A Fairfax County detective visited the store and asked for employee information.
Yes, the detective, in a business suite, had a badge...

but how does the average person know if it's fake or real?

If he has a subpoena or search warrant.
Other than that it doesn't matter if he's real or not, I wouldn't be handing out employee info.

Ask to see his credentials, it will have his EIN (badge number) and you can call the non-emrgency number to verify his employement.

Good question, I have no clue what a Fairfax detective badge looks like? The regular officers have silver badges, but don't "detectives" and sheriff's have gold badges?

I read somewhere that some fake badges that are sold over the internet say in small print "replica" or "novelty."

1. Try and run the person down with a car near IHOP. If the person shoots and kills you then the person is a legitimate Fairfax County law enforcement officer.

2. Ask the person to handcuff you and drive you to a bridge. If you can successfully jump off the bridge without intervention from the person, then the person is a legitimate Fairfax County law enforcement officer.

3. Successfully complete the requirements for a degree in Optometry and then place a few less then legal gaming bets. If you are gunned down, then the person is a legitimate Fairfax County law enforcement officer.

Hey smartie pants... you do realize that the IHOP incident was an Alexandria City Police Officer don't you? You are also aware that the teen jumped off the bridge after getting handcuffed by Virginia State Police, right? I don't think there's anything to worry about if the detective is legit.
A real cop wouldn't be offended if someone wants to verify his/her identity
by making a phone call to the police headquarters.


However, I'm worried about the fake ones. If someone confronts them about
it, wouldn't that make it into a bad situation?

Any legitimate officer in plain clothes will show you a photo id,not just some bullshit badge purchased off the INTERNET.Always ask for a business card in ALL dealings with law enforcement.It could have been a private investigator,they are famous for impersonating law enforcement.The best rule is no warrant,then no info. In this day and age giving out information to anyone can be problematic.What if that was some bill collector,auto repo guy or worse sexual stalker(rapist).Please tell the employee and verify that it was law enforcement. Normally the police can access personal information from many different data bases,DMV,voting registration,clerks office etc. Going to an employer? I wonder if he was legit.If not FILE A POLICE REPORT AND TELL THE EMPLOYEE REGARDLESS.

Since where you work is public info, a search warrant is not needed nor a sub. If they are asking persenel info they are but not just to verify the person works there. Since feds and state rquire you to report who you employ it is not pvt info sorry.

I would follow restons advice, ask for a search warrant or subpeona signed by a court. I never heard of the police having a right to obtain employment info without a court order or search warrant unless the employee in question signs a waiver allowing the info to be released.

Where does it say in the law that your employment is public record except for government employees?

Do you know what kind of info the detective was seeking?

Atty is full of shit ! A business owner doesn't have to reveal anything to the police without a warrant or court order,YOU never have to even speak to the police and probably shouldn't). There is substantial liability in giving away personnel info to some asshole flashing a badge. Right now we have two armed police impostors fulling people over to rob them.They are driving a crown Victoria with FLASHING GRILL LIGHTS.Hey ATTy are you in the 9th or tenth grade?

I will stick with your advice. Plenty of guys in jail who also suspected their lawyers knew what they were talking about.

I just dont see in this day and age any company handing over private personnel information to anyone absent a court order. I have read plenty of times in the paper when cops are disciplined the department will say we are not releasing that information as it is a personnel issue.

If the cop could point out a state code where the company has to release information then maybe but have you ever heard of that being the law? Not saying it isnt just never heard of it. If I am wrong it wont be the first time or last.

Even if they have a warrant or subpoena, you don't have to say a thing.

If they have either one of those legal instruments (warrant, subpoena), they can just enter the property and take whatever evidence the judge allowed them to look for. They can't compel you to answer their questions; you have the right not to answer them.

And if they don't have either one of those legal devices mentioned above, it's probably just some cop hoping to get some info from someone who is willing to talk to them.

First, if the store is a chain store with a HR department, refer it to them. A knowledgeable HR person (if that isn't an oxymoron, I don't know what one is) will know not only the law, what your company policy is about releasing information and might even know some details that the cops may find interesting - previous employment, in case of emergency contact etc - and whether this information is in the companies best interest to release.

For instance, the company may have records of the guy showing up for work with a gun, he has been reprimanded for letting someone named Gravis hang around the store, or that the person recently had a creditor call to verify salary and employment for a new car.

Again, the store should refer this to HR,if they have such a department, to protect themselves from liability and lawsuits.

Not only do police impostors show up with fake badges, I have heard about competitors hiring spies to show up in the evening when the store manager is usually not around. These spies identify themselves as IRS Inspectors and announce they are conducting random inspections and demand to see cash register tapes, credit card slips, and other financial and sales info. Many times, pimply faced teenagers have turned over the key to the cash register, left to get a soda while the agents do their work.

Lastly, if it is this man showing up asking questions, I would tell him everything!

A man was arrested on Monday, February 26 at approximately 4 p.m. after being found in a stolen 2002 Chevrolet Impala. The man was pulled over on the Capital Beltway at Dolley Madison Boulevard in the Tysons Corner area for speeding. Investigation determined that the vehicle was stolen and belonged to the District of Columbia. The car was not a police car but was equipped with red and blue emergency lights. Kenneth Drew Bryant, 37, of 1519 17th Street #1 in SE Washington D.C., was arrested and charged with receiving stolen property and impersonating a police officer. He was transported to the Fairfax County Adult Detention Center
