Need some DMV advice

My wife's VA driver's license expired recently. She went to renew and they would not do so because her birth certificate was a photo copy. She was born in Vietnam (father was a US soldier, mother was Vietnamese). She moved to the US as a toddler and at some point the birth cert was lost as she was moved through the foster system. Her father has since passed away and she has no contact with her bio mom. Her foster parents don't have the original birth cert.

So, what does one do with no original documents and in turn get their license renewed that they've had for some 25 years?

That's the problem, it's a Vietnam hospital that has been no help.

CHRIST ALMIGHTY, of course I went to the dmv site and looked at that very document. We don't have any of the primary documents other than the expired license, only a photocopy of the birth cert as I clearly mentioned. THAT IS THE PROBLEM...it's not original.

From the above document

How recently had it expired? Over a year? It also appears that even if she had her Vietnamese birth certificate she'd be SOL.

I was thinking exactly the same thing. She must have some legal document: green card, naturalization certificate, etc unless she is hanging around Herndon 7-11 looking for day work.

It's only been expired for a little more than a month. An expired license less than a year appears to be a valid proof of identity but the problem comes in the the proof of presence the DMV said she needed (that is where the birth cert is needed). Maybe this is just a simple fact of the DMV employee not wanting to do anything or not know what to do. Although the manager became involved and said they couldn't do anything without the actual birth cert.

call your local rep. state or federal, tell them what is happening. they can call the DMV, when the managment gets a call from the local or federal government they are willing to at least recognize your problem and work with you. a friend had a similar problem, though they were not forign born, a call to their rep. got a licence for a few months. once it expired all the tests had to be retaken, even the road portion. just an idea, good luck.

How can I obtain for my birth certificate? In case, I cannot obtain my birth certificate, what can I do?

Individuals born in Vietnam who need new copies of their Vietnamese birth certificates need to contact the office of the People's Committee of the district where they were born: the district where their mother was then resident according to her Ho Khau. The district People's Committee can issue certified copies of a birth certificate (Ban Sao) based on their records of the original birth certificate. Alternatively, the office may provide an Extract (Trich Luc) of the information in the birth record on file in their office.

If you are not able to obtain a birth certificate because records have been destroyed or the government will not issue one, you must obtain a statement to that effect from the civil registrar’s office and submit secondary evidence of birth. Secondary evidence of birth can be old family household registrations, school records, or baptismal certificates.


How can I apply the Police Certificate (Ly lich Tu Phap)? Can your office assist me in this matter?

If you live in Ho Chi Minh City, you may contact the Justice Department at 143 Pasteur St, Dist 1, Ho Chi Minh City, Vietnam. The telephone is 848-829 7052/ 848-822 3276. It is our understanding that a friend or relative may request the Police Certificate (Ly Lich Tu Phap) on your behalf. This can also be done at the local Department of Justice office of your last residence in Vietnam.

Does the DMV issue temporary licenses? We're having a helluva time proving "legal prescence" and in the meantime she hasn't been driving because of the expired license. We can get the necessary docs through the State Department but it takes 4-8 weeks and I refuse to be a chaeffuer (sp) for much longer.

The DMV is now closed so I can't call and ask. I do see mention of a "limted duration license" on the site but I don't think it applies to my wife. I find it hard to believe she can't drive because of a documentation problem after she's been a VA driver for close to 25 years.

Try going to a different DMV. Some are more lax than others. As an example, I went to the Tysons Corner DMV to upgrade my class b CDL to a class A. They would not do it because I had my Class A learner's permit for less than 30 days. I argued with them forever and they would not budge on the issue. So, I said F*** It, and went down to the Warrenton location the next day. They gave me what I needed, no questions asked.

That's true, I've noticed that the fair oaks dmv is lax on things others are not (like sterling park and the on in Westfields)

an example at those places would be identification burden. The screening guy at the westfields location will triple-check every personal document before he even gives you a number to wait for a cashier. He will cut no slack on small details of documents. He once refused my birth record because the state seal was no longer raised. I took the same records to fair oaks and was out in no time flat.

The supervisor Julie and fair oaks DMV is insane
Refusing on September 23 2011 to accept the form filled out mailed to me by the DMV about verify insurance from 2008
Instead she gave me a blank page of paper demanded I write on it
I refused and told her please give me copy of form competed and mailed to me by DMV so that I may follow what it is asking me to do
She flat our refused began to tell at me
Threaten to call police on me
Told me I don't look disabled to her I look fine
Then told security to get her out of her
I told her she was violating federal disabilities act of 1991
She did it intentionally
Causing my drivers license to be suspended when I have always had auto insurance the insurance companies lie
I am city mail carrier USPS 27 years
Injured returning to work her actions stopped me going back to work
Insurance on my Suv has nothing to so with my ability to drive a USPS mail truck
I was refused service I was publicly humiliated
Inconvenienced until it Made me sick by her verbal abuse in public
Knowing I was disabled telling her stop I can't do what she says when she says her way
She is crazy
Then I went back November 1 to get a state issued ID card
The old man at front desk refused to give me forms to sit down and fill out
No matter what proof of ID I shows said no birth certificate !
I just renewed my drivers license in may for 50th birthday
Showing birth certificate , marriage license from 1982 divorced !!
I showed federal government ID
They keep asking for a passport
The old man yelled at me to we can't use that
Don't they keep anything on record why is the paper work from DMV good enough?
The old drivers license and If not why do they let you keep it now they did not oh the past
I was born in Detroit Michigan Virginia resident since 1996
Why are they asking me for passport like I am from another country
They seem retarded to me
Badly behaved old people zero social skills
Petty tyrants think they have an ounce of power so want to abuse it against disabled woman in public humiliating them
Now that they won't let me keep or get state iD
My bank questions who I am?
Why are the insurance companies believed they lie
Federal government employees USPS don't my job won't let me
Why is the bank and insurance company who tax payees bailed out both playing games and Virginia DMV playing it with them??
