State Tax Returns delayed Why?

Virginia's tax season officially starts on Monday, Jan. 28, 2019.

However, there is one big difference this year that could affect your state return. The Virginia General Assembly is determining the Commonwealth’s response to the federal Tax Cuts and Jobs Act. Because of this, Virginia Tax will not be able to start processing returns immediately.

Why? What's the hold up?

Richmond is playing chicken with the Tax Payers of Virginia. Justin Fairfax and the other liberals are behind this delay. I will never ever vote Democrat again in this Commonwealth. They could delay this for months the A-Holes.

The new Federal Tax Law for 2018 forces far more tax payers onto the standard deduction than the prior Federal Tax Law.

This increases tax collections for Virginia under its current law which heavily favors being able to take deductions, but that also costs Virginians more money. Also, it's the middle class homeowners that are primarily affected by this, as the folks with the million dollar houses can still itemize...

Forces? You can itemize on your federal return even if the total of your itemized deductions is less than the Standard Deduction. It's your choice, and it may make sense for some to itemize in that the state standard deduction is so much lower than the federal standard deduction. Savings from the excess state itemized deductions may offset any extra tax owed on the federal side. You just have to run the numbers both ways and see.

I did run the numbers both ways and with itemizing vs the standard deduction I would get back a couple hundred more dollars. Now I am pissed that I could possibly have to wait several months to receive that back from the State of Virginia all because of politics in the Commonwealth.

Also a Republican led Senate. It isn't as simple as party though. And if the goal is to decrease on the state level the damage to taxpayers the damage caused by the Federal 2017 tax act, the solution isn't as simple as allowing taxpayers who claim the standard deduction on the Federal return to itemize on the Virginia return. Not that it matters because on the party level neither side is interested in restoring the status quo ante. The Republicans instead want to use the rewrite as an excuse to provide benefits to one group while Democrats want to use it to provide benefits to another. However both parties have their mavericks who understand their party's agenda isn't what most of their constituents want. This is why the problem wasn't solved when the General Assembly met in 2018, and with 2019 being an election year it is even harder to solve.

No. The legislative session is scheduled to end on February 15. If the General Assembly doesn't get its shit together and pass something by then, I have heard the Department of Tax is ready to move based on the law in place at this date. The hold up is that VDTax didn't want to start processing returns based on one set of rules and then switch to another. Also rumor has it they didn't want to force taxpayers affected by a rule change to file amended returns. Not sure myself if VDTax is that thoughtful.

Longer term, Virginians are going to the polls this fall. If the General Assembly doesn't fix the problem this year it will be an issue for the fall election. The outcome of that election would probably dictate the direction of change in the 2020 General Assembly..

The latest I have heard is the following:

Processing Virginia tax returns is still on hold. A deal was worked out in the Virginia Senate, but as of a few days ago what the House would do was still uncertain.

Ignoring arcane rules of tax conformity what it means is that most taxpayers will be filing returns under rules that are similar to prior years. The tax rates will be the same. The standard deduction will be the same. The requirement that taxpayers who use the standard deduction on the Federal return must use the standard deduction on the Virginia return will still exist. Later this year there will be a tax rebate of a portion of the excess taxes Virginia collected due to the changes in the tax law. Based on the babble from one news source the rebate will be automatically sent to taxpayers without another filing, using the refund method indicated on the taxpayer's return.

WASHINGTON — Gov. Ralph Northam signed emergency tax legislation into law Friday, which will allow delayed state tax return and refund processing to begin soon.

The bill conforms state law to match the federal GOP tax cut bill, but includes extra refunds for many taxpayers this fall and additional deductions on returns filed starting next year that are meant to offset nearly all state tax increases due to the federal legislation.

The Virginia Department of Taxation can now prepare its systems to process 2018 returns, including those already filed over the last few weeks. The returns are processed in the order received.

“As you may expect, we already have a significant backlog, so you may experience slower turnaround times for refunds than in years past,” Tax Commissioner Craig Burns said in a statement.

The delays were due to a dispute in the General Assembly over how any tax benefits should be distributed and whether any of the additional revenue should be kept in the state budget for other priorities.

The eventual agreement met Republicans’ push to prevent any significant state tax hike due to the federal tax cuts, but added some Democratic priorities of distributing more of the benefits of the tax changes than initially proposed to people who make less money.

It means the new spending proposed based on the increased revenue has been eliminated from budget plans in both the House and Senate. The two sides must reach an agreement by the end of the General Assembly session a week from Saturday.

They had to retool their tax forms due to them being based on the federal return information. A lot of Federal forms were not available even in December of 2018, so this placed all the design of the taxes for Virginia on late hold.

Add to that they are trying to figure out ways that they can end up with most of the tax savings that people received with the new Federal tax law.

We are starting to process 2018 returns in the order we received them.

We are currently processing returns received on February 3, 2019.

95% of all electronically filed returns are issued within 1 week but could take up to 4 weeks. If you filed your tax return on paper, processing your refund could take up to 8 weeks. If you mailed your tax return using Certified Mail, it could take an additional 3 weeks.

Latest from the Virginia.Gov site. Looking good now so it's should be long now.
