Wreckless Driving Ticket

I just got a wreckless driving ticket going 82 in a 55 out on Rte. 28 near Dulles Airport. I have -11 points on my driving record and a DUI which was 4 years ago. I'm concerned about jail time and restriction of license. Should I get a lawyer?

You should always get a lawyer for 6 point violations, especially Reckless driving. A reckless driving offense will remain on your record for 11 years and will cause a large increase in your car insurance payments. As you also have a DUI on your record (which stays on your record for 11 years) it is possible that your insurance company will just drop you as a client.

Again, get a lawyer. It doesn’t matter how good a day the Judge is having, they won’t give you any leniency because of your DUI conviction. Any chance you have at getting the charge knocked down rests in the hands of your lawyer.

I’m not sure what the Judge can do to you in this case. I don’t think you can be sent to jail for a reckless driving conviction even if you are a habitual offender. The Judge may order you to attend a driver improvement class or they may take away your license. Your lawyer will be able to give you an idea of what to expect and what you can do prior to your court date that may help your situation (like taking a driver improvement course prior to showing up in court).

Good luck and stop disregarding traffic signs. However, with gas prices where they are, perhaps not being able to drive is a good thing.

Here is some basic information about your license and points assessments that I found on the VA DMV website.

Points are removed from your record two years after the date you commit the offense. The offenses will remain on your record for a length of time that can be different for each offense. Insurance companies also use points and these will remain on your insurance profile until they feel like removing them.

Reckless driving is worth 6 points in the state of Virginia and the offense will remain on your record for 11 years, so while the points will be gone after two years, it’ll be 9 more before the offense is removed.

If you are age 18 or older and you accumulate eight demerit points in 12 months (or 12 points in 24 months), you will receive an advisory letter that cautions you about the consequences of violating the law.

If you accumulate 12 demerit points in 12 months (or 18 points in 24 months), you will be required to complete a clinic. You must enroll in and satisfactorily complete the driver improvement clinic within 90 days or your driver’s license will be suspended.

If you accumulate 18 demerit points in 12 months (or 24 points in 24 months), your driving privilege will be suspended for 90 days. Additionally, you must complete a driver improvement clinic before your privilege will be restored. Once your privilege is restored, you will be placed on six month probation. You will not be granted restricted driving privileges.

A friend of mine got a similar ticket, then a lawyer, and was on a restricted license for 90 days. This happened about 2 years ago.

I would guess there is a distinction between reckless driving, and a ticket for speeding with reckless automatically tacked on to the end of it.

Good luck with your case, and uhh, think you're gonna slow down after this one?

I got a reckless in Loudoun... went to court, talked to the DA to get it down graded, was told I was lucky she did't pull my license. I paid the fine. Never got an insurance increase for that ticket or the other 2 I've got in VA. Matter of fact, I get the "Good Driver" discount.

Reckless driving is punishable as a class 1 misdemeanor, which can carry a fine up to $1,000 or up to 12 months in jail. With a previous DUI and -11 on your record that puts you at a big disadvantage. Hopefully you will only get a big fine and your license suspended, but not likely.

ps. my advice would be to get a good ass lawyer and prepare to lose your liscense for atleast some period. Not losing it forever and staying out of jail should be your main goals with the lawyer.

...I almost forget, you can also have your license suspended for up to 6 months. Reckless Driving is an EXTREMELY serious charge in VA. If there's any possible way that you can afford an attorney, I would absolutely recommend that you obtain one. I'm not sure if you were in Fairfax County or Loudoun County based on your description of the location but if it was Fairfax County, you'll need an attorney to negotiate with the prosecutor because they won't talk to you directly.

my wife got wreckless in PW county - 92 in 55. Hired a lawyer, got suspended jail time and a $500 fine on top of the $500 to the lawyer. No DUI in her past though. No telling what may have happened without the lawyer. It's always worth the money because the "system" likes to see itself being fed.

I've gotten 2 reckless tickets in FFX county in the last 2 or 3 yrs. I screwed up and didn't get a lawyer for the first one and just had to pay the normal hundreds of dollars + 6 pts. The second time I got a lawyer for $700, but he talked them down from license suspension to a reduced fine and 6pts. They refused to drop the charge down, though. My advice would be to definitely get a lawyer, especially with a DUI in your history! Whatever you get for this charge in court will make the next one even worse, so you might as well minimize it.

Well, retard, I wasn't implying that he was drunk when he got the ticket, but he said that he had recieved a DUI in the past. Mistakes are common but most people have the commonsense enough not to drink and get behined the wheel. And Dude, how about the government take your god damn vehicle away from you on your first DUI offense and people can ride their bikes, metro, or walk. That way, we can generate more income for the cities and countys by making more people use public trnsportation. It would also cut down the amount of traffic and get dumb ass drunk drivers off the road because while most people learn from their mistakes, 9 out of 10 drunk drivers are habitual offenders. Also Dude, while i'm not the worlds best speller, its "stupid" not stoopit and when refering to the government, you say "them", the government is not one person as it turns out. it turns out that taking public transit is not cost effective. public transit is very slow and is not well connected at all. while you may bitch about a long commute, it takes far longer to get places on public transit. additionally, unfairfax has all the money they can bleed out of people. really, they have plenty.

I was going 85 in a 55 on rt. 28. Never have gone fast before im only 18. I never speed. I was coming home from my hockey game @ 11 p.m. It was an accident, will the judge give me a waring for this? I have no points on my record. I am still in school and wanted to get home so i could get to sleep to go to school the next day.

I hope its just a small fine or hope they let me go. I am not a criminal.

Thanks for the translation and I was reasonably sure that it was something to that effect, but there are PLENTY of other ways to catch unsafe drivers than to have to rely on radar.

Perhaps, but a good RD tilts the favor to the motorist a thousandfold...a vigilant motorist with a scanning eye and a radar detector is more than a match for any state trooper or traffic cop.

That all might be true, but sadly, vigilant motorists with scanning eyes and radar detectors are a rare breed. Too often, they get lulled into a false sense of security because they have the RD.

Looks like the best bet is to hire a lawyer to plea bargain your case. But the message is clear... you want a lawyer. There is going to be a penalty... I would guess a fine plus the six points, but maybe your lawyer could get it pleaded down to a disregarding of a school signal or something. I'm not a lawyer, so rather than be scared you need to schedule an appointment with a lawyer today. Get off the computer and call one right now... you will probably feel better once you have met with an attorney and he/she has given you a plan.

I dont know about you people. But i got a reckless 78/55 and only had to pay a 170 doller fine, and got 3 points.. They said the points would be pretty much gone if i took a driver imporovment class... Maybe i just got lucky. Haven't had really any other driving offences, maybe a speeding ticket here and there.

I had a reckless driving once too. Flipped over the handle bars of my bike and landed on my feet. Then the bike crashed inches in front of me on the pavement. Was pretty cool.
