OMG! I hope I don't get in trouble since I was the one to mention it. But it is public record and I felt it had a bearing on the accident. It just seems kinda weird that some rum dum citizen like me mentioned it first here instead of some journalist. They have access to much more info than we do.

I just got home from work and my husband told me about it.

Now I am positive he press monitors this site. You guys better stop talking about bad stuff and no more swearing either!!!!!
Should I get some Botox just in case I get interviewed by channel 4????

Whether or not it had a bearing on the accident, it is the truth and the truth is 100% defense against libel or slander.

There was no intent and or malice, I do not believe you twisted the facts and came to a wrong conclussion. Simply repeating a matter of public record is perfectly legal.

lol. I don't think anyone will have to change usernames or be threatened by large groups of people this time around. But it is funny that in both cases a posting from the arrest list caused a fuss. But this time an anon poster posted the finding... probably smart as RESton Peace can attest to. And in both cases this site takes a break from general flaming back and forth and becomes a tribute posting site for a few weeks.

Yes I know!!! Now I have to confess to my husband that I hang out here! he will recognize the name. Well it's not my name but our cat who died at age 21 about ten years ago. That's why I thought I might run out and get some face work (ie Botox, eye lift, retin A) just in case the media comes calling! Luckily I just got some nice highlights so my hair looks good.
Oh and Radiophile, thanks for the definition of "libel." I majored in journalism in college but that was way back in the 60's and I forgot everything I learned. It's been too long.

I'm very impressed with the NBC4 news team for both following up on a lead from an unconventional source (Thackston's arrest record on this site) and for citing their sources. Most mainstream news outlets wouldn't bother investigating something found on the internet and even if they did surely they wouldn't give any credit to a non-commercial news source.

Bravo NBC4 for the respectable journalism!

Digging through the traffic stats there is a noticeable spike in activity that started just after the segment was aired. This spike was nowhere near the level generated during the Don & Mike show incident, likely because NBC4 never actually said "Fairfax Underground" on the air, whereas Don did.

Still, traffic for the 6:00pm hour was up 225% from the June average and Google searches strictly for "Fairfax Underground" totaled 187 yesterday, up from a daily average of 75.

Today traffic is still up an average of 33% with 106 searches thus far for "Fairfax Underground" on google.

and the part mentioning Fairfax Underground: "The information has fueled an emotionally charged debate on a Fairfax County online forum -- with some writers critical of the girls and the driver." hmm, the same fourm where ya got the info that the driver had a previous DWI?

the reporter specifically says that there will be a closer look at the online debate over the accident "coming up on News4 at six" which would have been on Monday?. can we find that report?

Thanks for the kudos, Trickie, but to clarify, I am not a lawyer nor have I ever claimed to be. The true definition of slander, libel, and malice can be found at many websites or certain books. What I gave was a general rule of thumb - if it is the truth (bonus if it is public record) you have nothing to worry about.

If for instance you repeated the charge and posted she was found guilty, and if in fact she was found innocent because the cop was in reality trying to date her and got his revenge by charging her with DWI, then you may be responsible for your actions. But if what you said was the truth and you did not add a lot of un-truths to it, then you are fine.

Not a sermon, just a thought.

Most journalists, especially in television, are vapid and lazy (you can quote that, Channel 4). That's why they cover blogs now, so that they don't actually have to investigate anything themselves.
