Here's the scenario:

Leaving my neighborhood, someone in a big red Ford SUV blows through a stop sign and cuts me off. I took my foot off the accelerator and let my car engine brake instead of stomping on the brakes. That left me following ~ 1 car length behind the SUV for the 100 feet or so between the intersection with the stop sign, and the following intersection with a stop light. We were going between 20 and 30 mph.

At the light, the car stops and the door opens. My heart started pounding for a moment- until a scrawny white contractor looking man hops out of his SUV and starts walking back towards my car. He started yelling for a moment while I gestured for him to get back in his car. When it was obvious he wasn't interested, I opened the door to move him back and stepped out. It's never a good idea to open your window and put yourself in a position where you are unable to defend yourself.

Having never encountered someone so stupid as to exit their vehicle and try to start an altercation, I was at a loss for words.

Obviously agitated, he said, among other things, "Are you in a rush? Because I have allllll day!" and "You better watch yourself."

He seemed to become decidedly less uppity once he noticed I had a few inches and a few stone on him. Plus I stood right in his face, even though the words were escaping me.

Eventually my favorite man decided to get back in his car and drive off, but not before he waited for the light to turn yellow so I'd have to wait for the next cycle. Thanks, buddy!

What I wanted to say was, "If you want to throw the first punch, I can school you in proper traffic etiquette in front of all these people." Next time.

I've been followed around my neighborhood after I flicked off a BMW that had to swerve to avoid rear ending me. Is it time to get a CCW?

if you're svelte and weight 3 stone more than your fellow driver, you must be over 7' tall. dont try and be cute by using stone as a measurement if it doesn't fit with your story.

I'm about 5'7". He was about 5'5". I'm very athletic. He was as scrawny as I used to be. Do I need to spell it out for you any further?

I will anyway.

Other guy = ~140, and that's a high estimate
Me = ~140 + 3 stone (42 pounds)

I used stone because saying "I had 40-50 pounds on him" sounds too much like bragging to me. But so much for that now.

Nice! The cracker got out of his truck to confront you? I can see why you'd be speechless. That's insane on his part. I think the SUV gives him a temporary testosterone boost. As the boost ran out he scuttled back to his overgrown minivan.

I've also noticed that engine braking is a foreign concept to most NoVa drivers. If they don't see brakelights, they keep their feet mashed on the accelerator rather than maintaining a safe distance (safe distance in NoVa - hah!). Of course, manual transmission is another long lost skill around here.

I find most NoVa drivers proceed using the floored/not floored method. Sigh...the wasted gas.

I don't think a CCW would have helped much... hanlding it when your life isn't reasonably in serious and immediate danger can get you charged with brandishment.

Even if he started pounding on the car you couldn't have done much with the gun unless he had a weapon on him or grabs something to break your window to get at you. The best thing to do if no one was behind you was slowly back the car away, otherwise keep the window rolled up and call the police from your mobile phone if you have one, giving them the license number of the SUV and that he is standing outside your window yelling and acting in a threatening manner. Once someone like this sees you are on the phone and not responding to him, hopefully he'll just go away. If he hits the car or something stay there until the police arrive and have him charged with assault.


Personally if you are in the habit of flicking off people even if they have wronged you, you may not want to get a CCW. I don't react to people just because I don't need the trouble and the hassle. If someone threatens to harm me and begins to take action on it, the last thing they may see is my barrel. But the rule of thumb is don't clear leather on a firearm unless you have already decided to kill someone in self defense. You can inform someone you are armed and suggest they go away peacefully, but unless you or someone near you is about to be hurt by an armed assailant (knife, gun, whatever) then deadly force isn't justified. And it's not worth going to jail when you started out as the victim.

One time these teenage assholes were following my brother around shining one of those spotlight things that plug into your cigarette lighter. Well, as he started getting closer to home, he started getting a little more edgy. Finally he stopped. Threw his old chevy impala into reverse slammed on the gas and backed into them. Threw it into drive and took off. I'm sure their piece of shit 199x escort was fucked, and his impala didn't have a mark on it. I wonder what they told their parents.

He stowed it for the night in his girlfriend's garage and called me to pick him up. I stopped by Blockbuster on the way over and rented Road Warrior.

Now, back on topic. Used to be Ben, that if a man pulled some shit like than and then had the audacity to get out of his vehicle and talk shit, you'd be justified in beating the living hell out of him. (not shooting him, though).

In certain areas of the Country that's still understood. But up here... I just wonder when and how we got used to the rudeness, to people cutting us off, flipping us off, driving like assholes. If times were different, I'd love to stop somebody and beat some sense into them. I guess they call that road rage, but when I get that urge it's not usually rage but just a sense of righteous indignation. I feel that people driving recklessly are a direct threat to my life and the lives of people I care about. If they were to cease to exist, the world would be a better place. That's why, among many other reasons, it's a good thing I'm not God.

Pgens, the CCW comment was a joke. :)

As far as the rest, I respectfully disagree.

I've seen numerous incidents where someone has been standing outside the driver-side door of another car apparently road-ragin'. If you are inside the car at that point, you are at a complete disadvantage and at the mercy of an already unstable person. I would not risk property or personal damage to wait a nutter out.

Of course I do everything possible to avoid a confrontation in the first place. The other night in Burke I wasn't going fast enough for someone and they started to follow me while trying to pull along side me. I just took a right turn that they couldn't make, went around the block, and continued on my way. I've done that plenty of times. (Part of the reason is once I'm in a verbal argument, I can't keep my mouth shut. It's better for me to just avoid it.)

But once someone is out of the car and escalating the situation, it's a different matter. As silly as it sounds, I see my car as an extension of myself. It's not the greatest car in the world, but is it one of my more valuable possessions (both dollar and utility wise). Unless I fear for my life, I'm out of the car and in the middle of a confrontation if I think someone is going to damage it.

It might not be the wisest course of action, but I do not trust other people (in this case, the stark raving mad guy), the police, or insurance companies to handle things properly.

Hey pgen since you seem to be pretty familiar with local law, would it be considered brandishing if you moved your coat to the side or lifted up your shirt to show the piece (not taking it out or pointing it) and not threating anything?

I think it would depend on your intent. If you are moving your coat to the side with the intent to get your wallet out, it should not be considered brandishing (though arguably you should not allow it to be seen at all).

If your intent is to show somebody that you are carrying and they should back off, it is branishing.

If you are the attacker, yes but your link says "However, this section shall not apply to any person engaged in excusable or justifiable self-defense." I think if someone threatened you and you showed someone you were carrying in order to head off an escalation you could argue you did it in self defense.

But the above applies to holding it. It is already legal to open-carry in Virginia, so it's hard to image a situation where just moving one's coat aside would be brandishment. Unless you said "look at me, I'm a badass" and did it.

I have read people post that if it's at night and they are walking to their car and there are a group of weirdos about that they make a point of swiping their coat aside a little slower to make sure a holster is visible to them, but personally I don't do that crap. Some people look for excuses to get into fights and I don't want to give anyone excuses.

The open-carry thing is why you don't want to call undue attention to yourself. Cops get called to restaurants all the time because someone is open-carrying and some dumbass calls the cops saying "there's a guy with the gun in the restaurant!". Of course by law a CCW holder MUST open-carry in places that sell alcohol for on-premesis consumption but Joe Average doesn't know that. A couple of guys got hassled by cops a few months ago at Starbucks because they were open-carrying and some bimbo called the cops saying "two guys with guns in Starbucks!". The cops in Northern Virginia know it is legal but may still hassle you. I guess what I'm trying to say is just don't knowingly draw attention to yourself... the gun isn't there for show, it's there for personal protection. Why 911 operators are too stupid to ask questions like "is the person holding the gun or did they threaten anybody? Or are they just sitting there with a holstered gun? If it's #2 then call us back if it turns into #1" is beyond me.

I was interpreting "brandish" as any manner of "display...as to reasonably induce fear". Upon further review, I must agree with you that to brandish requires that you hold the weapon in hand.

That having been said, I still contend that overtly displaying a holstered gun with the intent to induce fear is improper, and may escalate a situation instead of diffuse it.

Such a true story. I live in sully station in centreville. My neighbors have followed me home, steped in front of my car came up to the window, chased my car on foot, chased my car with a bike, all to tell me the fucking kids are out side and I have to drive 10 under the speed limit and how they will call the cops on me. The best neighbor bitch fit I went through was when a mini van pulled over in the neighborhood let me pass then followed me home and told me to slow down and how I drive reckless.

This happened to me once years ago on Suitland Pkwy. We were all travelling about 50mph during morning rush. I was in the right lane.

I turned on my signal and when it was safe, I went to change to the left. SIMULTANEOUSLY, the teeny Geo (whatever) directly in front of me changed at the same time.

So, no longer was I safely maneuvering to travel in a new lane & at a safe distance from the truck I was getting behind, but suddenly I found myself on the ass of this Geo wedged in the too small space.

Like you, I took my foot off the gas so as not to startle the whole lane behind me--braking suddenly or ostentatiously would mean yo-yo'ing. And at a good rate, I slowed.

Then I realized that I was still slowing but the same distance behind the Geo and the forward traffic was getting away.

"WTF?!" 45mph. 40mph. 35mph... and I had to put my foot on the brake. I went to change lanes again, but the prick boxed me in next to the left lane.

Luckily, the other traffic wanted to move it along and opened it up for me (I was in a Pontiac V6) so I went around.

On my way by him, I just had to look at why this guy thought I was causing him problems (now he was resuming speed). I looked baffled at him and he flashed ME the finger! I only just got on the pkwy the few minutes before. He was already on it, so it's not like I'd done something wrong well before and now was his time to get back at me. Damn.

Assholes. The guy did an illegal lane change while not paying attention. Out the the blue (for HIM) he thinks I rode up hard on his ass when he sees me in the rear-view and decides to punish ME.

I never understand asses like that man. But there are plenty of them walking and driving the streets unfortunately.

Not sure why you feel the need to resurrect a post nearly 8 years old.

There are a lot of bad and aggressive drivers in this area. The best thing to do is ignore them. But if you are having problems with bad or aggressive drivers call the police at the non-emergency number for FFX Cty its (703) 691 - 2131. Get as much information about the vehicle that you can safely including color, make, model, license plate (including state) and a description of the driver.

If you have someone with you who is not driving and can take cell phone video of the offending driver it will help your case. The police will meet you at any location and take a report. Since the police most likely did not see the offending incident, you will need to go to the magistrate and swear out a warrant on the offending driver and will have to go to court and testify. The police call help you with this process. Cell phone video will help the magistrate issue the warrant and will help your case in court. I have seen several convictions based on cell phone video. I have also seen several get tossed out because it turned into and he said/she said trial and both parties were convincing.

Hint that you did not get from me or FFXU: When you call the non-emergency number tell the dispatcher you suspect a drunk driver. Tell them the behavior you observed, a description as noted above, the road you last observed the vehicle on and the direction the vehicle is traveling. This information will be sent via our CAD system to all police officers in the area. If we observe the vehicle operating aggressively, even if they aren't drunk, we will pull them over. They will be charged with numerous traffic offenses, including aggressive driving, reckless driving, speeding, following too close, improper lane changes, failure to signal, etc. The driver will wind up at the ADC for at least a few hours and may even get jail time when they go to court!

Last word, aggressive driving is not worth dying for!
