing and it gives you a chance to explain in person the circumstances surrounding those conviction(s). You can explain to the interviewer your strong points, why you would be a good fit, along with any degrees or higher education. If they ask about the felonies, I tell them the truth. I am human. I made some bad choices and have learned from them. I was convicted of fraud and falsifying business records. I have a DUI and some simple possession charges. I tell them what I have done to rehabilitate myself. I dressed up for interviews. I spoke with intelligence and confidence. I disclosed all my info and I got the job! (At a security company no less). I not proud of my past, but my experience has made me a better and stronger person. There are companies that will give you a chance. It's not worth the gamble lying on an application, but there are ways to answer that will make them still want to interview you and not reject you strictly by what they see on paper. they may also be information houses who keep track of your "portfolio" (whatever they have they can by any means take from you)

So I am 27 years old and when I was 18 I plead guilty to poss. of marijuana. That is the only thing on my record, was in no trouble before or after and it has been almost 10 years. I recently had a background check completed by the state of VA for an adoption/custody issue, and the lady just called and said my record was "squeaky clean" why or how is this possible??

I don't get it either. In 2002 I was released from prison after serving 4 years on 8 for arson with intent to defraud and extortion. I was originally arrested in 1997. There were some flukes in my case because of a dirty fire inspector, a cop or two with family ties to the real arsonist etc... I was a kid, though legally an adult. I worked for a retired organized crime guy that had a horrific accident leaving him disabled. His son, and his daughter were friends. He became very unfriendly when he imagined that his daughter and I were involved. I was facing 30 yrs in prison. So, I fled the country. I lived outside as long as I could. My girlfriend became pregnant outside the U.S. and because of the heat caused by EL NINO, she was going to lose the baby. The doctors said that we needed better medical care to save it , and if we could get to the U.S. the baby would be fine. So, we came back, and a few months in I was snitched on and arrested and forced to face the same dirty bastards. The old man had passed away and my time went down to eight years. Mind you, I know murderers that have done less time. But, I did my time, worked out , got my GED, and a Diploma in welding and fitting, etc.. Katrina wiped out New Orleans, I moved to Georgia. In Georgia I applied at a company that is world wide, 187 countries wide. Didn't know there are that many. The agency calls me back and says that everything I told them on the application doesn't exist. There are no records of my background that I stated on the app. So, for years now I have been an alcoholic, mainly because of my prison experiences. Not because I was punked or anything like that, but because I've seen things like a persons face melted off by magic shave and baby lotion microwaved for 40 seconds and thrown on them. Or guards breaking 6 ribs and a jaw on a guy for hitting a snitch. Or my best friend inside telling me its no biggie, put up a curtain and let this guy suck you off, you won't know the difference. It goes on and on. Whatever the reason, I'm a functioning alcoholic, but I'm fighting to stop completely. I got myself sober enough to apply for a job I'm over qualified for , except for the background. I've been turned down for jobs simply for over qualification in fabrication. I can build anything from anything. Like Magyver sp> but recently I'm thinking my background has resurfaced due to deeper technology. Which means I'm fucked. I have been married 18yrs now. I have 3 great kids and two dogs. I'm that guy in the neighborhood you can count on, cause I haven't even had a ticket since 1997. But here I am unemployed and exhausted. If ppl are going to hold my past against me, why should I continue to be good? I'm naturally gifted at being bad, and since we are all supposed to be born into sin, why shouldn't I own you when you doze me? I'm in a dark place right now, and its not cause my lights are off. I could've been anything in this world. But I was abandoned by mom and dad and left to the streets by 15. I slept in culverts at public parks, ate from dumpsters , backs of Dominoes pizza joints, McDonalds garbage etc. But yet here I am , and still paying for all those years ago. I want to kill myself, but I can't hurt my family that way. And seeing how I feel that way because of ppl like you , I feel hate for you, like you are the enemy, even though I fucked my life up because I didn't know any better. So I look at you and want to hurt you , or take what I need to provide/survive. I'm praying and hoping that the circle of life really is just a song in a disney production. Because if I'm off the chain with all I know, just to provide for my family, you ppl are in for a sequal of D day. I'm not just a convict, I'm smarter than a 5th grader, and can build anything, out of anything. But this world is oppressive to the point of attack. I hope someone out there figures it all out. I wouldn't punish my dog forever for tearing up my couch, or pissing on my floor, or even biting my neighbor.

In 2004 I was convicted of two Marijuana with intent to distribute felony charges.

Since then I have had no other conviction except maybe minor traffic infraction. I went back to school and graduated from GMU. I also got married.

Recently I went through a recruiter who got me an interview with Sprint for an IT Data Center Tech position, which I did great in and they offered me a job. 6 months contract to perm.

I then go back to the recruiter and fill out paperwork and explained to him my felony conviction in 2004. He comes back with a blank sheet of paper and tells me we only check back 7 years. Just put no on here and if nothing comes up your good to go. I'm waiting for the background check to come through and hear back from them....

Hey, I'm not going to advocate criminal behavior but there are a lot of yuppies in the area and the brothers look at them like the lions in Africa look at baby gazelle, and a lot of those guys have done time too so....you can read between the lines on that one

Let me tell you something else. If you see these weak, limp-wristed yuppies with their kickball playing, starbucks drinking, mcmansion building, career-ascending, me,me,me, phony patriotic ways and don't automatically want to kick their teeth in than their is something wrong with you, so I say hate on brother. Look I'm glad their are so many people with clean records looking for jobs. I got a drug possession charge in another state when I was 19. Because I was from out of state the charged intent to deliver. I was working out of state as a laborer.It was all of our weed but I claimed it to keep the whole crew out of jail. That was 20 years ago. I've been in no trouble since. I was a dumb kid and people can change. I'm now 40 and still doing construction. I'm a superintendent now but I'd trade it all for a chance to work in a plant and go home at the end of each day. A felony is a felony and it's a flawed system because in my 20 years I've worked twice as hard as any shift worker and spent my life without being able to see my wife and my kids. I have to work whatever amount of hours it takes to get my site finished on time. I've missed my step mom's funeral because the job site comes first. I've worked 36 hours strait take a 4 hour nap and go back in. I would trade 75,000 a year of pure misery for a job on a line where i could come home every day but even though I've ran heavy equipment and I'm the safety and compliance officer on my sites, know every form of lock out tag out, never missed a day of work. Nobody will hire me except construction companies. Their the only ones not wearing blinders

To the construction worker above...you're good for doing what you do for your family. I don't understand why people act like ALL felons are the same. Its all about your life after the felony. I've went to college and I graduate next month for HVAC. I am a 32 year old woman that honestly can't stand HVAC but I figured this field might be more forgiving about a felony.

Most of the ppl on here have lived a sheltered life. I grew up a white boy in Humboldt park Chicago. It is a Puerto Rican getto and one of the most violent neighborhoods in the country. Imagine the life and mentality I had to have. At a young age I picked up a gun. I've been convicted of armed robbery and manslaughter. That was 30 years ago. I served my time and even been forgiven by victims family. I have since lived a honest life. Should I be punished for the rest of my life and denied a way to legally provide a decent life for my family? BTW, victim had shot me 10 months prior to my retaliation.

I am a Software Engineer who was wrongfully convicted of "attempted manslaughter / imperfect self-defense" for defending myself with a legally registered firearm from two attackers. My $40,000 defense attorney threw me under the bus.

I'm currently waiting to hear back from a company who interviewed me and liked me. They wanted to hire me but the background check is holding me up. Now I may be denied the job.

I used to be a "yuppie", totally ignorant of how the criminal justice system works. Especially in states like California with it's Orwellian gun laws. I had no idea that doing time for your crime is just the beginning. Unless I get this job, or someone in my field will give me a chance, my career is totally ruined.

Never plead guilty like I did if you have a chance at beating your case in trial. Worst mistake I ever made. If I had known it would cost me my career I would have fought it all the way.

I now sympathize with many of the felons out there. The punishment doesn't fit the crime. Lock a man up... sure. But deny him a means of survival once he's done his time?

I will tell you why.

When you are arrested in certain states it does not get recorded in a National Database like you might think. It is only accessible to the state.

VA currently is one of the states that does not report to a national database. West Virginia too I think (don't quote me on that).

Also, WITHIN Virginia the different counties do not always report to each other.

For example (True story & BTW I was not found guilty of anything):

In 2008 I was arrested in Fairfax county for attempted murder.

In 2013:

I was arrested for a felony in Fairfax County. I was released on bail because it was my "first arrest". As part of my release, I was told if I was arrested or accused of another felony I would be detain until my court date.

A week later I was again arrested for another felony in Prince William County. They let me go with the same warning.

A few weeks later, again I was accused of another felony in Prince William County. The magistrate let me go, but mentioned I had to be under police surveillance because "It was my second offense".

During the time I applied for a job. They did a background check, and only the 2013 Fairfax County arrest showed.

I asked my lawyer this same question. I was told that some background checks are national, some local ect. If the one the job did on me was national they would probably gotten nothing, but because they did a local search they got the one in Fairfax County. Also, because they were only looking for the last 5 years or so, the first one never showed.

AGAIN, I never did anything illegal, and all the charges were dropped. So it might be different if you were convicted.

I just get arrested a lot because cops are assholes, and I refuse to be questioned. Go ahead, arrest me, drag me to court, but you will not get a damn word out of me.

Yes, never talk to the cops. When they say anything you say can and WILL be used against you, they are not just saying that... they mean it.

In my case I said I was "angry" that two punks had thrown trash at me (as any person would be). This statement (and many others) were used against me to paint me as a violent/dangerous individual. Nevermind I was attacked, the whole thing was started by the trash throwing, etc etc. Once the cops have a theory and decide who did what, nothing you say will help you or change their minds SO DON'T TALK.
