Misdemeanor

Buddy of mine got hit by some dumbass the other day, the guy speeds off and leaves the scene and then decided to call the cops down the street. Not knowing that he decides to leave and called his insurance company to get his car fixed. Couple of days later the cops came knocking on his door and he got slapped with a class 1 Misdemeanor ( up to 12 months in ADC/ up tp $2500 in fines). He couldn't prove his case and he was found guilty but he only walked away with $300 in fines.....somehow. How long does a misdemeanor like that stay on your record or is it there for good. He is in his senior year in college studying criminal justice and going to try to become a cop. What are his odds? and once again how long does a misdemeanor stay on your record in the state of Virginia?

I heard you can file a petition to have conviction dismissed? If approved, would that mean that the misdemeanor would no longer show up on that persons record?

he should consult with a lawyer. Many lawyers will talk to him and go over his options for a minimal charge or no fee at all. It sounds like this case is too complicated to even guess at. And of course, if the charge is dismissed (it was not, so now he would probably have to get the conviction overturned), it won't show up as a conviction on his record. If I were him, though, I'd just take the lump and move on unless it is going to damage his career or some other major aspect of his life in some way.

Plus one should really call the cops if a hit-and-run has occurred and ask whoever you get on the phone if it is proper for you to leave. Get a name and note the time/date of the call.

Great this guy sounds smart. Just what they look for in a cop. Any 10 year old knows if you are in any kind of a car accident you need to stay put and call the cops. At the very least you need the report for your insurance.

in virginia a record can only be expunged under very limited circumstances. if your friend is able to get it expunged there is still one more hurdle in the state code.

any and all law enforcement agencies have access to expunged records in the course of a background investigation for employement purposes. so your buddy is SOL...
