does anyone know what khat is ...or the green leafs from east africa or what crime you will be charged if you are in a car that khat was in and the police found but no one said it was theirs including the owner of the car.thanc

khat is a schedule 1 drug. You can be charged, I'm sure, on par with other schedule 1 drugs.

I've never been offered it before, I've known about it for years but it's rare around here.

what if it is not yours but the police found it in the car that you were in ...and no claimed it ..and its not your car you are just passenger.

That is the old "constructive possession" argument. Basically, you can be charged if you are in approximate possession of any drug in a car, and it is up to your lawyer to explain to the trier of fact why it is not yours.

There would have to be clear indication that the owner of the substance was the only one that knew the substance was in the vehicle. If multiple people know the drug is in the car, than they are all in possession of it (unless it is in someone's physical possession).
