TorreyPoint acquisition is underway. The following email was sent out by Min Cho yesterday. They are saying Min Cho will be pocketing $2.5m in this deal.

-------------------------------------------
From: Min Cho [mailto:mcho@novadatacom.com]
Sent: Thursday, January 26, 2012 2:05 PM
To: Nova Staff
Subject: Torrey Point Acquisition

Nova Datacom Team,

As many of you know, discussions have been underway with executives at Torrey Point over the last several weeks regarding a potential Torrey Point acquisition of Nova Datacom's assets and contracts. I am pleased to announce that as of this week we have reached such an agreement in which Torrey Point will expand their East Coast operations while at the same time ensuring the continued employment of as many Nova Datacom employees as possible.

In the coming weeks, the agreements will enter into the final stages and legal documentation will be fully drafted. At that point a full transition will take place and you will start to meet some of your new executive team. Additional efforts to realign the brand name with Torrey Point will take place.

During the acquisition discussions, we did our best to ensure that as many people as possible would be unaffected by this decision, however there will be a small Reduction in Force of all non-essential personnel and those whom are deemed not to align with Torrey Point's vision for their expansion of their East Coast operations.

As for myself, it is with deep regret that I announce that I will be stepping down as your CEO effective immediately, in order to pursue other ventures and to spend more time with family. As I will be stepping aside, it is with grade pride that I announce that Joe Kim will be heading up the entire East Coast engineering operations for Torrey Point. I wish him the best in his new role and I'm sure he will be a great leader and visionary in the months and years ahead.

I want to thank all of you for your continued perseverance and support during the last few months. I know it has been difficult amidst all the controversy, but we wouldn't have been able to make it to this point without all your patience, diligence, and hard work. Since we started this company over 4 years ago, all of you have tirelessly and selflessly contributed to help realize our combined vision of Nova Datacom.

It is with the warmest personal regard and unending support that I bid you all the best in future endeavors, and I certainly hope we have the opportunity to cross paths again in the future. I know you all will continue to work just as hard at making Torrey Point one of the best IT firms on the East Coast.

Sincerely,

Min Cho

Dear Min,
I read in Alex's plea bargain that they are going to confiscate any funds from nova datacom to repay the 20 million of stolen tax payers money. Will the 2.5 go towards the repayment or to you and Alex's wife and kids? Just for a moment if you could be transparently honest, I think you can. Get some sympathy based on the fact that this must be such a horrid experience for you and your extended family. Just my opinion. And there is so much factual information out there that everytime you lie or twist the truth, you lose more and more credibility!

Sorry, that is impossible, these reprobates have no empathy whatsoever. See the previous posts regarding the new business model today.

It's all about how much money they can put in their own pockets, the pockets of their girlfriends and/or wives, and thier families.

That's it. Min and her co-horts don't care about taxpayer, all they care about is themselves.

They're sociopaths.

But I don't see how they can get around not paying back the federal govt. In alex cho's plea agreement, it clearly stated that all of his assests, including that of nova datacom would be forfeited .....

Is there anything you can share with us? Your anonimity is protected here so please feel free to induldge us with what is actually going on. Is it not true that Torrey Point is purchasing Nova Datacom? How many people have gotten laid off. Tell us what life is like over there since all of this has been taking place...

Mr. Smith,
Do you know if any of the links that individuals posted here are fabrications as well. I think Alex 's plea baragin and other docs were posted here. Do you think such individuals that have a grudge against nova datacom could have forged those links? It would be a aweful for all of us to read those documents, thinking that they were actually true and authentic..

Well thanks for clearing up the issue about the emails and nova datacom's response letter to the whole scandal.

I am by no stretch of imagination a fan of NDC and its executive staff as they are the definition of greed and arrogance and for the most part are not worthy of their titles.

Having said that personal attacks to their families and other employees are uncalled for. My 2 cents.

I couldn't agree with you more. Personal attacks such as this serve no benefit.

Having said that, Tim's wife did work at a massage parlor, so to call her a whore might be a stretch... but Joe did say she gave him a happy ending once when he went for a mas-sag-ee... (Ok, turn over Joe)...

Well, this all goes to show that if you want to brazenly steal, $500 from
the taxpayers, you can -if you have the right partners. The law enforcement, newscasters, FBI that continue to congradulate themselves for uncovering "the biggest fraud in history" barely cover the scam conducted at 1600 Penn. Ave.
The shell company name was "Solyndra" and soon after receiving the 500 mil.
went bankrupt taking the taxpayer money with them. So if you want to pull a theft like this ,get a good celebrity spokesman with lots of experience at
defrauding the govt. IT also helps if that partner in crime belongs to a group
that can deflect any criticism with cries of "stereotyping" I suppose that 500 mil. is small change compared to the 700 Billion given by Bush and 850 Billion by Obama to banks, primarily Goldman-Sachs, but the really bold move was putting the very execs. from Goldman who engineered the even larger-multi-trillion dollar- housing crisis scam as directors of the Dept of Treasury and Federal Reserve. These scams-much,much larger- recieve scant attention and no prosecution from the self-aggrandizing "heroes"you hear on television. Wake up voters. Don't get caught up in made for TV mini-series sideshows while your tax dollars get shifted to political cronies of both parties. By the way-a small house in FFXCO getting replaced by a mc-mansion ! Shocking! This has to be the first case of this happening. Thank goodness for the cunning and vigilance of law enforcement and neighbors. I hope this insidious trend doesn't tke hold.

Thank-you Chan and others who have contacted me privately.I cannot claim all the credit for this piece, however. The criminals who perpetratedthis crime and numerous others similar wrote the script. I just kept my eyes open and assembled all the available facts. This was not that difficult ,but it has
escaped the attention of numerous "award winning journalists" and their award winning staffs. The current criminal in chief only distinguishes himself in the dollar ammounts and brazenness with which he operates. His predecessors were no better or worse, but they could not shield themselves in the "invisibility cloak" which is generated by fear of criticism of such an "historic" figure. While the public is distracted with dramatic raids and posturing news conferences, the really big crimes go unreported.Persons wishing to explore the concept of investigating the obvious further are encouraged to visit the " Ron Paul "thread on this site and please ,go to the indicated links of Dr. Paul speaking for himself, not my analysis or that of others with more colorful screen names than myself. I don't hear Ron Paul saying the things attributed to him by others and I checked his claims in his video against his voting record and -how refreshing-he's not a serial liar at least on these points as are all his opponents .Thinking beats emoting when the fate of a nation is at stake and actions speak louder than political rhetoric."I'm Blake Lane and I approved this post." Paid for by the Committee
for independent political thought.

A former Army Corps of Engineers employee admitted in court Monday that he participated in a $20 million bribery and kickback scam authorities have called one of the largest in the history of federal contracting.

Michael Alexander, 55, of Woodbridge pleaded guilty in the District’s federal court to charges of bribery and conspiracy to commit money laundering. He faces at least nine years in prison under federal guidelines, although that number may drop depending on his cooperation with authorities. A sentencing date has not been set.

Major layoffs at Nova Datacom this week and last... Many, many employees now need to fend for themselves. Horrendous layoff packages, no severance, etc.

Also the sign has been removed from their building in Chantilly. This is pretty much the end for Nova Datacom as we knew it.

Copper River IT purchased their assets, you can see they've already started updating their web site

http://www.copperriverit.com/core-competencies/education-services/instructors/

Those are the old instructors at Nova Datacom.

Also take a look at http://www.copperriverit.com/about/location/

It lists their metro DC location as Nova Datacom's old offices at 4501 Singer Court in Chantilly.

A lot of people were laid off and those that remain are all desperately looking to find employment elsewhere...

Hahahaha... Copper River IT? What a joke... some no name company coming along and picking up NDC's assets for a fraction of what it was worth... what a sad state of affairs... this is such a far cry from what NDC was and ultimately could have been had it not been for the greed and corruption of a few key individuals.

As others have written, Min, Alex, Ted, they were all losers that couldn't have made a successful business unless they stacked the decks in their favor. Joe Kim is a slimeball who went along with it and treated people like garbage along the way but it looks like he's getting his along with the others. He now gets to work for some no-name company w/ no real prospects of being a power player on the scene. Too bad Joe burned all those bridges cause no one is going to be offering him any positions any time soon. Too bad Joe, looks like those visions of grandeur and being the man are coming to an end. Enjoy working for that no-name company and your one-way ticket to loserville.

So long suckers, the party was fun while it lasted but it sure sucks like a real bad hangover now eh'? Glad I left those losers when I did...

Angela Inguillo is a victim of her own stupidity. There were signs everywhere that NDC execs were corrupt and that executive management was treating employees terribly, yet she continued to deny these claims and even went so far as to try to paint a picture that they were the victim of lies and distortions from their competitors, distributed press releases indicating that everything at NDC was business as usual, and it was a wonderful place to work.

She's been really hard at work moving all the marketing collateral and everything else over to the Copper River IT website and I can only believe it is because they are paying her a ton of money to assist in a smooth transition, perhaps she is hoping no one will realize that Copper River is a joke and just a front for a bunch of former crooks and management that lack people skills.

In a way I feel sorry for her because as a marketing manager she pretty much got handed the worst situation that someone in that position could ever have to deal with, but at the same time she is at much at fault for not paying attention to the signs and getting the F out of dodge when she should have...

What a freaking joke this whole company and executives have become.

Does anyone know if it will go back to recoiling tax payer money as it was stated in the plea agreement or have they done some other tricky stuff to pocket the money? With the money it sold for, Min Cho will say "C YA SUCKAS". She will keep half and save the rest for her brother. She has already been telling us that her brother when he gets out and on his feet will be richer and better off than he has ever been!

It only sold for $1.2m and most of that went to pay for the Cho's back legal defense fees, a very small amount was pocketed by Bill Halliday and some went to Joe Kim.

Besides, it's going to be anywhere from 7 to 35 years before Alex sees the light of day. Sentencing Guidelines require him to do the bare minimum so he won't get to spend of dime of any of that money for at least 7 years.

How pitiful this family is (along w/ the slimeball Joe Kim)...

What about that worthless so called CEO - She must have pocketed some too!

Who knows maybe there was some under the table money. If they can steal 20 million from the govt what makes us think that it was all on the table. Plus Alex had months before incarceration to plan for his family and his wife and kids that he is leaving behind. His lawyer must have advised him of the time that he is looking at. Does anyone think that he wasn't preparing for it? Plus as a parent, if you are already face with what he was looking at, his back is up agaisnt the wall....what would still him from not trying to hide money or do anything else underhanded.

Rat out your competitor to the authorities then swoop in and devour the bones.

Priceless.

How does Breck Taylor fit into this? Was he affiliated with Copper River? I believe Red River was - is that the affiliation?

Is the NDC thing done? How much did Min Cho end up making?

NDC sold for a meager $1.2m - approx. $500k went to Min, another $500 went to back legal defense fees, roughly $170k went to Bill Halliday for orchestrating the buyout, and somewhere around $30k went to Joe Kim.

Pathetic...

I don't think Breck Taylor fits into any of this at all...

Some interesting reading here for anyone who has been following this case. The transcript from the courtroom hearing between Nova Datacom and EyakTek back in December:

http://www.scribd.com/ndc_exposed/d/85493770-Eyaktek-Novadatacom-Settlement-Transcript

According to their financial disclosure statements and transcript from the case, it seems at one point back in November/December, Nova Datacom was operating with an Accounts Payable of $4.27M and an Accounts Receivable of $4.3M leaving them with an operating budget of only $30,000.

No wonder they had to lay so many people off, they literally had no cash in the bank to weather any storms! They better thank their lucky stars they got puchased by Copper River IT - also explains why Copper River was able to pick them up for literally pennies on the dollar.

What I thought was so telling was the judge when she stated:

"...although EyakTek's withholding of the funds in escrow has undoubtedly harmed the financial health of Nova Datacom, I don't doubt that point at all. Nova Datacom cannot make a clear showing that the harm it has presented is
irreparable; i.e., that going out of business is attributable even primarily to EyakTek's withholding. It's attributable to that person's engaging in this illegal conduct and resulting disbar -- debarment."

One other thing I thought was interesting, according to the transcript, Min Cho was fully aware of the fraud BEFORE Alex was arrested and began assisting the feds... so the fact that she was acting like she had no idea about these charges is total bunk. It's all in the transcript folks...

Breck Taylor was a character played by actor Ben Cooper in season 10, episode 25 of Gunsmoke called, "Breckinridge" that originally aired March 13, 1965.

In this episode Cooper played a young attorney newly arrived in Dodge who works the law to keep his client out of Matt's clutches and then has ample reason to regret it.

Ever the proverbial character actor, Cooper had previously played roles in classics such as Johnny Guitar, The Rose Tattoo and Gunfight at Comanche Creek in which Cooper played Billy "Kid" Carter.

I'd venture a bet however that the OP is referring to Breck Taylor, the former President of Red River Computer Company of Claremont NH.

Mr. Taylor was prosecuted last year for false claims agains the US Government to the tune of about 2.3 million dollars, a crime of the most despicable kind.

The link to the house that is for sale in Lyme, NH appears to be the former home of Mr Taylor, which he forfieted as part of his deal with the feds.

Originally on the market for 2.3 million, they've slashed the price down to a mere 1.5 million and some change.

Red River Computer was the mentor to Copper River in the Small Busniness Administration 8(a) mentor-protege program, perhaps that is the connection ?

From the Red River Computer Company website:

http://www.redriver.com/markets/government.html

"Red River is a certified small business we also have a teaming relationship with Copper River Information Technology, a tribal entity firm, which enables us to satisfy your 8A and set-aside procurement needs."

According to this document filed with the Securities Exchange Commission,
Red River Computer was to be the mentor to Copper River in the Small Busniness Administration 8(a) mentor-protege program, but that arrangement apparently fell through.

From page F-106:

http://www.nasdaq.com/markets/ipos/filing.ashx?filingid=7735696

In March 2006, the Company entered into a loan agreement to lend $600,000 to an Alaska Limited Liability Company (the “Borrower”) to provide working capital needs to a subsidiary of the Borrower (“Alaskan Company”).

This obligation did not bear interest. It was the Company’s intention to seek approval of the Small Business Administration (the “SBA”) to enter into a Mentor-Protégé Agreement with the Alaskan Company under the SBA’s Mentor-Protégé Program pursuant to the Code of Federal Regulations (“CFR”) Section 124.520.

Repayment of the loan was contingent upon application to this program. During the year ended December 31, 2009, the Company decided not to pursue the Mentor-Protégé program with the SBA. Consequently the loan of $600,000 was deemed to be uncollectable and was removed from the balance sheet and was recorded as a component of general and administrative expense for the year ended December 31, 2009.

Perhaps that is the connection the OP is referring to ?

Sammy Prima,

Thanks for sharing this info and the link between the two is now more apparent than ever. It seems there are all colors of shakiness surrounding Nova Datacom, Copper River, and Red River. We had reason to believe Steve Giani was crooked before but with the recent acquisition of Nova Datacom it is ever more apparent that these guys intentions aren't good. Everywhere you look it seems these guys are surrounded by crooks.

Wait, I thought Ted Hallas' home was under foreclosure... at least that's what I heard from a good friend of his wife Heather. Apparently she is leaving him because of all this mess and the fact that he'll be doing about 6 years behind bars. Plus since all this took place he apparently has only been earning an annual revenue of about $96k through his company Technology Lifecycle Management, at least according to Manta:

96k??? WTF! ROFL... What a far cry $96k is compared to the money he was making at Nova Datacom...

What is interesting is that Alex managed to actually sell his house back in 2011 before the feds could forfeit it. And this is public record which can be found on the fairfax county website. Many this is one of the reasons he was called back to the area from cali because the feds realized that he was not upfront about putting his house up for sale rather than abide by the terms of his plea!b.

What I think is funny is how former NDC execs feel the need to tarnish the good name of their former employees with talk about defrauding taxpayer money? Wasn't this the whole idea behind the entire bribery scheme involving NDC execs and contract officers within the Army Corps? What about the attempt by NDC execs to create fictitious past performances to get preferential treatment through the SBA Hubzone program?

I think I speak for everyone here that if the former NDC execs simply showed a bit of remorse for what they did and their terrible treatment of their employees then people might be more willing to let bygones be bygones... unfortunately they continue to act like they are innocent victims in all of this and only resort to dragging other peoples names through the mud.

This doesn't just go for former execs who were involved in the scheme- I worked w/ a lot of others on the DSS contract and we were discarded like trash when they no longer needed us. Didn't even give us a severance package of any sort...

Also, the feds came to learn that Alex had some of NDC's IT staff involved in deleting emails that would further implicate him in other crimes, and could be used by the IRS to determine that improper bookeeping was taking place.

Mr. Configure, are you delusional or something? You do realize that threats made like this constitute a crime and the person you are threatening can now easily subpoena the site owner for your IP address. Who is willing to bet that one of those IPs resolves to a certain address in Potomac, MD? That probably wouldn't go over too well with the judge at your sentencing in May...

Just a thought... you should think twice before making threats that could come back to haunt you...

Ted,

If this is truly you and not someone masquerading as you, I just want to extend my sincerest thanks to you for reaching out in an honorable manner. I think I speak for everyone else when I say that all the employees have only wanted a certain level of humility and remorse from the former NDC execs that treated employees terribly and discarded them like trash when they were done with them.

Having said that, why this change of heart after the previous attacks levied against some of the former employees?

It was well known that Min was a CEO in name only, so they could obtain the "minority-owned, woman" status, but everyone knew that the company was really Alex's. Min had not a clue about running a technology organization which was painfully obvious when talking to her... Alex was the one steering the ship, she just pretended like she was at the helm.

Ted even has his own webpage and apparently likes to Tweet and blog about everything...

Ted Hallas
Leader, Businessman, & Mentor
http://www.ted-hallas.com/

I have extensive experience in business management consulting, strategic business development, and consultative sales. I also have held several senior management positions with Fortune 100 companies as well as small business. My experience involves analyzing potential market size, opportunities, and barriers to entry while at the same time devising and implementing action plans for significant revenue growth.

As EVP of Operations for Nova Datacom, I was primarily responsible for corporate strategy, business development and sales. I was able to drive new business by developing and establishing strategic high level relationships and partnerships within the systems integrator community. I also developed strategic alliances with large OEM’s and startup companies with emerging technologies. I defined our organization as a value added integrator and was responsible for branding our company with “Security is in our DNA.”

Prior to Nova Datacom, I was Vice President of Strategic Alliances with Nortel Government Solutions. My responsibilities included: managing a team of sales professionals who focused on selling to, through, and with Systems Integrators and Value Added Reseller channel partners. I was also responsible for setting strategy and executing upon a sales plan to work with our strategic alliance partners. I also created and implemented the SDB Prime program. This was a program that employed a sales strategy that included a cooperative of small disadvantaged businesses to capture set-aside federal contracts.
My management career also included growth opportunities within the start-up community that included optical solutions, security solutions, and virtualization solutions.

Additionally, I was a senior manager with Lucent Technologies Internetworking Systems where I was responsible for IP convergence, network infrastructure, wireless technologies, security products and solutions supporting the enterprise, multi-national accounts and service provider market, including developing Lucent’s channel development strategy.
