Per nbc news 4, home invasion/murder sometime after 10 pm

NBC news just said something about a break-in/murder... soooo perhaps burglar decided to break in, encountered someone and in surprise shot him... that is just what I feel is the more likely situation.. could be anything.

this was definately a targeted attack, that neighborhood is quiet, and the neighborhood watch is always around, and everyone knows each other. its a family orientated neighborhood, robberies never happen in that area. but this murder sounds like someone could've been involved through inside, waiting for more updates.

Any updates? The Sydenstricker/Fieldmaster area is usually a fairly quiet, low crime area.

How did the the assailant know the resident?

Police have charged David Patton, 44, 9140 Conservation Way, with murder. It appears the victim and suspect were known to each other.

A neighborhood dispute over a new traffic speed hump that apparently led to a June fistfight allegedly led a Fairfax County man to invade his neighbor's home and shoot him to death Sunday night, Fairfax police said.

Stephen A. Carr, 48, lived in the 6800 block of Field Master Drive in the Burke area. He frequently expressed concern about traffic speeding through his quiet neighborhood, in part to cut through to the Fairfax County Parkway.

So Carr, working through County Supervisor Pat Herrity's office, had a speed bump installed almost in front of his house.

So I guess that Patton found a way to avoid the speed hump! You know that this is going to get reduced/tossed on some sort of mental health grounds. What sane and rational person breaks into a neighbor's house, ties up the occupants and kills them? I want to see how Patton's defense attorney argues this case.

The article said his court date is this Tuesday. He was probably sitting in his chair thinking about his court date coming up and just lost his cool, then I guess he walked over there and killed him.. seems like a typical 2nd degree blind rage homicide to me.

OR perhaps he thought this out and planned on killing him to get the case thrown out as he is the primary witness obviously... however that's 1st degree and not 2nd, and I believe blind rage is the likely situation.

Any sane man can still feel the need to enact revenge.

Assuming no prior arrests/convictions, what is the penalty for misdemeanor assault? A short suspended sentence plus probation? Doesn't exactly seem like a reasonable trade to me, but maybe he thought that being in state prison was better than the ADC.

Neighborhood watch is usually out? I have never seen s neighborhood watch anywhere ever. All I see is the signs.

if your using fieldmaster to cut to the parkway your an idiot. Spur is right up the hill and it cuts to huntsman which goes to the parkway, and even then it only cuts maybe 90 seconds off your trip.

How unbalanced do you have to be to have a speed bump tip you over into being an insane murderer? Did these two guys have any prior history other than a speed hump?

We got a guy in our neighborhood that honks everytime he goes over one - do I dial 911 on him?

Well, it's more than that he went over there just to kill them. From the affidavit, it appears that the killing part was specifically in relation to a violent confrontation. It's not clear he went over there intending to kill. Even the cops don't know, which is why he was charged with Murder 2, not Murder 1. Not (yet) any evidence of malice aforethought.

He may not have gone over there with intent to kill, but he did go there armed and with zip-ties. Again, what did he want to accomplish here? It makes no sense.

Who knows? We're talking about someone who clearly doesn't think like you or I. The fact is we don't know what he wanted to do, and even the cops don't know what he wanted to do, or if they do, they don't think he went over there with the intent to kill.

The only reason WE can come up with was that he intended to kill them. That only means it's all we can come up with. It doesn't mean that's the only possible reason.

I bet there will be some kind of insanity defense.

No, that's not all I can think of. Maybe he wanted to scare him or something. I think you might be misunderstanding me. I think we are dealing with an unstable individual here, I want to know his logic. Even if he did in fact go over there with the express intention to kill, what did he think would happen then, the speed bump would go away? If this wasn't all about the speed bump, what was it about? How, in his mind, do these actions turn out well? To me, thinking to myself, "I'm going to go to my neighbor's house armed and tie him up" in no way turns out good. Or did he not even think that far ahead?

They're notoriously difficult to get away with. If he was a productive member of society before the incident, it would be incredibly difficult to prove. Insanity requires you prove he is insane.

That said, I'm SURE there's something not right about this guy. Just a complete overreaction. I just doubt it absolves him of guilt for his actions.

FYI, at this point, death penalty is not an option for this crime. (Murder 2, max sentence 40 years in prison)

What's going on now? Sept 26, 12:46pm police helicopters overhead in the same area as they were with the speedbump thing, and lots of police cars headed west on Braddock Rd. when I came home about midnight.
