I haven't had a ticket since 1987.

The other day, I was turning off of the Parkway onto Backlick Rd. near the Vol. Fire Station. The light was green. As I was getting up to the intersection, the light turned Amber. I didn't want to slam on my brakes so continued with my turn. The intersection is a wide turn. I didn't go through the intersection on red.

There was an officer in the Fire Station's lot. He turned on his lights and pulled me over. He didn't ask me any questions. He just stated that he was giving me a citation for Disregard of a Red light.


Should I go to traffic court?
If I prepay, the fine is $100. and court fees $62.

If I go to court and explain that I didn't think that it was safe to apply the brakes as the light turned Amber, I may not be charged with 'disregarding a red light'.

Sine you haven't had a ticket in so long, you have a +5 record which plays a big part to the judge.

District Court Fairfax County- a ticket that I got (not the OP) for Disregard of a Red light on Old Keene Mill Rd. has a different code

82.1-6 (46.2.821)
82.1-6 (46.2.833)

Both of these are for Disregard of a red light. What makes the number in (46.2...) different for the same type of charge?

So, if I went to Traffic Court, and told my reason for continuing into the intersection, I might not be charged with Disregard of a red light?

I wasn't in a hurry or rushing. Just didn't want to throw the brakes on.

Thanks.

Why didn't the Officer just ask me when he pulled me over? He didn't let me say anything. Just asked for my lic. and Registration telling me that he would give me a citation.

Do the Officers always go to Court? A coworker told me that they sometimes don't show to traffic court & then the ticket is dismissed that way.

Because all they do is hear excuses all day long. Either you did it or you didnt and he saw you do it so he was giving you a ticket and wasnt interested why you did it.

Yes theres a chance he may not show up or the judge may cut you a break, but theres also a chance that you stick with the ticket and get hit with the court fee and the day off from work. Theres no assurances and a lot will depend on the judge and what kind of mood theyre in that day.

Just showing up gets the charge reduced. I had a one ticket already on my record and my speeding was reduced to "disobeying a highway sign" by my no-contest plea.

Pleading not guilty will push you to the back of the line so that they can process all the no-contest and guilty pleas.

With your record, you haven't been in traffic court for a while. You will be out of your element. Your crappy little ticket for turning on red will be nothing compared to the multiple DUI (with people being hauled off in handcuffs RIGHT THERE) and some fucknut that has been busted - AGAIN - for driving without a license.

You will eventually realize why people with jobs and lives and something to lose just pay the ticket and not show up for court. Just going to court is punishment enough.

wnrsm-That may be the best description of Fairfax traffic court I've ever seen. However that "Just showing up gets the charge reduced" seems to depend on the judge and the prosecutor.

Perhaps the officer was sent because they'd had complaints about too many people running red lights at that intersection and he was in a rush to get back and write more tickets. Think about it. He's already decided that you broke the law, so what are you going to say that makes him think otherwise?

The guys that work at Springfield Toyota tell me that this same Officer sits in the left turn lane on Backlick near the Fire Station or in one of the parking lots just watching several intersections.

He has been known to do this for over two years. I'm sure that he brings in quite a bit of revenue for the State/ District Court.

The fine for disregard of a red light is 100. plus the 62 court fee.

In My opinion he passes out tickets and leaves it up to the driver to 'pay' or go to court.

What a freaking hassle.

To go to court to say what? He never asked me why I did it? A ticket isnt an investigation. Theres no reason to ask why you did it. If theyre curious or considering giving you a break they might, but once theyve seen you do it theres not anything to discuss if theyre going to ticket you

two points,

1. Section 46.2-833 of the VA code says you're supposed to stop on a yellow light unless you have already entered the intersection or a crosswalk. So telling the judge that you intentionally ran a yellow even though it was yellow long before you made the turn will only result in a guilty finding.

2. The police officer is paid to be in court so that's where he will most likely be when you show up for your ticket. If he can't make it all he has to do is call the court ahead of time and they will reschedule the hearing. Of course you won't know about this until you take a day off from work and sit in the courtroom all day ... only to have the judge reschedule the case. Oh, but it gets worse, because even f the cop doesn't call the court ahead of time FFX county judges are known for saying things like "Well we didn't hear from the officer but it looks like the he couldn't make it today so I'm going to reschedule until ..."

Bottom line is you need to pay the ticket

46.2-833 is running a red light.

46.2-821 is running a stop sign or not yielding at a yield sign

They are not the same.

You folks really need to step up your salesmanship game. I was pulled over four times in Fairfax County, two times while over the legal limit, and used the words "sir, I am so sorry, but....".

Nope,

46.2 - 833 is "Traffic lights; penalty"

You can get a ticket under 46.2-833 for running a yellow light which is the OP's problem.

Pay the ticket cause you know you wrong. Bitch and moan at the cop for trying to keep that intersection clear of accidents (Geez, I wonder why he sits there all the time..........dur!) all you want if it'll make you feel better.

yes and no. about 8/10 tickets i paid were not my fault. but i'd pay them.

but you SHOULD argue $162 ticket that's a new sharon bullova / foreigner gov fiasco. they did it - not one previous. just those people. they cannot point to anyone else.

tickets were $15 (non-moving) up to (a max) of $75 (excessive)
