3rd DWI in 10 years last night

What can I expect? It’s been 9 years since my first, 6 since the second. Are penalties harsher even if the first one was so long ago? This one was barely my fault, I almost missed my exit on 66 and hit the brakes a little too hard, and a cop was behind me. Will the judge take that into consideration?

Third one is a felony with no statute of limitations - it's not a civil matter. Go to court don't be stupid. You will need the camping gear for when you are released and unable to find employment. Prepay a small storage unit before you get locked up. The most important skill is building a fire in the rain but it's still better to camp than to go to a shelter with the niggers

I don’t think employment will be a problem, I’m a bit of a specialist in IT, and companies so far have overlooked my past to use my skills. I am just wondering if there is any jail time, it’s not like I got into an accident or anything. The only problem is that I blew a .19, which is a bit over the limit.

Many employers will look past misdemeanor DUIs but you are now a felon. You will do several years at least so you will lose your current job. Then when you get out the jobs you are eligible for (have fun flipping burgers) won't cut the mustard in this area and your parole officer won't let you relocate to a more reasonable housing market. You can try renting a room from a slumlord for 500/month but you will have to share the dilapidated townhouse with 6+ niggers who will cause you to violate your parole with their second hand pot smoke. Have fun being homeless you wretched alchie!

I think you may be exaggerating. You can’t go from employed to homeless because you had a couple of beers and didn’t hurt anyone. Look at the sex offender registry - they all live in decent areas and are employed.

I am not a feline, I am a person. And as I’ve stated, I have some very specific skills that companies want, so I don’t think my record will be a problem. My only concern is that cops were illegally following me, trying to get me to do something to get pulled over for. Would a judge recognize this and let me off with a warning?

Some of the respondents to this thread are correct.

You will get a 5 year jail sentence with 3 years suspended.

You will have to serve 2 years in jail, 3 years probation, large fine, permanent loss of your driving privileges and probably ASAP program.

Also the trail will be in the circuit court, not traffic.

It might take a year before your trial.

Check the court website and look at the trial history for what happened to other people with 3 DUI's.

On the line at .08 or way over the line .11 and above , If its lower closer to .08 a good lawyer can get it plea bargained down to a reckless depending on circumstances

Three DWIs is a class 6 felony . It is a reason you see so many street beggars and bums hitting people up for cash . If the last DWI was within 5 years its 6 months in jail , if it was over 5 its 90 days in jail

And its true that if your illegal at least you can head back to El Salvador and avoid Virginia the next time you come back and live in style in heavy Democrat areas

That’s nothing! Like $50 a year!! I had a DUI once - was passed out shitfaced at a traffic light. It took almost 9 months to go to court and the cop moved to another jurisdiction in the meantime so the case was thrown out. I still drive after a few beers to this day!

Yes you can get more its unlikely, the ASAP class is usually to get your license back and in time you can If you take it.

ASAP will reduce the jail time to the 6 months and not more, if you buck ASAP they will give you more time, get the lawyer let us know what's up and remember this

This is all BS, his first post is at 8:07, if he got his third DWI he would still be in jail at 8:07. The jailers (Sheriff's Dept?) make everything the biggest, longest hassle possible. Anyone in for his third DWI would be lucky to be out in time for a late lunch.

I had four (12oz) beers once and got pulled over for speeding, 38 in a 30. I spaced those beers out, so wasn’t sure if I was over the limit or not, but definitely wasn’t drunk. While the cop was running my plates, I had a massive bout of diarrhea all over the driver’s seat. It stunk so bad I didn’t even get a speeding ticket, although I did throw up all over the steering wheel, so I had to drive home sitting in a gallon of shit with a slippery puke steering wheel. I am Catholic by the way.

Cops in VA can legally follow you for as long as they want. Judges in VA don't do "warnings". Blowing a .18 is pretty bad. You should've left VA for good after your second DWI.

Thanks for the interest and advice, so here’s an update.

The first two offenses were not in Virginia - one was in Georgia and one in Maine, but all within the last 10 years.

I made bail and am still working, it’s a small company and as I stated before they will stick with me because I have pretty good programming skills.

I have a good lawyer and should beat this - the cop should not have been following me as I wasn’t breaking any laws for the majority of the time. The worst that will happen is 3 weekends in jail, the best is reckless.

That's just about the stupidest shit I've ever read. A cop can follow you if they want to. I can follow you if I want to. You don't have to be breaking any laws for a cop to follow you. Your whole story is a bunch of bullshit.

Laws . Virginia can not interpret another states laws as the same as in Virginia, Maryland for example has a DUI and a DWI and their DUI is not the same as a Va DWI its a lesser offense with up to 90 days in jail and can not count as a DWI in Virginia .Their DWI is the same class of offense with up to a year in jail

Maryland also has Probation Before Judgment PBJ which turns into not guilty after one year if there's no further trouble with the law, it means no conviction . So you are not convicted but have been arrested . If your license is suspended or revoked that's another issue then its suspended in Virginia as well and vice versa
