My dumbass did something really stupid recently. Stole a laptop from work cause im struggling with my $$$ and someone offered me money for it if I get it for him.

Got busted a few weeks later. Here I am now, fired from work, facing a felony of Grand Larceny in loudoun county.

Its my first offense, im a good kid, im still young (18... still feel really young too), i've got amazing grades, I started college as a junior in high school, just about to get accepted into virginia tech (about to be a junior in college at 18 years old), i always have good intentions but money is the root of all evil and i fell into the temptation for more money..

From your experiences, do you guys think this will get dropped to a misdemeanor? I read that the sentence is anywhere from at least 1-20 years in jail... I couldnt take the 4 hours in jail that I spent when I got arrested for it.. I cant imagine staying in jail for a year. I feel like now i've been exposed to reality and its no joke...
what do you guys will think happen to me?

I can't say but as someone so young with so much promise they'll probably offer you a deal to try to get you out of this without too much trouble but with you still learning your lesson. A year, two tops. I know it doesn't seem like it now but that'll go quicker than you think. Plus you'll probably have to pay for the laptop.

I wish I could offer more and better advice for you. As far as the charges getting reduced, I suspect it all depends on the mood of the judge for that day.

Have you tried discussing your matter with the Human Rights Agency for your county? Was it clear that they fired you for the theft? Or, were there other things that they had been harassing you about recently and used this latest incident to fire you? If you go the Human Rights route, they might have some other suggestions to offer you - or, they could easily just tell you that the offense is out of their league since you were arrested.

With that being said, you do realize that places like Best Buy and the Micro Center now sell some pretty well-equipped laptops for $299 (from Compaq and HP).

Yeah I actually felt a little bad about that which is why I came back and said I was joking. Get a lawyer and he'll work out some kind of deal for you. It'll cost you some money but that's kind of part of the punishment if you think about it. I don't have a lot of experience with actual criminal law or anything but they aren't going to send you to jail or ruin your life over something like this.

I know this is "too little too late" but next time if you have a job and a checking account, just go get a payday loan. You can go to a storefront (Ace Cash Express, Advance AMerica, etc) or online if you need even bigger money- cashcall could have fronted you up to 5k as long as you have a job and paystubs. Granted the interest is off the charts, but if you are desperate (and I mean about-to-get evicted or your car broke down and you need it fixed or downpayment money for a new one or else you will lose your job desperate, not "I want o go to the club or buy new clothes" desperate).

That is the best bet if you have tried all other resource...credit card cash advances, asking your payroll/HR about a paycheck advance (my company does them for extenuating circumstances, up to 1/2 a normal check paid in cash on the spot if needed and with a signed agreement), borrowing from friends/family, selling stuff on ebay/CL, doing odd jobs, etc. You could have also gotten a title loan on your car if your car was paid off. Even if you have shittacular credit, SOMEONE out here would give you a loan. You DID have options but chose the wrong one. Well, now you know for next time. :)

Relax, unless you have an absolutely moronic lawyer, you will not serve jail time. More like a lengthy probation with restitution to pay the company back. You will have a record unless they offer something like a misdemeanor. But it will be on your record, so when you go for a job interview, you may have to explain this blight on your record - don't offer excuses, just tell the truth. As for college, you may have shot that to hell. I can't imagine VT accepting someone with a felony conviction.


Have you thought about actually sending an apology to those you stole from instead of writing on an electronic board? Cause it sounds like you are worried only about yourself and that is the type of thinking that got you in this debacle.

The good news is that this happened while you are young, so you can learn from this. Your brain is not fully developed until 24 or so. One of the last things to develop is seeing how your actions impact others, it happens in the front of your brain and that isn't really fully developed at 18. That's why you aren't allowed to drink legally yet - you don't really get the concept that what you do can have an affect on others and your future. (Look through this board and you will see some others haven't fully mastered this lesson yet as well, that's a tip-off to spotting someone who is not mature)

This is a learning moment, take it, embrace the lesson and learn from it. If you do something bad, you will one day get caught. Do enough bad things and it catches up to you, so concentrate on doing good stuff, like writing apology letters (not emails) and reflecting upon your actions.

Good luck and write back to let us know how it goes. If someone offers you a deal to bargaiun down to a misdemeanor charge, take it, looks MUCH better on your record. Stay out of trouble, keep your head down and do some volunteer work.

my whole life plans are screwed right now.

Idk what will happen with virginia tech, I have to sell my car ASAP so i dont have any payments, im already looking for a new job (probably going to be an IT specialist on nova campus -- just applied yesterday). im rethinking EVERYTHING..

life did not hit me until that day.. i thought i was on point with my life, i had everything planned out, after virginia tech i'll graduate at 21 years old and ill work with DHS.. everything was planned out

for selling your car quick, take it to carmax. Just be prepared to pay the difference in what you owe your lienholder on the spot so you can be 100% free and clear. Example- carmax offers you 10k for your 07 civic but you still owe the lienholder 12k. Pay carmax the 2k and you are free and clear and owe no one. Getting a felony grand larceny charge bumped down to a misdeamenor is super hard. My friend paid nearly 10k for a lawyer, but was facing 3 felony counts which got pleaded to 1, but even with the 10k in court fees he will have the felony conviction forever.

How much was the laptop worth if it was a piece of junk 250 one you may be able to plead down to a misdemeanor, but if it was a nice one with al ot of software you're probably stuck with the felony. Bring a first time offender you'll probably just get some community service or probation, but that felony charge is a life sentence of its own.

Do not worry about jail, atleast you are young and 5 or 6 years from now you can explaing the mistake and say it was terrible judgement. You're in for a few rough years though and do not mess up again. I wish you the best of luck though.

yeah, that won't come through, either. virginia tech will revoke their offer of acceptance, which won't matter anyway because you will be in jail when fall semester begins.

First of all, you need a lawyer.

Second, if you have NO prior record, and GOOD grades, and your family minister will say nice things about you, and you can complete your restitution before the court date, you might be able to get this tossed into some kind of pretrial diversion program -- if you keep your nose clean for a year, it's like it never happened.

Shit man, he probably wouldn't even be hired as a driver with a felony conviction, at best he'd be one of the dudes hanging off the back.

But in all seriousness my friend, I don't think you'll get any jail time. Most likely a semi-large fine, couple years probation, maybe some court-appointed behavior modification classes or something...but no jail. I know people that've done far worse but still managed to come out without any jailtime. Of course, a very good lawyer is paramount to you getting the best deal. Spend your money there, don't skimp for the $500 lawyer.

Dear unknown, first disregard most of the posts from idiots on this board. I have been in your situation in fairfax county and was able to come out of it ok. I had a robbery and larceny charge and was able to get them both reduced to misdeamenors..I didnt go to prison and i didnt lose my job....Grand larceny of one laptop wont get you prison time (especially since you have a clean record and are the "college-bound" type)..and also since it was one instance and not a "theft operation".... Most judges are not interested at ruining your life at such an early age for one dumbassed mistake. Additionally, I have seen guys with multiple grand larcenies on their records get probation; so, in the unlikely case that you are convicted of grand larceny, you will most definitely get probation... but-if i were in your situation--i would mitigate my risks,, so here is what i think you need to do:

(1) DO NOT talk to the police about this or the merchant/business, if they attempt to contact you. Use your right to remain silent

(2) DO NOT talk to any of your friends or family about this incident.. you never know who the police or prosecutor may be talking to...

(3) Hire Robert Whitestone Senior, Ted Sibert, or Peter Greenspun IMMEDIATELY (it's going to cost some money, but it will be worth it because they have the best chance to work with the prosecutor to get this reduced to a misdemeanor)...DO NOT use a public defender or some ham-handed cheap lawyer... By hiring whitestone, Sibert or greenspun, you are mitigating your risk and investing in your future.

(4) Through your hired attorney, pay the merchant back for the stolen laptop or return it (if you have not already done so)..If the laptop has been returned, ask your lawyer to contact the merchant to determine what other losses you can reimburse them for....DO NOT contact the merchant or business directly.. have your lawyer take care of this
(5) Through your hired attorney, Write a letter of apology to the merchant or business (and have your lawyer take care of getting that letter to the merchant or business).....In your letter, DO NOT focus on how this has fucked up YOUR life; rather, you need to focus on how your crime has hurt the merchant/business, your family and friends, and your community.. and it needs to be REMORSEFUL...
(6) DO NOT advise virginia tech of this incident
(7) DO NOT advise your current or prospective employer of this incident
(8) Get that IT job that you referenced or some professional IT job asap, BEFORE any conviction goes on your record and would be picked up by a background check... once you are employed, most companies dont run a background check (unless you are doing work that requires a high level security clearance and would necessitate periodic background investigation).. the background check is generally run when the employment offer has been accepted by the candidate. I believe this would probably be true for the NOVA IT job that you referenced.
(9) Be prepared to be GENUINELY REMORSEFUL at your sentencing day.. get ready to shed some tears and appear to be really sorry to the merchant (from whom you stole), your family, and the community.. If you are arrogant or focus on how this has fucked up your life, the judge will lay the hammer on you.

Do what I say above and you will come out of this just fine.. Best of luck

I feel for you, man, since this does have the potential to screw with your life. You should abandon your dreams of working for DHS, though--someone who is willing to steal computer files is about the last person the US gov is looking to hire right now.

What did you need the money for? I guess it could help your case if, like, your child was dying and you needed to buy cold medicine.

DHS is overrated. The Secret Service is way, way overrated. I filled out all of their paperwork 25 years ago. It must have been about 25 pages of answers that I penned to each of their questions. Fortunately, I didn't get hired into those positions. Now, when I'm downtown and working at one of those offices, I see those Secret Service officers just sitting at the desk with a paperback book each and every day. Man, I'm just glad my life turned out the way it did - and, not the other way if I had been accepted to work for one of those agencies.

I don't know how it is done today, but if they do the background checks the same way they did them when I worked for Treasury, you are screwed if the result is anything less than Not Guilty.

It is my understanding that Virginia will not bury arrests when the defendant goes through a diversion program. If they check arrest records they will find that the original charge was grand larceny. If they only look at conviction records they are still likely to uncover the felony charge. It used to be they would follow up on any convictions and a review of the case would disclose that the original charge was grand larceny.

Even if the OP can get Virginia to bury the charge it is still likely they will uncover it. When I was with Treasury they required that we provide the names of all former employers and I know they contacted the more recent ones. If they do the same what do you think this employer will say?

Remorse, restitution and a competent lawyer should be able to get the OP off with either no jail time or with minimal jail time. However if I were the OP I would suggest having a backup plan.

i just spoke to a lawyer

he told me that he usually gets his clients off with no jail time, but sometimes you might have to do a few days or a week in jail and the felony will be dropped to a misdemeanor.

he told me to make sure i bring my parents to court to show the judge that im still a kid, go to a psychiatrist just to help my case out a little bit in court. bring my grades (i've got really good grades), etc.

When you apply to DHS (or to whomever requires a clearance), the Grand Larceny charge will be an issue.

You CANNOT hide it from the background investigators.

You must report it, even if your case gets dismissed and expunged. OPM will still find out about your criminal record.



Clearly, this criminal charge is going to be a HUGE red flag during your background investigation. However, it may not be grounds for automatic denial (as mentioned in a previous post).

What the background investigators look for are lifestyle patterns. They want to know if they can trust you with U.S. Government secrets.

In your instance, say you apply for a DHS job in 5 years. Assuming you are a PERFECT SQUARE for those 5 years, they may infer that you have changed your life around for the best, learned your lesson, etc.

On the other hand, they could say, look this kid lost all our trust because if he stole a laptop for money, he may sell Gov. secrets for money in the future......

I think the chances are good of this being dropped to a misdemeanor. You'll probably do a year or two of probation and 100 hours of community service since this is your first offense. Like everyone said...GET A GOOD LAWYER.

For DHS - I agree with the other posters that you probably won't get a job there. At least not in the next few years since you did steal property from your place of employment that probably had confidential information/files on it.

If you do get a felony, good luck getting a job. No matter what people say...it is going to be hard as hell to get a job anywhere! You'll probably have to work for a really small company that can't afford to do a background check since they're really expensive...oh yeah...and obviously you will need to lie on your application to even get your foot in the door.

Okay, first thing is I would stop soliciting advice from this forum. You have a serious situation to deal with.

Use your common sense....If you want to protect your future employment prospects, you need to bend over backwards as much as possible NOW to avoid anything serious going on your record.

Also, don't rely to heavily on your brothers. Assuming they have a clearance, it would be a burden on them to help you out. Think about....when your brothers have to go in for their background re-investigation, they have to explain why they helped a person who was charged with a FELONY, get a job at DHS.

It would help overcome it if you picked up related work experience during college. If you can get an internship at DHS or other government agency, it would be a big plus. Colleges has work-study options where you can do this during the school year, not just as a summer job.

If it is your first offense, it should be reduced to a misdemeanor. You should have the money ready at the preliminary hearing to offer instant restitution. Also once it is reduced, wait a year, and get the misdemeanor expunged. It cost $90 or so.

If you have a great radio voice than screw it. Ted Williams fucked up and now he is famous.

Larceny is a bitch of a conviction to have hanging around your neck, because the issues that most people look at when hiring new employees is whether or not they can be trusted. I'm certain you can have it lowered to a misdemeanor if it's a first offense, but get a good lawyer, and have this be a lesson for the rest of your life.

DON'T GO POSTING STUPID SHIT ON THE INTERNET ABOUT COMMITTING A CRIME.

You never know if the police made an evidentary error or conducted an illegal search. You'd be amazed at the amount of legitimate evidence that is suppressed at trial because the police broke the law without anyone but the defense attorney realizing it.

Recent example from a local court:

A guy (D) is driving down the road with a busted tail light. Cop stops him. The cop's reasonable suspicion for stopping him was that D was driving with defective equipment.

D's license is suspended so the cop arrests D. After his arrest, the cop searches D's car. The cop finds a bunch of credit cards under the driver's seat. The credit cards have a female's name on them. D is charged with credit card fraud and theft in addition to driving on a suspended.

A subsequent investigation reveals that the owner of the cards had previously reported them stolen. The other day, her car window was broken and purse stolen.

There's video of D using the stolen cards.

Seems like an open and shut case right?

WRONG. The search was unlawful under the Supreme Court case of Gant v. AZ. Because the search was unlawful, all evidence obtained as a result of the search was suppressed, including the videos of D using the stolen cards.

The guy got off.

Call a lawyer. NOW. And stop talking about the fucking thing.

How does that process work? I thought once your convicted of a misdemeanor its on your record for ever pending a pardon from the governor. Any info would help. Thanks.

I'm pretty sure you can only get something expunged in VA if you were acquitted, the CA moved for a nolle prosequi, or the charges were otherwise dropped.

In other words, if you take a plea which involves pleading guilty to a lessor charge, you're probably fucked.

AGAIN, GO GET A FUCKING ATTORNEY. Is it really worth fucking up the rest of your life to save a few hundred????

Just talk to lawyer. Talk to as many as you can. Ask them questions, but don't rule out the point that your record matters and the actual court you'll be prosecuted in. This is what why they're there. Some Judges are worse than others, in this case ask whichever lawyer straight out how to cut a deal.

Do an internet query for a lawyer who does this stuff. But, you'll probably have to pay'm, but it's worth the service I should think. I don't have personal experience with this myself, but you'll probably be billed or have to pay up front.

This happened to someone I know last year. He stole a laptop from a FFX Co public library when someone stepped away for a moment. He ran out and two guys chased him down and called the cops. He ended up getting 3 days in jail, a grand larceny conviction and a fine. He had a FFX Co. court appointed attorney. Not sure if that matters or not. Good luck.

he's going to see the following:

a male who was 18 in 2011.
lives in loudoun co.
started college roughly 2 yrs prior.
went to NoVa
worked at NoVa (or at least applied)
went to VT.
had a job that had laptops laying around.
has two brothers (with relative ages) that work for DHS and one is a "almost agent" with a badge.
did i miss anything?

they're going to see all this, and look at their investigation forms, and see that you are admitting to a felony.

Yeah, that was a stupid move. Sounds like you know that now -- or is it now stupid because you got caught? Have you spoken to your employer and begged for forgiveness? Might be worth a shot. Good luck. Finally, I doubt anyone conducting a BI on you will be able to determine who you are because you posted on this forum. That would make for a pretty good investigator who is probably working more on interview numbers. Just make sure your neighbors don't find out. If they find out you are done.

Even though you're legally entitled to have at least your first dismissal expunged in VA, I've actually witnessed completely dickheaded prosecutors refuse to sign-off on them. Some prosecutors are absolute assholes, and they love to play games just so they can earn a few extra stripes here-and-there.

On the other hand, I know of some law practices that have dedicated staff members for expungements, and they can expunge more than most people realize.

Courts cases and records can sometimes rely upon who you know, as much as they do the actual facts and case law. A good, experienced lawyer will most likely know the lay of the judges and prosecutors who they're dealing with, and some might even personally know judges, prosecutors, and officers.

There's almost no way a background investigator would find this thread in 5 years. There's no name, no screenname associated with the OP that could be tied to other accounts. How is an investigator going to find this with just a google search for the guy's name?

I am sure if you go in and ask, they will think your up to something and not taking this seriously.

But if it is your first offence, and your a decent person they normaly waive most if not all the charges.

The fact you stole from your employer, will make it look like you have an issue earning a living, and respecting rules and authority.

They got me off on ALL sorts of shit in FFX.

Most of it I did, but never had to pay a dime to the courts and it was removed from my record. (Idid pay them of course)

Even my attempted murder charge they got changed to domestic assult and then dropped. No classes, no fines, and totaly off my record.

You won't be going to prison. It is a felony but being sentenced to anything over 12 months is prison time. You will not be sentenced to anywhere near that. Trust me. If you do get jail time, it will be a few months max most likely along with probation.

As far as homeland security. I am sorry that will not be happening. Any job requiring any sort of security clearance will not be hiring you as they do an extensive investigation (check with your neighbors, teachers, everything).

Even as a felon, you can still make something of your life. It will just be much more difficult but not impossible so don't let these guys get you too down. Does it suck? Yes. Is your life over? No.

So sorry to hear your story.We all screw up especially as kids. A friends son had the same type issue you had, when we discuss this problem of a "life sentance" for a relitively minor offense around "good" respecable professionals we always get comments about "boy if i ever got caught for all the stupid things i did as a kid id be screwed for life!!!!" everybody screws up - unless they live in some sort of holy bubble.
Yes as others have said, its going to be a rocky road, but success and living a good life in spit of all is your best revenge. "Whatever does not kill you makes you stronger"
Learn from your mistake, go forth, make adjustments and lead a decent life.BUT and this is a big BUT, always remember how you suffered so give the next guy the break that you didn't get.
