Lets say I host a Texas Hold'em games at my house and payout the top 5 players. Are there laws against this? I heard that as long as the house doesn't take in any money then it is OK. Is this true?

Partially true. It depends on how big the tournament is and how much money is at stake. If your have 5 or 6 people come over and the pot is 2 or 300 bucks they wont care. Yours sounds like a much bigger tournament though which they would care about. You cant have 20 people tournaments ect or be playing for thousands of dollars because they will act if they find out

Its still gambling and illegal they just dont care if its just friendly games with friends. Theres still a lot of luck in poker too, you can make all the right moves and get your money in at the right time but if the guy out draws you he outdraws you

They key here is really the issue of what is the house taking in. It's been probably 5 years or so now but my old roomate was a wedding photographer. One of his clients was a couple that was running a good sized ( 20 + people on many nights ) set up out of their house out in Centerville. They would charge people a small fee to play and in return they would provide food and drinks but didn't really take a cut. One of the guys that was a regular at that place was down on his luck and began stealing money from the Pizza Hut where he worked. He got caught doing that and went to the police and worked out a deal with the police to go in as a CI and play with marked money while they built up a case. The CI reported back that they kept a gun in the house because several places had been broken into around that time. When they were finally ready to go in they went in with a SWAT team because of the knowledge of guns. Maybe some of the Centerville guys remember what happened. No idea what the final outcome was but it played out in court for over year with appeals and other filings.

?? Nobody got shot that I was aware of. My understanding was that they questioned everyone, detained a few and that was it when SWAT came.

That is what some states are using to make online poker legal. It is true poker is a game of skill. It is not like pulling a handle on a slot machine which is luck. If you dont have a good working knowledge of the game you will be the loser everytime.

First off, it appears that all gambling is illegal in VA, unless it's specifically defined in the Code as legal (i.e. the government runs the operation like the lottery § 18.2-334.3). It also seems like if you are just hosting the gambling operation you don't even need to make money off of it for it to be a class 6 Felony. Just "supervising" it is enough (sounds close enough to "hosting" to be scary).

But then there's Section § 18.2-334 which excepts it if it's in a private residence (?), as long as there's no "Operator". That's a broadly defined word which they'll used to hang you from a tree with.

Really not sure why the government is even involved. Oh yeah, the Bible.

§ 18.2-325. Definitions.

1. "Illegal gambling" means the making, placing or receipt of any bet or wager in the Commonwealth of money or other thing of value, made in exchange for a chance to win a prize, stake or other consideration or thing of value, dependent upon the result of any game, contest or any other event the outcome of which is uncertain or a matter of chance, whether such game, contest or event occurs or is to occur inside or outside the limits of the Commonwealth.

For the purposes of this subdivision and notwithstanding any provision in this section to the contrary, the making, placing, or receipt of any bet or wager of money or other thing of value shall include the purchase of a product, Internet access, or other thing, which purchase credits the purchaser with free points or other measurable units that may be (i) risked by the purchaser for an opportunity to win additional points or other measurable units that are redeemable by the purchaser for money or (ii) redeemed by the purchaser for money, and but for the free points or other measurable units, with regard to clauses (i) and (ii), the purchase of the product, Internet access, or other thing (a) would be of insufficient value in and of itself to justify the purchase or (b) is merely incidental to the chance to win money.

4. "Operator" includes any person, firm or association of persons, who conducts, finances, manages, supervises, directs or owns all or part of an illegal gambling enterprise, activity or operation.

18.2-328. Conducting illegal gambling operation; penalties.

The operator of an illegal gambling enterprise, activity or operation shall be guilty of a Class 6 felony. However, any such operator who engages in an illegal gambling operation which (i) has been or remains in substantially continuous operation for a period in excess of thirty days or (ii) has gross revenue of $2,000 or more in any single day shall be fined not more than $20,000 and imprisoned not less than one year nor more than ten years.

As used in this section, the term "gross revenue" means the total amount of illegal gambling transactions handled, dealt with, received by or placed with such operation, as distinguished from any net figure or amount from which deductions are taken, without regard to whether money or any other thing of value actually changes hands.


§ 18.2-334. Exception to article; private residences.

Nothing in this article shall be construed to make it illegal to participate in a game of chance conducted in a private residence, provided such private residence is not commonly used for such games of chance and there is no operator as defined in subsection 4 of § 18.2-325.

Bottom line is playing poker is technically illegal to do for money. If you have a very small number of friends and the pots arent that big the cops dont care. You start holding large tournaments for playing for a lot of money and they care.

While luck may win you a few hands in the long run I will take you to the cleaners. Do you think it is luck the same people show up in the final ten each year in the WSP? In a true tournement you cannot keep digging out money waiting for luck to happen. You buy in with a set amount, once you get cleaned out you leave the table, thats how it works.

I didnt say the exact same ten, I said the same people meaning the same faces more or less. No one ever got to the final ten on just luck and saying it is just luck will make you an easy mark for a good player.

I watched Rounders many years ago and the saying still holds true. Reading the other players, knowing what cards are already out and the percentages of obtaining certain hands is skill and not luck. Only a fool would call the game luck.

Only a fool would not admit luck is a big part of the game. Theres a reason even the best pros will be some of the first out in tournaments. You can make all the right moves but if you get outdrawn your done. Skill improves your chances but if you arent getting cards you arent going to win consistently period

Luck a big part? I dont think so. With little to no skills or knowledge of the game you will be an easy target. The pros go to the small venue poker rooms and clean up with people having that mindset, happens all the time. I have seen it in Charlestown over and over. People who come to the table with the idea luck will carry the day will soon be broke. I have seen people that didnt even know the ranking of hands. An easy payday for those looking for piegons.

Your saying luck is a big part marks you as a sucker. I will hold three of a kind and you try to fill that inside straight with one card left, let me know who will be the winner the majority of the time.

You obviously dont understand what luck is. No luck doesnt work everytime but it doesnt matter what happens in the long run while your on the hot streak it works. Im not talking about idiots that dont even know how to play.

Get over it luck is a part of the game. People get sucked out all the time. If it was all skill it wouldnt be gambling. Its gambling not a sport

If you were the poker genius and so great at it wed see you at the final table on ESPN

They win maybe 5 to 10 percent of the events they play in. Brunsons probably played in a 1000 events. If it was skill and only still the same 5 to 10 people would win every bracelet. In REAL sports the elite players dominate especially in an individual sport. 6 people have won 8 or more bracelets yet they all play in 8-10 events a year every year. I guess they just dont feel like trying most of the time.

Youve obviously missed the entire point yet again. Your making non relevant comparisons and acting like im talking about just saying all in every hand. Let me put it to you in the simplest of terms. You could have too top flight pros at the table. The majority of the time the winner will be the one you gets the better cards. A hand here or there one of them might out play the other but they both have skill and who ever has the better luck of the cards will win.

No shit a casino wins in the long run because they have an advantage in every game. In the short term on any given day depending on players LUCK the casino could make a ton of money or be cashing out a ton of chips.

Poker is gambling and luck is involved its not all skill and its not a sport end of story

Carry a rabbits foot, your lucky penny or wear two different socks the odds of obtaining certain hands are fixed. I have played in many tournements and at first I felt some guilt for taking peoples money who had no business being in a game but that is the only way they will or maybe will not learn. When they get beat they curse luck and say if only I had gotten lucky and filled the inside straight or gotten that flush. The odds beat them I just happened to have the odds on my side they didnt.

Okay so since luck has nothing to do with it why do pros go out on the first day of the WSOP? Why is the final table not all pros? Do they just not feel like trying some days? Why do they go on cold streaks where they will lose millions in cash games?

By your logic the answer is that they just get tired of winning and want to mix it up

The law cannot take your money, but if your income from games or bets exceeds the amount established by the state, then you must pay a special tax. I just bet on a new betting site and was able to win more than 25,000 bucks in a couple of months, and the tax office ordered me to pay out about 6,000 bucks. I was shocked, but I had to hatch this money. So the government requires taxes from literally everything.

Gambling should definitely be regulated strictly. I am into sports betting and I just hate the fact that there are too many betting websites that just fool their players and only a few ones can be trusted. Like, those ones listed on https://apps-bet-nga.net are good.
