Fairfax County General :
Fairfax Underground
Welcome to Fairfax Underground, a project site designed to improve communication among residents of Fairfax County, VA. Feel free to post anything Northern Virginia residents would find interesting.
I just want to say that I am a law abiding citizen and it is very rare for me to get any tickets. I was unfortunate enough to get pulled by over by a few motorcycle cops hiding behind bushes in Tysons Corner Virginia. The speed limit was 30 mph on a road where people on average drive around 40 mph - this is because the road is designed to be way above 30 mph speed limit. I was running late to work one day and they caught me and several other cars. I was apparently doing 46 mph in that 30 mph zone. I was not aware that I was speeding that much above the speed limit.
If I decide to pre-pay it, I have to a pay a core amount of $62, and then $6 for every mile I was over the speed limit. That makes it $62 + $6*16 = $158.
If I decide to court it, I will have to pay $62, and then depending on the verdict, I could either pay more, less, or none of my speeding fine.
What shall I do? Do I pre-pay it? or court it? Do I have any case? There's one thing and that is that my speedometer is off and doesn't always give the true mileage. It has a variance of -5 mph. So when you're driving at 35, it will show 30. Since the ticket, I have gotten this problem fixed. This plus the fact that this was my first ever speeding ticket, can I pull a 'lesson learned' on this one?
Please advise. Let me know if there's any more information I can provide. If I have to end up paying the fine, that's ok, I'm just trying to see if there's any way to avoid this.
To summarize the original post: I am a law-abiding citizen, defined as I break laws because I think they are stupid.
Talk to a traffic attorney, they are paid to hear the excuses (late to work, everyone else is doing it, my speedometer is off, I didn't know I was speeding, cops were hiding in the bushes, did I miss any you provided?).

What bonoz said, except for the clean record part.
I have gotten two within the last four years. From my personal experience, show up for your court date.
The first one was on a clean record at Fairfax Court. Without saying a thing other than pleading no-contest, it was reduced to "disobeying a highway sign" with three points a much lesser fine. On the second ticket and appearance - at the Herndon City Kangaroo Court - the first offense was still on my record. The same exact thing happened.
It is possible that two failures to obey highway signs have much less of a ding on insurance rates than two evil speeding tickets. I got a new motorcycle and insurance with full coverage for <$400/yr with both of those turds on my record. I was expecting dry anal rape from all insurance companies once they saw those two tickets.
If you're lucky the cop won't show up. The way they set up the court dates here (as opposed to how San Diego County did it when I was there), the cop usually shows up.
Seems to me that showing up - DRESSED NICELY - just to plead no-contest will get you some advantage over paying it by mail. Don't plead not-guilty and go on with any excuse because they have heard them ALL before. I can't think of any reason to pay via mail if you can just show up. If you're due for a beating because of your record - I doubt they'd just let you pay via mail anyway.
By "clean record" I didn't really mean spotless, just not really bad. In my experience, and it's been a while since I had a ticket, the judge asked people looking for a deal about their driving record, and he would randomly check the records of people so you didn't know if you'd get busted in a lie or not when you were up. If you weren't someone who had a ticket or a bunch of tickets within a year or two at least he was more willing to deal. Otherwise, YMMV.
Edit: Agreed on the dress nicely though. So many people show up in T-shirts and shit it's ridiculous.

A few things,
The LEO's typically have all their tickets scheduled for the same day. For example, all their summonses may be for the first and third Tuesday every month or something like that. That way, it's easier for them to be available for court.
It's typical for the officer to declare that their gun has been properly calibrated, and they'll have a printout to support that, so don't think you can claim that their radar has some margin of error.
If you plead guilty, you can ask if the ticket and points can be waived if you agree to take a driver improvement program, basically a defensive driving course. You'll still be on the hook for the court fee, but the ticket will be dismissed as if it never happened. You won't need to report it to your insurance company, because the speeding incident never occured once it's dismissed. You have to show up in court for that. Don't send anything in, don't plead guilty by mail, just show up. You may have to miss a day of work, but it'll cost you more than a day's labor to pay the ticket and the increase of your auto insurance premium.
There are two classes of people in court. The sane person dealing with the occasional ticket and the shitheads that seem to be going through the system ever few months.
The last time I went to court, one person's defense was something along the lines of:
"Those jerk cops are always speeding and so is everyone else and I don't see why I got the damn ticket and - (deep breath) - this is unfair because I see them speeding every day and they have the audacity to give ME a ticket when THEY are driving fast and - (wheeze deep breath) - I think it is WRONG that I got a ticket and you all have no business trying to fine me when you all break the law everyday..." (truncated for both your sanity and mine)
I watched all the court personnel start rolling their eyes and some started snickering. If monotony is painful, their lives are torture. I bet people like this actually brighten their day a bit.
The judge was a pro and put her in her place firmly without setting her off. The judge always has to be sharp and not just rubber stamp your shit and send it along. If you show up looking sharp and acting politely, you just made his day because he doesn't have to deal with your bullshit.
The funniest part for me was sweating it out on my speeding ticket when a majority of the other people were up for some serious shit like DUI, suspended license, reckless, bench warrants. Dudes were getting hauled off in handcuffs. Idiots up for DUI just showing up to see what happens - so the judge is smart on their behalf and hooks them up with a public defender. Dirtbags with too much tint, expired tags showing up in a wife beater shirt and flipflops.
I'd be freaking out if I had anything of that magnitude looming over my head.
So.... stories...
What's the worst you've ever had to deal with in traffic court?

What kind of screwed up insurance do you have that you think you have to report a ticket to them yourself?

From my experience, twice, just plead no-contest and take your lump. For me, it was cheaper and a lesser penalty than just paying it by mail - especially when it came to insurance renewals. Dress nice.

"You won't need to report it to your insurance company, because the speeding incident never occured once it's dismissed."
"What kind of screwed up insurance do you have that you think you have to report a ticket to them yourself?"
Probably Senate Insurance - "Kiss my bumber, just kiss it"
I have never heard of any insurance company that you have to report your tickets to, trust me it is in their interest to take a look at that each time your policy is up for renewal. My insurance company is on top of that shit, they have never missed a chance to increase my rates.

I've got it! Slow the f*ck down and obey the speed limit, especially in residential neighborhoods. That 'road is designed to be way above 30 mph speed limit' whine is lame. Act responsibly.

Go to court.. When they call your case. Ask if you can take driving school. you may need to wear you "butt kissing" shoes. but it will wipe the ticket off your record.. no ppoints against you ... and last but not least .. your insurance will not jump through the roof ... It worked for me my ticket was 67/45 .. Hope this helps
The case was dismissed because of calibration issues. So I was probably NOT speeding and was clocked at a way higher speed. I was probably going 40 or less. No way was I doing 46.

The only time I had a ticket (5 years ago) there was an old woman who ran a stop sign causing an accident. She claimed that it wasn't her fault, she was just trying to do to right thing by getting home fast 'cause her dog and cat were fighting on her lap...

Just go to court.. plead no contest .. if your case is not called first, then you will get to see how everyone tries to bullshit the judge and you'll get to see the show.. Remember, the Fairfax County Police Department does not lie, cheat, or trump charges... You most likely will get the fine reduced..
