Got my first speeding ticket. anything i can do?
Posted by: Speedster ()

so i got a speeding ticket, 57 in a 35, i didnt get charged with a reckless so the cop says. when i speed generally 5 or 10 over the limit. is it possible to fight the ticket? i was thinking if i took a driver improvement course and show the court that i took it that they would waive the ticket, would this be possible? is there any other ways that i could get the ticket waived?

Can't help you when it comes to fighting the ticket. What I can tell you is that your ticket is going to be $196

$6 per mile over (22*6)= $132
court fees = $64

Take the drivers improvement class to remove points from your license. I would not go to court if I were you, the judge is just as likely to increase the fine, since it seems like you were going quite fast in (I assume) a residential area. Also, it seems likely that you were going faster than 57, and the officer reduced the speed on your ticket to a more reasonable level.

Had a similar thing happen to me. Like curious said, take the driver improvement class. It'll give you 5 good driver points toward your license, so at worst if you're convicted you'll just go back down to 0 and break even. Are you a minor? My parents nailed me with punishments when I got my first ticket at 16, so much so that the judge laughed, said that's more than he would've done to his own kid, then dismissed it. Even if you're over 18, if you take the class, and since this is your first ticket, it might get dismissed. As long as you take the driver improvement class prior to your court date, it's definitely worth giving it shot.

Oh, and don't goddamn take the driver improvement course. That shit is for suckers.

One ticket won't impact your insurance unless you're using shit insurance. It also won't cause you to lose your license.

Also, if you take the class and then you get a second ticket, the judge will probably anal rape you for being a repeat fuck moron criminal.

The Solution 2-
wrong. just....wrong
a regular speeding ticket won't raise insurance, but 22 over? good chance. even if that doesn't raise insurance, if that gets completely dismissed then it's like no ticket ever happened. if the driver gets a 2nd ticket, then the judge for the 2nd case has no way of knowing a first ticket was issued at an earlier time--it was dismissed.

you won't lose your license for a speeding ticket. true.

and fyi, i've had 5 tickets in VA in 4 years. yeah, i know, a lot, but whatever. i've only been convicted of 2--hell, in Bristol VA a legit reckless ticket was completely dismissed because they were so impressed that i'd taken the driver improvement class prior. this was after i'd already taken driver improvement 4 times for other tickets.

how many times you take driver improvement is irrelevant to the judge. that's not even done through the courts, it's done and points are issued through the DMV.

Slow the hell down! Seriously, not to beat you to death over it, but you need to chill with that speed.

Take the class- it can't hurt. You are not likely to get it thrown out, but you may get it reduced. It depends on how bad you want it reduced. You are much more likely to get it reduced- I had one reduced to failure to obey a highway sign or some crap like that- if you have a lawyer.

This type ticket can increase your insurance rates especially if you are a young male. I went through that which is why it was worth it to me to hire a lawyer for the next ticket.

The slow down advice is the best advice. That's what I eventually did.

If the ticket is not marked as reckless, it is still just a "regular" speeding ticket.

This tard could take the driver improvement course 500 times and it wouldn't get dismissed because it's common knowledge that speeding is illegal.

You just contradicted yourself. You can't say that it was the cause of your reckless ticket being dismissed and then say that it's irrelevant to the judge.

The Solution 3-
read carefully. if you go to driver improvement between being issued a citation and going to court for said citation, it helps your case. you provide proof to the court that you did this by showing them a certificate you receive upon completing the class.

Without this, the judge has no concrete proof in front of him that a driver improvement class was attended. Hence, unless you bring and show the judge all your certificates for other incidents (which wouldn't make sense), he has no way of knowing if you've been to any classes and how many.

Showing the judge the certificate proves you went to the class as a result of the citation. This looks good. The judge has no other way of knowing you've been to a class otherwise, so he has no idea that you've attended other classes.

also there's different classes of speeding citations in 5 mph increments. Not sure what the highest increment is, but his citation is probably "speeding 15-20 mph over posted limit" or something along those lines.

And yeah...speeding is illegal. good job. I'm sure the judges who dismissed 2 of my speeding tickets and my 1 reckless ticket were plenty aware of that, as was I. The whole case for getting a speeding ticket dismissed is based around showing and proving remorse for the citation and taking steps to resolve it prior to court, and hoping the judge isn't having a bad day.

Pay the fine and consider yourself lucky.

That's what I did, with a speeding ticket @ 57/25, 17 days after getting my learner's permit...

Awhile back (10 years ago?) I got my first ticket - going over 55 on 28 north. When first stopped the (young-looking) officer said he had clocked me going something like 75. I looked at him in total disbelief and replied "over 75!?" and pretty much nothing else - the car I was driving would have shaken itself apart at that speed - and would have to be going downhill to get there; somewhat later I figured he had "clocked" me by simply driving behind me with his lights off while looking at his speedometer. Anyway, he came back from his car a bit later and said he was charging me with exceeding 55 or something equally valid (in reality, I was probably going about 60-ish based on where the stop occured). Later on I looked up the points/fines and found it didn't really matter WHAT he charged me with - they were all the same as far as points/fine!

I got my second ticket about 5 years ago (mind you, that's 2nd ticket in like 40 years of driving) when I pulled a u-turn at a construction entrance - my "bad" was that I had crossed a solid double line to make the u-turn. Charged with "failure to stay right". Turns out that's "reckless driving" (as is illegal u-turn, BTW). Still in the traffic thingee up above as "reckless driving". BTW, crossing that solid double line is illegal even if you're a home owner entering your driveway - like across the street from St. Timpothy's CHurch, for example:

wipe your ass with it, get a big dollop of your shit on it, and stick it in an envelope and mail it to the judge.

The Judge will know you have taken the Driver Course because if you let DMV know to help your point situation out, the Driving Record will say Driver Course and the date and wether the course was ordered by DMV or not. If your record is good, you will want to bring a certified copy of your driving record from DMV showing your history and point balance. The best point balance you can have is +5 and most speeding tickets are 3-5points, RD's are 6points. When you take the driving course, you get +5 but the points only matter if your in the negative. if your at -3 and you take the course, your record will now be at 0 point balance. If you drive from 1/1/11-12/31/11 without any violations, you will get +1 point on your record for a max of +5 even after 40years of good driving.

Take the course on your own, it shows good iniative and you are takinbg the correct steps to rectify your lapse in judgement while operating a motor vehicle.

If the judge allows you to take a driver improvement class, you must return to the courthouse with a copy of the certificate by a certain date. At least in PW county it's that way. I got nabbed about 7 years ago on a failing to merge properly (the lane turned into a turning lane). Being that it happened in Manassas, I had never travelled that road before and didn't know. Plus it was rush hour and nobody was letting me over anyway.

Since until then I had a perfect driving record, the cop told me to come to court and see if I could get the charges dropped (he only charged me because he got the guy behind me doing the same thing, but he couldn't let me go and not him). I went to court and in exchange for a one day course, I would have the charge droppped and would only pay the court fees, but I had to return to the clerk's office within a set number of days with a certificate as proof, or they would institute a full conviction and send me a bill.

Today I got pulled over for going 55 on a 40. The cop said I can either go to court with a parent then they would assign me the classes or pay the fine. I am 17 years old and this is my first ticket, what should I do? Also how much dooes these driver improvement classes cost?

There is always a chance the officer dodon'not show up in court for one lame reason or the other and the case gets dismissed. Unless it is a more serious offense like reckless driving (19+ over the limit) the judge will not impose another future court date and dismiss the ticket.
Unless, of course, you are a rich person and can afford the higher insurance rates for years to come.
Best thing either way, you know, is to slow down.
Speed kills. Injures. Cripples people. Leave early for your destination and don't let the jerks out there on the roads stress you into driving like them. Take it easy and be 'The Low Rider'!
The most famous thing the jerks do is tailgateyouinto speeding like they do. Beep their horns if you don't go over the speed limit like they do and then you get the ticket cause the cop catches you up in front of them speeding and not them on the radar! Typical backstabbing bullshit tricks the jerkoffs pull out on the roads regularly.

Try to get pulled over for doing 35 in a 70 zone.
-$6 per mile under (35*-6)= -$210.
Your account will be wiped, and VA willeven owe you some money!!
