Dog Walker Acquitted in Pooper-Scooper Case
FAIRFAX, Va. - A dog walker accused of failing to clean up after a friend’s pet has been acquitted.
A seven-person jury delivered its verdict after only about 15 minutes of deliberations, with one juror saying afterward the case appeared to be a “vendetta.”
Two households at the Penderbrook condominium complex have been feuding for years. The Cornell sisters, Virginia and Christine, complained that their neighbor had walked a dog without cleaning up the waste for three consecutive days in late March and early April. The sisters offered evidence from a camera that is always mounted in a window because of the feud. (They also offered other photos shot from handheld cameras.)
The photos showed their neighbor, Kim Zakrzewski, walking a dog. Handheld shots of dog poop on the ground were also submitted.
But the owner of the dog, Michelle Berman, testified that the poop in the photos didn’t look like waste produced by her 19-pound dog. Berman told the judge she had bagged more waste from the dog as the day began, and offered to bring it in from her car.
Circuit Judge Jane Marum Roush threw up her hands in mock horror, shaking her head, and said, “I don’t think you could get it past [court] security.”
The defense claimed that the Cornell sisters were pressing a vendetta, and got one of the sisters to admit they had called police on Zakrzewski on a half-dozen earlier occasions. The sisters said they did so because of threatening or dangerous behavior.
Zakrzewski told reporters afterward she hopes the acquittal is “the end of it.”
