Court Closures due to Coronavirus

Are northern Virginia Courts closing to limit the spread of coronavius to homes, families, children, immune at risk folks, law enforcement, court staff & employees, attorneys, court reporters, interpreters, the elderly and anyone at risk?

Other courts and states are closing the courts. Richmond, Chesterfield, the state of Maryland and other jurisdictions have done so already. We have coronavirus issues in Northern Virginia and a huge population with other restrictions in place, closures, telework and prohibitions of crowds of folks getting together has been recommended. Why have our courts not also made decisions to protect the citizens of Northern Virginia and others from spreading Coronavirus?

Public Transportation will shut down by the end of the Week. If it doesn't our government will be liable many many lawsuits.


Our Government is demanding everyone practice Social Distancing. That is, stay in your Home. If you must go out stay six feet away from people.

Ever tried staying six feet away from people on a bus or a train?

Fairfax General District Court including Vienna are closed except for bond motions, criminal advisement and protective orders.

Fairfax Circuit Court civil jury trials have been suspended for the rest of the month. Civil bench trials and all other matters, including civil motions day and criminal matters will continue as scheduled with liberal continuances on a case by case basis.

Fairfax Commonwealth Attorneys office has announced policies for continuances in criminal matters.

Arlington County is a bit more complicated. General District Court criminal trials through March 31. Traffic cases through March 31 will be rescheduled.

I'm assuming you mean "traffic court" of non-dangerous traffic crimes is closed

Here is the latest from Fairfax General District and Juvenile & Domestic Relations District Courts:

Fairfax Juvenile & Domestic Relations District Court:

These policies and procedures are effective as of 11:59 p.m. on March 16, 2020 and continue through at least May 10, 2020. Among other things, they provide that:
1. The Court's non-case related events (including all operator license ceremonies, school court tours, and intern and volunteer programs) are suspended.

2. All traffic hearings, and criminal trials and sentencing hearings for defendants not held in custody, are suspended.

3. Criminal motions are limited to bond (including motions to modify or revoke bond), continuance, detention review, discovery (in cases in which the defendant is held in custody), and emergency motions only.

4. Except for show cause rule hearings for respondents held in custody (which shall be continued), all custody, visitation, and support status hearings and trials are suspended. Emergency motions, for cases in which relief is necessary to prevent imminent and substantial physical or psychological harm to a child, shall be heard as usual.

5. Wednesday Motions dockets are suspended. Except as otherwise stated in the policies and procedures, the Clerk of Court shall continue all other pending motions to the scheduled trial date.
Changes in GDC Schedule
In response to Governor Northam's prohibition of gatherings of large numbers of individuals, the Fairfax City and Fairfax County General District Courts - all divisions, including the Towns of Vienna and Herndon - will not be holding regular court hearings through April 17, 2020, EXCEPT FOR THE FOLLOWING:
• 8:30 AM Bond Motions
• 8:30 AM Video Advisements
• 9:30 AM Motions Court
• 9:30 AM Information On Attorney court
• 9:30 and 10:30 AM Arraignment Courts
• 10:45 AM Mental Health Specialty Docket
• 1:30 PM Protective Order Court
The following regular court hearings will be held for incarcerated defendants only:
• 9:30 AM Criminal and Traffic Court
• 9:45 AM Supervised Released Violations Court
• 2:00 PM Preliminary Hearing Court
• 2:00 PM Sentencing and Non-Comp Courts
Court hearings in Fairfax County General District Court for the next 30 days will be continued by the clerk's office as follows:

Civil Hearings:
• All Monday - Thursday dockets will be continued out 4 weeks on the same day of the week
• All Friday dockets will be continued out 4 weeks on a Friday court date
• Long Trials scheduled within the next 30 days will be continued to another Long Trial court date
Please be aware of the following procedures in the clerk's Civil office:
• Emergency and/or time sensitive motions can be filed and will be heard daily in Civil Court.
• The clerk's office is not issuing any filed Writs of Eviction for the next 30 days.
• The clerk's office is asking all new cases befiled with a return date no earlier than 8 weeks from the date of filing. Private Process is encouraged to avoid the 60-day service rule.
• Motions for emergency exceptions to the above procedures may be filed.
Traffic Hearings:
• Hearings will be continued to the officer's next court date beginning with June 2020 court dates
o Heavy filers will be continued to a Friday or other no-court date at least 60 days out
• Blood Docket trials through end of April 2020 will be continued to Blood Docket dates beginning in May 2020
• Non-Comp hearings will be continued 2 months out to the judges' next Non-Comp dates
Please be aware of the following procedures in the clerk's Traffic office:
• Emergency and time sensitive motions can be filed and will be heard daily in Traffic Court.
• Motions for emergency exceptions to the above procedures may be filed.
Criminal Hearings:
• Hearings will be continued to the officer's next court date beginning with June 2020 court dates
• Preliminary hearings will be continued 60 days and beyond for defendants not in custody
• All new felonies will be set no earlier than 60 days out
• Sentencing hearings will be continued 2 months out to the judges' next Sentencing dates
Please be aware of the following procedures in the clerk's Criminal office:
• Emergency and time sensitive motions can be filed and will be heard daily in Criminal Court.
• Motions for emergency exceptions to the above procedures may be filed.
Through April 17th, hearings for incarcerated defendants on the Fairfax City, Town of Herndon and Town of Vienna dockets, and all motions, will be held in the Fairfax County courthouse, rather than in the City and Towns, at 9:30 am.

Supreme Court of Virginia Declares Judicial Emergency in Response to COVID-19

Effective March 16, 2020, the Supreme Court of Virginia has issued an Order and declared a judicial emergency for all district and circuit courts of the Commonwealth “to protect the health and safety of court employees, litigants, judges, and the general public.” The Order shall be in effect from March 16, 2020 to April 6, 2020.

If you have pending litigation matters, statute of limitations to file litigation matters, or other litigation-related matters, contact an attorney to consider how this Judicial Emergency impacts you or your business.

The Order provides, in relevant part, that Non-Essential, Non-Emergency court proceedings in all circuit and district courts are suspended and all deadlines are tolled and extended for a period of twenty-one (21) days and that all circuit and district courts shall implement the following measures, including continuing all civil, traffic and criminal matters, including jury trials, subject to a defendant’s right to a speedy trial, with the exception of emergency matters, including but not limited to, quarantine or isolation matters, arraignments, bail reviews, protective order cases, emergency child custody or protection cases, and civil commitment hearings. Judges may exercise their discretion with regard to proceeding with ongoing jury trials, and in cases where the defendant is incarcerated.”

Grand Jury met Monday 3/16. Meeting rooms were sanitized and there were enough empty seats to practice social distancing. Ample parking. Judge was very appreciative that we served.

the government now decides which cases "are essential" (meaning, you can be evicted, that's essential, but if you sue government that's "non-essential")

"essential cases go forward"

"non-essential cases" (cases that defend you from government) do not go forward
