marijuana possession

hey everybody --

i have a court case tomorrow for a marijuana possession charge. i'm wondering what kind of sentence i'll get (suspended license, probation, etc). here's what happened:

a friend and i were sitting in my car (pulled over, the engine was off) when an undercover cop rolls by, sees us turn the console light on, and pulls up behind us. we had an 1/8 of pot in the center console, plus two bowls in the glove compartment. my friend told the officer everything in the car was his, but the cop charged both of us with possession.

my question is, with that information in mind, what are the odds of getting my license suspended or getting probation? any help would be awesome. THANKS :]

You'll get some sort of probation/court ordered treatment. Maybe a suspended license. Its hard to predict since a lot depends on the judge too for what they want to do

Anyway.. you won't get "30 days in county lockup"; first offense you'll get what's called "deferred disposition". Virginia Code §18.2-251 provides for the dismissal of the charge after you complete VASAP, some community service, and endure the 6 month license suspension. You typically get a restricted license granted that will let you drive to/from work, medical appointments, and the VASAP/community service. Don't screw yourself by driving to your buddies house on a restricted, they'll make you pay. Google "Virginia 18.2-251" for more information.

Oh, I'm aware of what the law says...but there's been increased efforts by the county judges to have first time narcotics offenders serve time. I certainly don't wish for him to get 30 days...Goddamn...

Your license will be suspended for 6 months to a year, you'll have to go through VASAP, get SR22 insurance, and get a Restricted license. I got "caught" with 0.086 grams of pot and this is what happened to me. After VASAP, they dropped the charge.

actually there is a fairly good chance he could get a 30 day sentence, however it will be used as incentive for him to complete the treatment program and stay out of trouble as it is almost always suspended

i'm a white female who was in the car with a male. i have no priors on my record (aside from a failure to yield ticket). i guess what i'm really wondering is what they'll try to sentence me with if he takes responsibility for everything that was in the car (which he already told the cop).

we'll see how the trial goes tomorrow and maybe i'll pay him back haha.

for those who suggested the 251, we went to our arraignment back in august and were offered the option to take it but both of us declined. he's planning on pleading guilty and at this point i think i'm going to try to plead not guilty.

Damn..should have done the 51, but if it's your first offense you'll get your license suspended for sure. And maybe probation which will most likely included some type of mandatory "treament" but either way, good luck to you both!

wow this thread got a little hostile...

anyway i just wanted to post an update - the friend and i both pleaded guilty, he was given a $200 fine and 6-month license suspension, i was given the same thing except my fine was $100. the 251 is a joke, i know they say they expunge it from your record but it's not worth the hassle of everything that comes with it.

This is my first offense so I'd like to know what will most likely happen to me? Is it likely that they will suspend my license? If so, can I request for a special license for school/work without a lawyer present? Thank you in advance.

I will lobby against this! Your first offense should have never happened. You were engaging in illegal activity, and now you are seeking redemption. Word of advice, don't wipe your ass before going into the slammer. Perhaps drink a bottle of prune juice before going into lock-up!

First off, no, do not try to do this without a lawyer. If you cannot afford one (you must be able to prove this), you can get assigned a public defender.

The sentencing is different for everyone. If youre looking to plead it out (yes you still need the lawyer) they might give you the option of 6m suspended or 12m restricted. Youll likely have to go through VASAP which includes 10 weekly meetings about bad stuff that happens to you when you do drugs. Youll have to complete 10? or so NA or AA sessions and depending on how your intake goes, probably have to do group therapy. 16 or 32 sessions I think is what it runs.

Should run you 2-3k when all is said and done.

Thank you for your HELPFUL response, I will get started on applying a public defender asap.
There's also this program called 251 disposition, anyone ever heard of it? Is it worth it?
