Say It Ain't So Descano

Is it true that Commonwealth Descano hired the assistant commonwealth's attorney involved in the PW case who okayed getting a picture of a kid's erect penis to show the kid had been sexting his girlfriend? https://www.google.com/amp/s/www.washingtonpost.com/news/true-crime/wp/2017/12/06/detective-violated-law-when-searching-teen-in-sexting-case-federal-appeals-court-rules/%3foutputType=amp

A democrat that had inappropriate sexual contact with a minor? That's called building your resume to get hired by liberals.

Descano has his faults. His refusal to prosecute minor pot possession charges isn't one of them.

Upon petition, a circuit court may remove from office any elected officer or officer who has been appointed to fill an elective office, residing within the jurisdiction of the court:

Tell us how Democrats gun background checks stop gun crimes when Steve refuses to prosecute pot possession changes and put convictions into the NCIS to prevent them from buying a gun

You hate guns and you love weed , your a Democrat right screaming to stop gun crime with new laws that don't stop criminals and punish law abiding gun owners instead

https://www.novadefenders.com/possession-of-marijuana.html

"Understanding Possession of Marijuana Charges
Despite recent changes to the law in many states, possession of marijuana is still a criminal act in the Commonwealth of Virginia. On a first offense, a person can be sentenced to up to 30 days in jail and $500 dollars. Va Code 18.2-250.1. On a second or further offense, a person can get up to one year in jail and a fine of $2500! Now in reality, most judges will not give you any jail time at all for getting caught with a small joint or bag of weed (at least not the first time), but they WILL take away your driver's license for six months. Va Code 18.2-259.1. You will also have a criminal record from then on that will follow you around for the rest of your life.

Restricted License
The law says that if you are convicted (found guilty) by a court of almost any type of drug possession (including marijuana), you will automatically lose your driver's license for six months – in fact they will physically take it from you right there in court. The law also says that if a person's license is very important to them, a judge can authorize a restricted license. To get a restricted license you will have to file an application, which usually means handing the filled-out form to the judge on the day of court. Once the application is filled out and approved by the judge, you will usually be able to pick up a temporary version of the license the same day. You will then take that piece of paper to the DMV within a few weeks to get a hard copy of the new license."

I say Steve is neglecting his duty , misusing his office and showing incompetence in the performance of his duties

Will Steve let off DWI and reckless drivers next if that mirrors Fairfax's
"Community"

That is YOUR issue.

Every modern Fairfax County Commonwealth Attorney has made deliberate choices not just about whether to prosecute specific criminals but also about whether the prosecute certain types of crimes. Horan wasn't removed from office. Morrogh wasn't removed from office. The only difference between Descano and his immediate predecessors is that Descano told us up front which crimes he would not be prosecuting.

Now since you are so enamored with question 11e, look at the specific wording. It asks "Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance?" It does not ask "Are you now or have you ever been an user of pot?" It does not ask "Have you ever been convicted of using or possessing pot?" It speaks to a specific current status. Current use of pot in places where it is legal does not prevent someone from lawfully acquiring a firearm, nor does prior use of pot, even if it resulted in a misdemeanor conviction. It does however prevent someone from lawfully acquiring a firearm if he is currently unlawfully using pot, even if he has never been convicted or even charged with the offense.

So your 11e argument is bull shit. Its a false flag. You don't give a crap about the impact of Descano's policy on gun control You simply want to saddle individuals with records for mere possession of pot.

Nothing worse then when you do not know what the hell you are talking about while screaming to take peoples gun rights under the constitution away, so typical of hysterical Democrats

>Current use of pot in places where it is legal does not prevent someone from lawfully acquiring a firearm,

Yes it does read what 11e actually states . It has been added on to keep you from being a Strawman or worse

If you have a NCIS record as a marijuana drug user or person who possesses marijuana your a user or possessor of the federal narcotic marijuana

Then we have the Lt Gov of Illinois who bought legal weed to show off on 1-1-2020 who has no NCIS record because they are not entering that legal weed use into the NCIC while Democrats scream to ban guns but she is a possessor of the weed and thus may not buy a gun as she documented her purchase before cameras and media for all to see.

Now Ill let you look up the federal limitations that are imposed upon users of narcotics to buy a gun to educate you on 11E .

A clue Yes you can petition the federal district court for a OK to buy a gun just as convicted felons in Fairfax can petition Steve to get their gun rights back after McAuliffes blanket pardon . Good Luck with either and Im "With Steve" on that one. Now if the lad will change his ways on 11E he be a decent CA

"So Virginia decriminalizes marijuana and no NCIS information goes into the system to stop gun buys by narcotic users "

Democrats who say they want gun crimes stopped and support no narcotics info being put into the NCIS are a laughing stock of total hypocrisy

BTW don't forget the YES on 11F LOL

Is a "Certain violation" of the Gun Control Act 18 U.S.C 921 with up to 10 in the federal pen and at a gun show they will take you straight out to that black federal car in white plastic zip ties you wish upon President Trump so much to see. As federal BATFE special agents are on duty after you hand the dealer the 4473 to head to the Virginia State Police booth to run the NCIS check on you and you wrote NO on 11e with "possession of marijuana" on your NCIS check found

All kinds of fun waits for that 5 dollar state police insta check for weed users and your signature on the 4473 unless you answer YES then your just out a five and can leave the show not touching any guns . You will be watched ! LOL

>Yes it does read what 11e actually states .

No it doesn't if you read what 11e states. The operative word is "unlawful". Recreational pot use remains illegal in Colorado under Federal law, even though it is no longer illegal under Colorado law. Federal law stops though at the U.S. borders. Beyond that you would need to look at the laws of the place where it was being used. If it is legal there then the recent addition does not apply.

Not state laws it . Federal law supersedes state law Did you not read the federal 4473 form . Its not a state form.

So your a legal pot wizard ?? That's why weed smokes get caught because your in the know all right.

Since your in the know, you should know

"Some can smoke it legally anywhere they want under anybodys law" its their natural right but its not your right

But I will admit its natural but its federally illegal so go ahead and write a law legalizing it and when your finished do a amendment to the constitution removing then 2nd and ratify it .

it would be a non issue but Democrats want to write gun laws to punish law abiding citizens not criminals and then leave gaping loopholes for narcotics users as they lie and propagandize how successful they are when they failed miserably to stop gun crimes
