Petition to Repeal Excessive Traffic Fines
Posted by: MH ()
Date: July 12, 2007 10:03AM

Sorry if this is a dupe. Found it on another forum and now I'm spreading the word to any other large forums with "Virginia area" boards:

http://www.petitiononline.com/va3202/petition.html

Petition is as follows:

----------------------------

To: Elected Officials in the Commonwealth of Virginia

We, the citizens of Virginia, are opposed to the outrageous and unjust traffic fines imposed as "civil remedial fees" in House Bill 3202 for the following reasons:

1. The fines inflict a punishment on drivers that is disproportionate to the degree of the offense they committed.
2. The fines are mandatory, and judges are given no discretion in sentencing.
3. The language of the bill states that the purpose is to "generate revenue" and hence the fines have nothing to do with traffic safety.
4. The bill's sponsor, Del. David Albo (R- 42nd District) is a partner in a law firm that specializes in traffic court cases and stands to benefit personally from this legislation. This type of conflict of interest should not be tolerated.
5. The fines in the bill apply ONLY to Virginia residents, hence unfairly creating different penalties for the same traffic offense based solely on residency.
6. In order to generate additional revenue, points for driving offenses remain on the offender's license for up to 11 years. This will unnecessarily increase the offender's insurance rates for a time frame that is incongruent with the degree of the offense.

We, the undersigned, demand the immediate repeal of these "civil remedial fees." We will not vote for any state Delegate or State Senator who voted for this bill, or for any Delegate or Senator who does not take action to repeal the sections of House Bill 3202 that inflict these exorbitant and unjust penalties.

Sincerely,

The Undersigned

Those online petitions always have a lot of effect on government policy.

By "a lot" I mean "none at all".

Letters to your representative are still the best way to pressure legal change, outside of becoming directly involved in politics. Those retards are stuck in the 1860's.

seriously.. its cool to be down with a cause, but signing your name at petitiononline.com is nothing more than a waste of time.. if somebody can sign it at one computer, and move to another (or maybe even stay at the same) and then sign again - then why on earth would anyone take the petition serious...

One of us really needs to step up and get into politics.. or atleast find somebody already in, and have them frequent this site to keep up with "what the people want"..

Umm... let's not knock "online" as the cause here because some "want to be a programmer" throws something up on the web. Actually an online petition would be far superior to a "clipboard\handwritten signature" petition if done correctly.

What's to stop somebody from signing a false name on a paper petition? If somebody jams a clipboard in front of people at the grocery store, who's to say that their not going to sign "John Smith" and walk away.(No offense to the John Smith's)

Online, when done correctly, you can have a variety of tracking and validation schemes.

i never said paper was better... and i wasnt knocking online petitions.. i was knocking petitiononline.com

(i was going to type something like this but didnt feel like it): but if somebody wanted to make a petition site where you have to register, put in something like a SSN to verify that your legit.. then it could work... but then who really likes giving their SSN to websites when its not something you know for a fact is legit (banks, insurance, etc)...

Hey hey hey........ take it easy there Lurker.

I speak (type actually) on behalf of all John Smiths and I resent that you insulated that "John Smith" is a made up name! You could have used "Meade Skeleton," we all know that is a fictional character!

Lurker, I have no doubt those scientific methodologies exist. I think the greater hurdle is that these online petitions follow no legal procedure that I am aware of, and therefore, are nothing more than an e-mail to someone with a bunch of names on it.

Yeah, I'm not sure what the "legals" are on a petition or how much pull they have in general.

First time I read that I thought you typed "Farking on the lawn"!

I don't know what message that would get across, but it is not listed on list of offenses that have additional cost!

SRE - I don't think a "message" is the point...it's just easier for the owners of the home to clean up PLUS it airates the lawn at the same time.

I guess you could say it is a "GREEN" alternative, but the argument to that would be the use of the PLASTIC forks. The answer - the folks who got forked, fork someone else using the same utensils ...and so on and so on...

by far the best thing to do is to pour weed killer on his lawn so it spells I AM GAY

since he is/will soon be getting rich, he will just buy a new lawn.

Then someone else puts fertilizer on the lawn so that is says a similar message (since new lawns always die right away the fertilized protion will be ok)

edit: it would be easier to do that since its probly a lot faster then forkin the lawn.

plus when the kid will get made fun of at school- an added plus.

Well I typed in 6367 Rolling Mill Pl., Springfield, VA 22152 into Livesearch and I got a parking lot, so forking it might not work.

As for "being green" with the forks. He can use them at his next fund raiser.

Maybe just print up signs and put them at polling places to remind voters and give a write in candidates name.

As for the weed killer idea, not a "broadleaf weed killer."

True. But it does make the news (and keep the story in the news)...and the media does have an effect on government policy.

It would be interesting to see (if there is a special session), how many who voted yes, will change their position because they:

1. took the time to actually READ what they "support"
2. cave to political pressuer (re-election fears)
3. do the right thing for Virginians
4. all the above

Now if the tax of .40 on every $100 dollars from the sale of your home would be "reassessed," VA residents may be ok! I don't get why I will have to pay the state of Va $2000 just because I sold my home. I currently pay the annual property tax of approximately $3500/year and if I sell my home, I will have to pay the capital gains tax on any profit I may make if I do not re-invest in property immediately.

Does the $2000 get deducted from the profit or will I have to pay again on April 15th for that too?

Fuck waiting for January! Call a special session NOW, you assholes!

GOP in Virginia. Heh. They will be as extinct as T-Rexes by November 2008 if they don't do something about this bullshit NOW.

$2,000 bucks on a 500K home sale payable to northern va, just for the privledge of selling your home to get the hell out of here.

Ranks right up there with the fairfax tax on cell phones. They have nothing to do with the cell phones except you happen to live in the county and you pay extra on your bill.

since when has any representative done anything because they wanted to "do the right thing" much less doing it for virginians?

Easy Gravis, one could construe your comments to be a Felony...

§ 18.2-83. Threats to bomb or damage buildings or means of transportation; false information as to danger to such buildings, etc.; punishment; venue.

A. Any person (a) who makes and communicates to another by any means any threat to bomb, burn, destroy or in any manner damage any place of assembly, building or other structure, or any means of transportation, or (b) who communicates to another, by any means, information, knowing the same to be false, as to the existence of any peril of bombing, burning, destruction or damage to any such place of assembly, building or other structure, or any means of transportation, shall be guilty of a Class 5 felony; provided, however, that if such person be under fifteen years of age, he shall be guilty of a Class 1 misdemeanor.

B. A violation of this section may be prosecuted either in the jurisdiction from which the communication was made or in the jurisdiction where the communication was received.

(Code 1950, §§ 18.1-78.1 through 18.2-78.4; 1960, c. 358; 1975, cc. 14, 15; 1982, c. 502.)

The cap gains rules have changed a lot, Tia.

Basically, there's no cap gain tax if your profit is under $250K (500K for married couple). You do not have to re-invest. (applies to your principal residence only, not investment properties, etc)

pff... i never said i would or that someone should. the only thing i pointed out was that their ideas sucked. it's not a threat, it's an idea and ideas are not illegal. if "one" thought my idea was a threat, then "one" should put a bullet in their own head. OMG I JUST THREATENED TO HAVE THEM PUT A BULLET IN THEIR OWN HEAD!... oh wait... that doesnt make any sense.

That's my problem duh...I am anticipating and very hopeful that my profit will be well over 250,000...
