is it illegal for Asian restaurant not to hire me because I'm not Asian? (they couldn't fill the job in 2 months... nobody else came to apply for the waiter position.... I know the chef there and she told me the owner who happens to be Asian, does not ever hire non-Asians to be waiters. By "non-Asians" I mean whites/blacks/Hispanics/Indians/Pakistanis)

You can't discriminate against the following when hiring:
age
race
gender
sexual orientation
ethnic background
physical disability (as long as it won't have an impact on your daily routine)
There are rare exceptions to the race/ethnic background rule like hiring an actor for a specific part, theme restaurant or a place that needs historical accuracy like Williamsburg. If the chef is willing to back you up, you might have a discrimination case against them if its all true.

Yeah good luck. If they claim part of the job requirements are to speak "Asian", and you don't, forget about it.
Also, the can claim they are exempt from EEOC guidelines: The term “employer” means a person engaged in an industry affecting commerce who has fifteen or more employees for each working day in each of twenty or more calendar weeks in the current or preceding calendar year....
VA may have a different EEOC typse laws - but trust me you loose

Just threaten the EEOC action. That will wake them up.
The language requirement is rubbish. I have been in Japanese restaurants run by Koreans who don't speak a word of Japanese.

What do you want out of this? You are going to have a hard time proving discrimination. The owner could have decided not to hire you for a multitude of reasons. It would cost you more money than it is worth to pursue this civilly.

A business has the right to fire or hire you , or not for any reason other than..

All this knowledge of the law and EEOC, etc etc, but no knowledge that "Asian" isn't a language.

I know of a restaurant in Manassas that will not hire you because you are not from the country of origin due to the knowledge of culture and their foods. I guess sometime you have to really know what the food and culture is all about.
