The short answer is you likely are legally required to obtain a business license in Fairfax County and pay BPOL regardless of the state where your business is organized. There are certain exceptions.

I suspect the question you are asking isn't whether you are legally required, but whether you can get away with it. Do you have a physical office located outside your home? Do customers come to your office? Do you do business with government entities? Do you have employees? Does your business ever sue people or get sued? Is there the potential for a divorce? There are lots of ways to get caught.
