Best DUI Lawyer in Fairfax

I need help with this terrible situation I have. I recently had ankle surgery and was prescribed Percocet. On Friday night I went to Outback and had dinner and 3 Fosters lager beer. I was perfectly fine until I got pulled over on Braddock rd before Wakefield chapel rd. The cop asked for my license, insurance, registration etc. He asked if I have been drinking and I said yes "3 beers with dinner". He immediately ordered me out of the car and had me do numerouis tests and I told him about my ankle recovering and it was hard to balance on it still. He ended up charging me with DUI and I was in jail all night. I know Greenspun is the best but he is expensive. Any other reccomendations? Thanks

Just finding a good lawyer to get you out of this situation only fixes part of the problem. If you're an alcoholic, then you have to properly deal with those issues too. Or, you'll be back in the same condition within a few years or less.

What did you blow on the breathalyzer? Higher than a .08?

It is the fucking Percocet that made me feel weird which makes it my fault kind of which is why I am getting Greenspun. I made my mind up. Greenspun. My fault taking the Percocet in the molrning which intensified the alcohol.

The bottle that the medication came has a warning label that CLEARLY states that do NOT drive or operate machinery while taking, AND that alcohol will increase effect.

This situation is going to cost you about 15K for fines, lawyers, ASAP, starter interlock device for a restricted license, and AA Meetings.


Just wait until your insurance company drops you, and you will also be required to carry SR-22 insurance on top of everything else.

The advice is here is from retards.

- Don't ever admit to having anything to drink. That establishes PC for the police.
- Perform the field sobriety test, but refuse the breath test. That's not a crime. Refusing the blood test at the station is a crime.
- By the time you actually get your blood drawn your BAC should be much lower.
- Don't answer ANY questions whatsoever. Ask for an attorney.

That's sure some good advice - encouraging the drunks to keep drinking and driving and providing a "way" for them to proceed when pulled over.

Don't drink and drive - it's not that difficult. Use Uber, Lyft, etc. $10.00 to get home is less than $15K in fees/fines - along will possibly killing yourself or another innocent person.

Yes don't drink and drive is always the best policy. But we've all messed up and 0.08 is really not as "drunk" as you think it is. Nothing wrong with having a game plan should you find yourself in this type of situation.

Always refuse field sobriety AND the tube blow. The cop is just trying to establish probable cause for arrest at this point.

Don't say you have been drinking and don't say you haven't if you have - just say that you prefer not to answer.

If you think you are drunk, let the cop arrest you (on minimal probable cause so you at least have a chance that the arrest itself can get thrown out on probable cause grounds). You now have some time for the BAC to drop before you get the test at the station.

Say you are a 180 pound dude who had three beers with dinner like the OP. The MOST you will blow is 0.05. Probably less. But if you refuse, the hassle and expense will be enormous. In that case, if you're going to refuse anything, refuse the field sobriety test and take the breathalyzer.

There is a lot missing from the OP's story. Refusing either the breath or blood test is a separate offense in Virginia.

If a police officer requests you submit to a breath or blood test to determine your BAC level and you unreasonably refuse, the police officer is required to advise you of the consequences of a refusal. Your refusal can be used against you in court and may result in the revocation of your driver’s license.

If you still refuse to submit to testing, then the officer will fill out a form that will be forwarded to a magistrate judge who will issue a warrant charging you with violating Virginia’s Implied Consent Law. You will be required to answer the charge in court just as you would with any misdemeanor charge, separate from the DUI charge.

For a first refusal, you may lose your driver’s license for one year, and you will NOT be eligible for a restricted driving permit during all of that time. For a second refusal within a ten-year period, which is a criminal charge, you will lose your license for three years plus more asspain. Remember this is all in addition to the DUI.

You've made a bad situation worse. GET A GOOD LAWYER.

Here is the VA Code:

§ 18.2-268.2. Implied consent to post-arrest testing to determine drug or alcohol content of blood.
A. Any person, whether licensed by Virginia or not, who operates a motor vehicle upon a highway, as defined in § 46.2-100, in the Commonwealth shall be deemed thereby, as a condition of such operation, to have consented to have samples of his blood, breath, or both blood and breath taken for a chemical test to determine the alcohol, drug, or both alcohol and drug content of his blood, if he is arrested for violation of § 18.2-266, 18.2-266.1, or subsection B of § 18.2-272 or of a similar ordinance within three hours of the alleged offense.
B. Any person so arrested for a violation of clause (i) or (ii) of § 18.2-266 or both, § 18.2-266.1 or subsection B of § 18.2-272 or of a similar ordinance shall submit to a breath test. If the breath test is unavailable or the person is physically unable to submit to the breath test, a blood test shall be given. The accused shall, prior to administration of the test, be advised by the person administering the test that he has the right to observe the process of analysis and to see the blood-alcohol reading on the equipment used to perform the breath test. the CLINTON / OBAMA factor is the government assumes, for the purpose of political "filtering" of cases and top down control and money: is that everyone who drinks drives and everyone who drinks and drives gets in an accident

the problem is that the truth is that any person who is confirmed to drink drunk and drive is a significant danger on today's roads (high traffic), and a statistical danger otherwise

the problem is the Court has absolutely no way to "achieve" their objective. prisons are not built and meant to hold drunks: they are meant for killers and bernie madoff

The bolded part is not necessarily true. I got a personal breathalyzer for my birthday about ten years ago and did some experimenting on myself. Depending on how much you drink, how quickly you drink it, and whether it was on an empty or full stomach, your BAC can rise for a couple of hours after your last drink.

Secondly, if he did various tests, then why didn't he send you for a medical examination to check your words? An adequate police officer should have done so. The maximum that he had the right to do is write you a fine and that's it! You have every right to sue him. I had a similar situation and I filed a lawsuit.
