Suspended License Question

Ok so in March of this year I got charged with possession of alcohol and marijuana, and had my permit suspended for 12 months. I was still 17 at the time.

I am now 18, and my mom and I went to the DMV a couple of days ago to get me a state ID card because they took my actual permit in court.

When we talked to the lady working, she said they had no record of any suspension and that the court had never contacted them, and because of this, they cannot issue me a state ID card.

She said she could reissue me a new copy of my permit, but my mom was hesitant at the idea and said no.

So what steps should i take to get this resolved?

Should I go and get my permit reissued? And if so can I take the test and get my actual license and be able to drive?

With the DMV's current average, it should take TEN (10) years to resolve this matter.

Do you think it would be a bad idea though to go get my license and drive?
Or should i wait til next march when my "suspension" is suppose to end?

Thanks for the response, and i believe i have the papers somewhere so I will try to find them if not I will contact them.

was it my responsibility to bring these in the first place, or did the court mess up and forget to do it?

Wait, what? You don't even have a DL yet, and you've already managed to accrue a suspension?

Also, seconding what the Chuck said, don't even dare attempt to circumvent the court order. You will end up in jail if you keep along with this line of behavior.

I went through something like this years ago. The court took my license for a DUI conviction, I went to DMV to get an ID card because you are supposed to have some form of ID. DMV would not issue me an ID card until I turned in my license. I told them the court took it, the judge asked if I had my license on me and I pulled out my wallet and handed the license to the bailiff who handed it to the judge. So the court took it and I can't hand it in to DMV, DMV won't issue an ID without me returning my license, I have no form of ID at this point because I had not yet applied for a passport. I had to get my lawyer involved and she had to call Richmond to resolve the issue.

Lessons learned:

ALWAYS smoke/possess your pot in your home. NEVER take it with you outside of your home no matter what.

NEVER drink and drive, or try and get caught.

Next time don't take your mother with you.

Go to the DMV and re apply for an ID. Listen to the lady at the counter, do what she says.

IF the DMV must issue a drivers license instead of an ID, then take it. If you believe your right to drive is under suspention till next March, then by all means DO NOT DRIVE.

Also, after you get your license, go back after a few weeks and get a copy of your driving yecord for a couple of bucks. You may even be able to get it on line now.
