§ 46.2-1508. Licenses required.

It shall be unlawful for any person to engage in business in the Commonwealth as a motor vehicle dealer or salesperson without first obtaining a license as provided in this chapter. It shall be unlawful for any person to engage in business in the Commonwealth as a manufacturer, factory branch, distributor, distributor branch, or factory or distributor representative without first obtaining a license as provided in Chapter 19 (§ 46.2-1900 et seq.) of this title. Any nonprofit organization exempt from taxation under § 501 (c) (3) of the Internal Revenue Code, after having obtained a nonprofit organization certificate as provided in this chapter, may consign donated motor vehicles to licensed Virginia motor vehicle dealers. Any person licensed in another state as a motor vehicle dealer may sell motor vehicles at wholesale auctions in the Commonwealth after having obtained a certificate of dealer registration as provided in Chapter 19 of this title. The offering or granting of a motor vehicle dealer franchise in the Commonwealth shall constitute engaging in business in the Commonwealth for purposes of this section, and no new motor vehicle may be sold or offered for sale in the Commonwealth unless the franchisor of motor vehicle dealer franchises for that line-make in the Commonwealth, whether such franchisor is a manufacturer, factory branch, distributor, distributor branch, or otherwise, is licensed under Chapter 19 of this title. In the event a license issued under Chapter 19 to a franchisor of motor vehicle dealer franchises is suspended, revoked, or not renewed, nothing in this section shall prevent the sale of any new motor vehicle of such franchisor's line-make manufactured in or brought into the Commonwealth for sale prior to the suspension, revocation or expiration of the license.

Violation of any provision of this section shall constitute a Class 1 misdemeanor.

Selling of cars for profit without a license is illegal in every state. It's called flipping cars or curbstoning. Here is a website you might want to visit: stop curbstoning.com.

You can also call the Virginia DMV at (804) 497-7100 and inquire. Ask for their division dealer services division.

The laws for selling of cars were written to protect the consumer from being taken advantage of and of course to protect the dealer's sales. You may not agree with it but it's the law. Rationalizations for violating any law is an immature mistake. In Virginia, if found guilty, it's a misdemeanor.

You, as an individual, can sell as many cars as you want IF you are titling them in your name and paying the sales tax.

Licensed dealers can transfer ownership on a re-assignment so they are exempt from titling the car in their name and paying tax.

Individuals can NOT use re-assignments so they skip titles (telling the person they bought the car from to leave the Buyer's name in Section A of the title blank). This is ILLEGAL and you can't do it on even one car a year.

It's all about the Sales and Use Tax. Skipping titles cuts the State out of a taxable sale. and they don't like that.

Hello, unfortunately scams and understatement are still common among car dealers. To a large extent, you can protect yourself against them thanks to the VIN Check. A good decoder should provide data such as vehicle mileage, service history, stolen vehicles in databases, damages reported to insurance companies by previous owners, photographs, and registration history.

ANY NON-MILLENIAL can explain that I remember when the law was made. It was made AFTER THE LEMON LAW, a kinda follow-up on the same, when during the great satan BILL CLINTON regime, dealers were doing fake paperwork and corrupt Courthouses were refusing to handle the litigation resulting (since ultimately - there are many courthouses INVOLVED IN AUTO THEFT RINGS - playing members of).

The law applies to Commercial Sales not private sales. You have to be a dipshit not to realize the difference.

BUT NO YOU CANNOT do it if you don't own land:

* fire department code how many cars your allowed ot have at a "residence" - enforced by bill clinton types (to insure your family is fucked into paying more and doesn't have work and etc)

* if your not the owner you can't decide to start a business on the property: it's illegal. there isnt' an owner out there who gives a crap if your employed

* you can't run a business out of your home, though many say "ebay trading" doesn't qualify as a home business

YOU CAN sell privately. You don't need a license. Your neighbors could complain - but there again - if your AN OWNER and signed a "HOA AGREEMENT" your a fucking fool and deserve the devil spawns they will throw at you.
