Charges for Tinted Windows Dropped?
Posted by: Bob James ()

At the risk of making a worm hole in the time continuum, I wonder if anyone has had charges dropped for having tinted car windows that violated Commonwealth code? There are a number of conditions, to include a doctor's statement, that allows one to have tinted car windows. Aside from a medical reason, has anyone ever challenged the device used by authorities to measure the light transmission--or, otherwise, discovered a legal means to avoid the misdemeanor and/or having the film removed?

You won't get the charges dropped. Tinted windows are for thugs, grow up.

Loser.

Me too, lol. It such a lamer subject that I never really heard anything about, but in here it's like serious business. I've started to openly joke about it in my social circles and people from around here really know what I'm talking about.

According to the Fairfax Underground data base, 8,249 tinted window offenses are listed (from Abbott to Zimmerman). I am against the opaque tints that exceed the safety specifications of the Commonwealth--it's a safety issue for the driver as well as for the police. My curiosity was piqued by an offense which was for the lighter tint and did not meet the measuring device. I am curious about the device and its calibration or accuracy. This topic seems to be popular because it quite literally has involved thousands of drivers in Fairfax County.

Someone needs to declare a State of Emergency. Thousands of drivers are affected. This could have a serious impact on the tinting needs of future generations. The time for action is NOW.

I suppose you could always challenge the device as this guy did with the Breathalyzer (actually the Intoxilyzer 5000EN - he asked for source code and was denied. Upper court ruled they had to turn over the source code):

YMMV. Big question is, what do you do with the source code/schematics once they give them to you?

look for flaws in it's design or software to discredit it's accuracy.

Hire an expert witness and a lawyer. $10k later, you might have a chance to win your case. -§

I dont get why you guys think tinted windows are for "thugs" They do a great job of keeping the heat out of your car in the summer. I know since I got mine tinted, I no longer get into my car after being parked out in the sun, and feel like I just stepped into an oven. I have all my windows tinted at 20% and never had a problem with the cops.
