No it isn't. It is illegal to operate a vehicle with a BAC above a certain level or to operate a vehicle under the influence. It is perfectly legal to drink and drive so long as you do not violate either of these two provisions. Whether it is prudent to do so is a different matter. However the same could be said for driving with a cell phone in your ear or driving on the interstate doing 10 mph under the limit, but that doesn't stop people of all ages from doing it.

I think we can all agree people shouldn't drink and drive. For the most part people make mistakes. Depending on the circumstance and if anyone was hurt I think the punishment should fit the crime. Not everyone who has made a mistake, even getting a dui deserves to be treated as if the aren't intelligent. Anyone who wants to pass judgement as an organization such as "MMADD" should realize the pain they endured by losing a loved one doesn't mean they can't or obviously in this case won't make the same mistake. I'm sure she feels very bad doing something herself that has caused her and her family so much pain. My point is everybody makes mistakes. Everyone should be accountable but not everyone who has had the misfortune of getting a dui or driving after drinking and not getting caught...has hurt anybody. The punishment should fit the crime. Murders and rapist get off easier sometimes and its a whole different mentality. Dui offenders do not normally intentionally set out to hurt someone. These dui laws are based on a "what if" sometimes and that's not fair. The fines and licence suspesions impacting their jobs and the court, counseling fees and MMADD fees are punishment. A criminal intentionally hurts people in some form. A lot of people that get dui's didn't intend on hurting someone. I understand if they do then the punishment is severe...but don't ruin everybody's life on a mistake and a what if....that woman past judgement on everybody now maybe she understands that you can't do that and it isn't fair. How does she feel being arrested for the reason she condemed others. How could she intentionally drink and drive when she suffered the pain of being a victim of one? I know how...she's human.she made a mistake. Shame on her for advocating every person that gets a dui is a drunk seeking to destroy lives. Not true. Consider the actual circumstance and who was affected before ruining innocent lives...on either side of the fence.

I can't tell if this is sarcastic or not, so I'll bite.
It's the same reason you're not allowed to walk out into a park and start firing a machine gun into the air. I mean, as long as you kept the gun pointed in a fairly safe direction and didn't hurt anyone, who cares if you let off a couple hundred rounds in public?

In the interest of the public good and safety, the state prohibits people from engaging in actions that dramatically increase the risk they will harm fellow citizens, intentionally or not. You can't have it be 100% results-based (i.e. drunk drive and hit someone - bad/illegal; drunk drive and don't - you're A-OK) because due to numerous chance factors, results don't correlate perfectly to whether the choice/action was a good idea or not. There needs to be greater deterrence.

What ticks me off is the majority of the MADD mothers generally have kids that are out of control. Yet, they'll be the first to enforce rules on others.

Also, let's be honest, the MADD people who sit in courts and demand stricter penalties for drunk drivers are the first to go crying to the prosecutors, judges and officers to cut them a break on a DUI.

MADD doesn't support Sober ride programs or taxis, they want vengeance, so charge them double the penalty for DUI's when they are caught.

As for driving after drinking, was ever happens as result the person should be held accountable. Technically speaking more accidents occur as a result of sober drivers. Idiots on the road are always idiots on the road.

Again, a backward way of thinking about things. And a miserable long-term poker strategy if you followed the same logic.

You argument is greatly affected due to the ratio of drunk to non-drunk drivers. If (and I'm making up #'s for illustration sake) drunk drivers made up 4% of people on the road, and got in accidents 50% of the time, and sober drivers got in accidents 5% of the time, obviously the total number of sober accidents would be higher at a rate of 4.8 to 2, or 2.4:1.

That doesn't mean it's a bad idea to make drunk driving illegal, regardless of any individual outcomes, because the inherent behavior is so much more dangerous.



Edit: I'm not a member of MADD, there may very well be sever hypocrites in the organization, and things like safe ride programs are probably a good idea. But statements like the one I quoted and from 'justsayin' above don't hold up.

The accident percentage rate is greatly higher for sober drivers. The difference is drunk driving accidents are news worthy. Yes, you would think it would be greatly higher for drunk drivers but it isn't. Sorry to burst every bodies bubble. : (

I am certainly not proposing people drive drunk, get a taxi for $13, consider it part of the bar tab and evening entertainment cost.

Now texting while driving the percentage is higher, go figure.

Of course you have a higher percentage chance of being in a sober-related crash rather than a drunk-related crash, solely due to the % of drivers on the road at any given time skewing much more toward sober.

However, your individual chance still goes up dramatically if you are drunk vs. sober (all else being equal), and thus the state has a legitimate case to outlaw such behavior which would drive (no pun intended) up your chance of harming someone else in public, i.e. on the roads.


Unless you are arguing that at any given time, a specific drunk driver has a smaller % chance of being in a crash than if they were sober - which I don't buy. Or to say another way, Surely you just meant that if you get into an accident, it's more likely to be sober-based than drunk-based. Which isn't really the point. Be careful how you present statistics.

The MADD mother should be required to be processed in precisely the same manner as any other DWI offender would under the same circumstances. No special treatment, leniency, or sympathy by the judge or prosecutor, or by the Driver License Bureau in her state. Her organization pushed and pushed for these laws, so let her experience them the same way any normal person would.

No one wants to see drunk drivers on the road. There is a far greater chance of a drunk driver causing an accident than one who is sober. And yes, the law punishes those who are more likely to cause or have an accident. Speed limit laws follow the same thought process. If that train of thought was followed throughout the law, all politicians would be arrested upon taking their oath of office. They are far more likely to commit crimes than non politicians!

The problem is the laws and rules and how the our constitutional rights are waived. There is illegal search and seizure during a sobriety checkpoint. One is not allowed to refuse the breath test, for that results in punishment. Sort of like someone charged with murder who refuses to plead guilty being sent to jail for homicide without a trial.

I am happy to hear that someone involved in MADD was arrested for DUI even they are not perfect human beings and hopefully one will be arrested 3 or 4 times and have no license for 25 years due to revolktions while someone who has killed someone, but was their first DUI (well first time they were caught that is) goes to jail for a couple of years and gets their license back...how is this scenario fair? YOU SHOULD NEVER GET YOUR LICENSE BACK IF YOU KILL SOMEONE. Millions of people commit the act of Drunk driving each and everyday, bars, weddings, parties, depression all these things contribute to this act. My sons life has been ruined by these tough laws and he has hit no one, yet there are people back on the road who did kill someone because it was their first time, this country is retarted and so are the people including MADD who think this is going to deter people including the judge who just sentenced you from going to the bars after work and driving themselves home after numerous drinks.....This is bull and the Lawyers are making lots of money off of the fools who are going to do it again and again because why? You are not treating the disease of alcholism with tough laws...families are ruined for the act alone, yet someone who has killed someone is allowed to continue to drive only because the laws say he can have a second chance to kill someone else since it is only the FIRST TIME. I will never agree with the laws and if you think this is a remedy think again. Now people are driving without licenses and will continue to do so this is not going to stop this problem. Valh -- you've got to be kidding. If your kid's "life was ruined" it is because he repeatedly drove drunk on the roads and endangered everyone in his path. No one, MADD member or not, should be driving drunk - but if you get caught once you need to avoid even drinking and then driving even if you are not drunk.

"My sons life has been ruined by these tough laws and he has hit no one.." but he did drive so recklessly that some cop(s) saw him driving erratically, pulled him over and found he was intoxicated. He was arrested before he did kill someone - and perhaps saved his own life in the process.

"You are not treating the disease of alcholism with tough laws..." but you are hopefully taking some criminal off the roads before he does kill someone. It's not illegal to be drunk - it's illegal to drive while drunk. There are treatment options out there but your son chose to put himself in a position where he violated the law - I am EXTREMELY glad that the law had its intended effect and your son is no longer driving drunk on the roads.

"Glad to see MADD members are human with disease too and hoping one of them gets their license taken away for 20 years for doing nothing to anyone but themselves...RIDICULOUS" Irony is always good for discussion but I think it's unfortunate that someone dedicated to stopping drunk driving would commit the act themselves. Don't delude yourself, however, that an arrested drunk driver didn't do anything to anyone else -- they got caught before they did kill or injure someone else.

Driving is not a right, it's a privilege and if you abuse the privilege you lose the ability to drive. Drunk drivers who have lost their driving license can take a bus -- it's safer for all concerned.

  1. Drunk drivers are a danger to themselves and others, and they should be prosecuted to the fullest extent of the law.

  2. Unless you weigh less than 80 pounds, a .08 BAC does not constitute drunk driving.

.08 BAC doesn't depend on how much you weigh -- a 250 person is just as drunk at .08 as an 80 pound person.

Check out how much you have to drink to get to that .08 level: www.ou.edu/oupd/bac.htm It actually takes quite a bit to be legally intoxicated and no one should ever be close to the limit when driving.

BTW, the 8 year old boy that was killed on Duke Street yesterday was killed by a 22 year old drunk driver.

If you drink three beers with in an hour you can be at .08. I've seen plenty of people have three beers, like with dinner, with in an hour and there is no way you would of known.

Drunk drivers should be treated the same as everybody else. If they are breaking the rules of the road they should be held accountable. But if they are following all the rules of the road nobody should bother them.

More than 70% of all accidents are called by sober drivers. So the problem is really sober drivers, not drunk drivers.

guy from canada here and i agree that MMADD are a bunch of fucking idiots.

being made a criminal based on probability is unconstitutional.

gun owners don't serve life sentences prior to owning a gun and hurting someone, peopel from abusive parents aren't required a child abuse jail term prior to having kids even though statistically they are likely to abuse their own children, you cant simply start making criminals out of everyone based on the fact they may hurt someone.

the really important statistic here should be that 99.9 percent of people that drink and drive do make it home without causing themselves or others harm as they are responsible adults and know their limits.

drinking and driving statistics are super flawed. half of statistical crashes were suspected and not confirmed, of that half at least 50% of those accidents would have happened regardless of alcohol, and of the remaining accidents there is a certain percentage of them cause by the sober driver in the accident.

cell phone use has been proven to impair ability to drive to a greater extent than alcohol impairment yet you can walk away from that with a small fine and no suspension of your driving "priviledge". i have put priviledge in qoutation as here in british columbia canada if you are a visible minority apparently driving is a right(hindhu men can wear turbans on motorcycles and you can take a drivers test in multiple languages even though Canada only has two officially spoken languages that you would ever find on a road sign). Why should a Hindhu mans right to freedom of religion have any thing to do with the "priviledge" of driving? If driving is in fact a priviledge then you conform to the law as laid down for the rest of society or loose the priviledge. why does this only apply to concerns about drinking while operating a vehicle.

punishments should fit the crimes, as they do for all other sorts of crimes.

I'll believe MADD is a legitimate organization when they publicly protest the perpetual lack of punishment doled out to celebrities, especially NFL players, who are caught driving drunk. NFL player Donte Stallworth killed a man in a hit and run accident a few years ago while legally drunk. He served less than 20 days in jail.

I attempted to contact local and national MADD officials, and only one of them even bothered to answer. It was a typical, political no response. Needless to say, no member of MADD was sitting in the courtroom when the travesty of "justice" in Stallworth's case was meted out. They only do that when the defendant is a nobody.

Thanks to MADD, countless numbers of formerly non-law breaking "drunk" drivers are arrested, their lives turned upside down in the process, every year. The ONLY thing MADD has achieved is lowering the legal limit, and therefore arresting more less drunk drivers, and penalizing them far more severely than before. Unless, of course, the drunk driver is a pro athlete or other celebrity, in which case MADD is silent in the face of the inevitable "suspended sentence/community service" celebrity special.

There is a huge difference between having a few beers, and getting caught at a roadblock, and being nearly unconscious, blowing a .25 or higher. Thanks to MADD, there is no legal distinction. MADD is a joke.
