ARLINGTON, Va. (WUSA9) -- After two years behind bars, Michael Gardner was released as a free man today. He left the Arlington County detention Center with his family friends and wife.

Robyn Gardner is a former Falls Church City mayor and council member. Her husband's convictions for molesting two girls were reversed on June 5 by the Virginia Supreme Court.

Gardner still faces the charges from 2011 and he will be tried again. He's accused of sexually fondling two girls, ages 9 and 10, during the night at his daughter's slumber party.

Prosecutor Nicole Wittman argued Gardner be held without bond, saying there is significant DNA evidence against him.

During his first trial, the prosecution presented concentrated DNA evidence that pointed to Gardner. It was found on the inside crotch of one of the girls panties.

Similar DNA evidence found on the other child's pajama bottoms also presented.

I don't understand why people are so upset by a fair system of justice. Mr. Gardner was wrongfully convicted and the highest court in the state agreed. He should have been freed.

Now the prosecution and the Keystone Kops have another chance to earn the conviction the proper way with a fair trial. If he is guilty, then he is guilty. Just do it the right way.

Recently the Virginia Supreme Court reversed a decision finding former (and perhaps future) Falls Church resident Michael Armin Gardner guilty of multiple charges of child molestation. Following the reversal, the Arlington County Circuit Court has freed Gardner from prison on a $50,000 bond pending a new trial scheduled for February 2, 2015. Having had a two-plus year taste of prison life while his appeal was working its way through the system, Gardner might be tempted to agree to a plea bargain in order to avoid the expense of a new trial and the possibility that he could be found guilty again and ordered to serve out his original 22-year prison sentence.

Anyone in Gardner’s position might well be tempted to cut his losses and take the plea rather than gamble on an adverse outcome. Clearly at trial there was persuasive evidence, including physical evidence, to support the original finding of guilt. As discussed below, the Supreme Court’s reversal was based on a legal technicality. The Court’s majority and dissenting decisions suggest that it’s not a slam-dunk that a retrial will produce a different outcome, even as they recognize his right to a retrial.

Supreme Court Decision

On June 5 the Virginia Supreme Court, in a 6-1 decision, reversed the trial court’s finding that Michael Gardner was guilty of committing aggravated sexual battery and object sexual penetration against pre-teen girlfriends of his daughter who were attending a sleepover at the Gardner home.

The Court did not address the substance of the child molestation charges; rather, it has given Gardner an opportunity to mitigate the effect of the evidence given at trial. Specifically, the Court found that the trial court committed reversible legal error by refusing to permit two of Gardner’s character witnesses (Laurie Ombrembt and Katherine Allan) to testify to his “reputation in the community for being a good caretaker of children and for not being sexually assaultive or abusive toward them.” (The two were permitted to testify on the record their belief that Gardner had a reputation for “truth and veracity” and “peacefulness”.)

In reaching this decision the Justices relied, in pertinent part, on Virginia legal precedent holding that “a defendant is not limited solely to reputation evidence regarding truthfulness, but may offer evidence to prove good character for any trait relevant in the case.”

Dissent

The dissenting Justice agreed with the trial court’s decision not to allow Ombrembt’s and Allan’s testimony regarding Gardner’s reputation for “being a good caretaker of children.” The dissent relied on additional Commonwealth legal precedent holding that “a character witness in a criminal case ‘must be aware of the [accused’s] reputation in the community before [she] may testify,’” and on precedent defining what it means to have a “reputation in the community.”

Referencing Gardner’s offer at trial of a description of the testimony Ombrembt and Allan would give if permitted, the dissenting Justice found that the offered testimony was “ambiguous” and, in effect, consisted of the witnesses’s personal feelings toward Gardner and their personal lack of knowledge of any evidence “of any sort of bad conduct, sexual conduct, with minor children.” [Emphasis added.) There was insufficient evidence that the witnesses were qualified to speak authoritatively about the breadth within the community of Gardner’s purported reputation for child care. Thus, the offered reputational evidence “contained no statement that either Ombrembt or Allan was aware of Gardner’s reputation in the community for a trait regarding child care.” (Emphasis added.)

Accordingly, the Justice found that the exclusion of Ombrembt’s and Allan’s testimony by the trial court was consistent with Commonwealth legal precedent holding that “reputation is the aggregate voice of a community” not simply “what a few persons say or may think about the accused, it is what the community generally believes.”

This is the posture of the case as Michael Gardner returns to court on a legal procedural error, neither guilty nor innocent of the charges against him. He carries the baggage of evidence that has already convinced one jury that he is guilty of the alleged crimes. There is broad agreement in principle that, as the distinguished jurist, William Blackstone, observed: “It is better that ten guilty persons escape than that one innocent suffer.” And so, Mr. Gardner may have another day in court.

But what is the likelihood of his success? The proceedings in this case so far raise more than a little doubt. It’s a stretch to imagine that Ombrempt’s and Allan’s testimony, as it was described in the proffer at trial, will be sufficient to overcome the testamentary and physical evidence of abuse introduced at the initial trial. Surely the prosecutor, mindful of the full range of legal precedent set out in the Supreme Court decision and dissent, will put witnesses Ombrempt and Allan to the proof that they meet the legal standard of speaking with “the aggregate voice of the community” in reference to Gardner’s reputation regarding children.

The reversal in this case puts me in mind of the common law “one free bite rule”, relying as it does on Gardner’s right to have witnesses testify to their largely personal lack of knowledge that he ever molested a child in the past. It’s quite a leap to say such testimony would prove Gardner hasn’t molested a child for the first time, as alleged. The one free bite rule may forgive a dog’s first attack but it puts the owner on notice of potential future danger and puts the animal in jeopardy of a more permanent solution upon a subsequent attack.

Of course the rule does not and cannot apply literally in the case of proven child molestation; the first time must be fatal to the molester. But it does have some procedural similarity here. Mr. Gardner has now had his one free bite at the judicial system and will get a second bite. The girls he has been found once to have molested and their families will be subjected to the trauma of another trial. Unless some element of this case changes dramatically, it could be that his retrial produces a second guilty verdict and a more permanent solution to the harm suffered by the victims.

Stalking? The W&OD trail is a public park. I happened to be on a ride with my family and saw the scumbag there as well. I didn't see Robin though. He was there with another woman. My daughter was creeped out because she knows what he did to one of her peers.

Just because he got to keep his name off the sex offender list for a few months doesn't mean he isn't one. People need to know when dangerous individuals are out and about in their communities.

He shouldn't be sitting on park benches in front of a playground. That's just creepy. When he was out on bail the last time, he was denied visitation to his own children, you think it is appropriate for him to be hanging out at a playground?????

Sorry but I don't see how anyone could give this convicted pedophile the benefit of the doubt and accept him back into their community. Mr. Gardner had and well paid team of attorneys that few defendants in Virginia courts could possibly afford and he was convicted on three of four counts by a jury of his peers.

It disturbs me that he was granted bond especially after the nature of the testimony that was presented by three brave young girls.

I don't know how people who defend him or would testify as "Character Witnesses" can sleep at night if they know what was testified to in that courtroom. Gardner is a sick man who deserves to spend every waking day in prison.

He's been arrested again. Here's the City of Falls Church news release:


Police Arrest Resident for Felony Sexual Battery

Wednesday, October 1, 2014 -- City of Falls Church Police have arrested and charged Michael A. Gardner with one felony count of aggravated sexual battery of a child. He was taken to the Arlington County Adult Detention Center and will be held without bond pending his court appearance.

On September 29, 2014, the Arlington Circuit Court Grand Jury returned two indictments charging Gardner with Aggravated Sexual Battery of a Child, with offense dates spanning 2009. The victim in the case is a family member who was under 13 years of age at the time she was assaulted. The allegations came to light only after Gardner was released from prison after his conviction was overturned by the Virginia Supreme Court in a 2011 case involving two counts of Aggravated Sexual Battery and one count of Object Sexual Penetration. The victim in the most recent case related the incident to an individual who, by law, is a mandated reporter of child abuse allegations.

Likely chain of events:

1. The girl, then 12, is abused in 2009. Pedophilia usually begins at home, so it's no surprise that Gardner apparently first assaulted a family member before going after the girls at the slumber party.

2. The girl kept silent, probably fearing no one would believe that a respected vestryman like "Uncle Mike" would do such a thing.

3. She must have had very mixed emotions when Gardner was arrested in 2011 and convicted in 2012. On the one hand she would have been pleased that justice finally had been done. On the other, she must have felt that had she come forward earlier the other girls never would have been abused.

4. Her feelings of guilt must have intensified when Gardner was released after his conviction was overturned in June.

5. The thought that the other girls would have to endure a second trial must have weighed heavily on her.

6. She apparently told her therapist that Gardner had abused her two years before the slumber party incident.

7. The therapist then was legally obligated to notify FCCP and did so.

8. Gardner now is back in the cozy confines of the ACDC.

9. He has retained an attorney other than his counsel in the original case. The lawyer has the unfortunate name of Liebig, something his client seems to do quite well.

The reason I ask is because I am sure he was too young to have anything to do with the Lyon girls disappearance in 1975 but I think these fit the age range of his victims.

Every instinct in my body agrees that you'd have to be pretty sick to support someone who commits (or even thinks about committing) even one of the crimes that Gardner is accused of committing. I cannot imagine how his wife is able to stand by him, unless for some reason she is 100 percent certain that he did not do it. But how could ANYONE be 100 percent certain of that, especially after yet another victim - a family member, no less, has come forward.

The only thing that gives me ANY pause is when I think of what I (or any of the posters here) would do if I was (or they were) FALSELY accused of such an act. If you were falsely accused, how could you handle that? How WOULD you handle it?

That being said, the fact that another child victim has come forward alleging (apparently) that Gardner abused her on a totally different occasion makes it HIGHLY unlikely that Gardner is innocent.

My prayers go out to the victims, and I hope Gardner gets what he deserves this time.

Agreed.

If he also sexually abused his daughters the mother would have quashed those rumors and stories by repeatedly telling them to shut up, they were wrong or were only dreaming the whole thing. Nothing must be said to shatter the distorted vision of reality in her mind.

This guy in his over the top and vitriolic political rants displayed a narcissistic streak a mile deep with little concern for boundaries.

So no surprise we find the defendant (and apparently his spouse) in an incredibly defiant stance, now facing two sets of charges, the latter involving a family member no less.

I am not suggesting that people with aggressive political views of any kind are inclined to commit the kinds of alleged acts ascribed to Gardner. It is just the events and allegations do not surprise.

The only rational and honorable thing for Gardner to do is to reach some sort of plea agreement. Otherwise, he will drag three young women through yet another trial, and worse yet, a relative in a separate trial. The latter trial could make any semblance of family life for those around him - and note I use the word semblance - impossible for years. He will get a better deal, too. At some point the narcissism has to stop. It may not, however.

The reality here is that sex offenders are very reviled, both in and out of a correctional setting. The second set of charges have underscored this reality to an ever larger group of people.

Although perhaps harsh, it is really difficult to be sympathetic to Gardner's spouse. Kids were in harm's way, and she likely was the closest adult to the situation (not a legal statement, but a practical one).

For all we know he could be a member of NAMBLA or Kloman might have frequented his residence as a democrat supporter and gained access to the girls.

RdFox - I think the question of his culpability is settled, which is different than the legal adjudication of guilt. The jury reached a fair conclusion on the facts, and unlike most defendants, Gardner had excellent trial counsel with every opportunity to show that the elements of the charges did not meet a guilt beyond a reasonable doubt standard. The appellate decision setting aside his conviction was strange to me, especially in Virginia. Even if one concedes that two character witnesses should have been permitted to testify as to Garnder's conduct around children, it strikes me that this kind of error was harmless in the context of the entire case. But again from a practical perspective I think culpability has been established - no doubt a huge challenge for the defendant in a new trial.

The alleged acts against a family member (and new charges) bring the pressure on Gardner to an unfathomable level, beyond the incredible resources required to mount a defense in not one, but two, high profile trials. People think diferrently about the defendant now, even those already persuaded of his guilt. And mounting these two defenses from jail is also really difficult (I can't see bail forthcoming). This is why I believe we will soon see a confirmation of culpability (a non-legal conclusion), and thereafter at some point an adjudication of guilt.

Note there is no exaltation in anyone's misery, all the way around. But it looks like the actors and supporters on the defendant's side would find it salutary to focus on the hard, practical, and difficult facts which have emerged.

I leave open the possibility I could be wrong about all of this. The facts that seem verifiable do not point in that direction, however. The real rub for those who have supported the defendant is that the victims are innocent children, and acknowledging error like this doesn't come easily.

For some insight into the minds of Gardner's supporters I offer the following letter, published only in the print edition of the Falls Church News-Press on April 11, 2013. This was written after Gardner's trial, but before his conviction was reversed. Only the author's name has been omitted.


Editor,

I write to question assumptions and actions of the police department, the prosecutors and the court who found Michael Gardner guilty of molesting two underage girls.at his home during his daughter's slumber party in June 2011. I have found myself deeply troubled with questions that for me were not adequately answered.

For purposes of disclosure, I know Michael well. I have been a guest in his home on numerous occasions and I served with him on the Vestry of the Falls Church Episcopal. I have not been asked by his family or his attorney to write, nor have I shared these questions with them. I write as one keenly aware that our justice system wrongly imprisons many innocent persons.

There is no clear evidence of Michael's innocence or guilt, other than the testimony of these two 10-year-old girls. They spent that night in a lower-level den with eight other girls and none of the others saw or heard anything related to these charges. Why?

Why was Michael never accused of sexual misconduct at any other time? Child molesters are almost always serial molesters.

Why did the Falls Church police come to the home of Michael and Robin in the middle of the night, bang on the door, shout "open up for the police" and with bravado place him in handcuffs and carry him away? Michael and Robin, who was on the City Council at the time, are leading citizens, and, I believe, outstanding Christians. They are not going to escape. What is going on?

Why did city police publish a story that sperm had been found in one girl's pajamas, with the clear implication that this convicted Michael, befofre analysis was done to determine the source of the sperm? Later it was found that the sperm was not from Michael, but from the girl's father.

Why did the Chief of Police instruct the Department of Protective Services not to investigate this evidence?

Why were the two girls so carefully instructed and trained for their court testimony? The girls met with two prosecuting attorneys a dozen times for instruction before the trial.

Why did the Chief of Police announce that this conviction was the biggest achievement of his years in office? Why did he gives plaques of appreciation which cost $200 to the prosecutors and their witnesses? Is this customary?

Thanks for posting the Letter to the Editor of the FCNP from April, 2013. The perspective is intriguing, particularly in light of the fact that so much of the information is so incorrect as to be laughable. I'm sure all of the letters sent to the judge pleading for mercy prior to sentencing were even more interesting. I wonder when we'll get to see those!

The supporters' letters, which the defense presumably submitted as exhibits, might be available as an appendix to the trial transcript.

Perhaps the most interesting aspect of the LTE posted above is how it suggests that Gardner was the real victim. The letters offered to the Court in his defense probably were more tactful.

I was trying to be funny. Remember not long ago Kloman from Potomac school in Mclean was arrested for about the same thing and got like 22years. They had him nailed with credible witnesses to the point he couldn't deny the charges.

To understand one must go back 7 or 8 posts

The point was that Kloman gaining access to the little girls through Gardner was just as ridiculous as Gardner having his case overturned.
