bench warrant

hey some guy is threatening me that he has pressed charges and that there is a bench warrant out on my name so if I get pulled over supposedly I will be arrested and dragged to PA to face him. Could anyone explain this?

k let me explain, I sold a set of AMG wheels to a guy on ebay. The guy send me a check. Then I discovered that one of the wheels is cracked and will leak air with use. i explained to the guy that I will be sending him a check back. I am in the Marines and do not get around the computer too often. I didnt get a chance to let him know for about 3 weeks. i explained to him earlier this week that I have sent the check. He emailed me last night stating that he filed charges yesterday and that supposedly there is a bench warrant for my arrest now, Could this be right or is he just pressuring me? I explained that he will receive the check either today or monday

A bench warrant is issued by the court, usually meaning you have failed to show up at the court at least once... If you get pulled over, you will be arrested, and held WITHOUT BAIL until the next court date.If I were you, I would ask him the phone number of the court in which the bench warrant was filed. If he doesn't tell you, then he is probally lying. I would contact the court just to be sure.

Erm... The court that filed the bench warrant? You haven't been charged with anything yet, he just is pressing charges. If this guy really were serious, I am sure you would have been contacted by the court. He's probally bullshitting.

If you are in the service go to the legal counsel at your base. The court wont tell you over the phone if you have any warrants. Your JAG office can make contact with the locals to find out if what this guy said is true. I doubt he is telling the truth, prob just trying to scare you to get his money back.

Also the JAG should be able to run a wanted check without the locals getting involved to let you know for sure if this guy got a warrant.

Sounds like he's blowing smoke up your ass. "Hey I got a cracked rim on ebay" "OK we'll file an arrest warrant for that no problem". But I agree with the previous post, go to wherever you are stationed or your closest marine/navy base for that matter and take to the JAG office and ask them to sort if out after you explain the situation. They will likely tell you not to worry but you never know.

I don't know of any court that will tell you over the phone if you have an outstanding warrant. If a person thought they were wanted and called the court over the phone and found out he was he would be on the next train out of town in most cases depending on how serious the charge.

That story is fishy. I think there may be a warrant for David -- somewhere along the line somebody added their own jargon and the warrant became a "bench warrant."

If David already contacted the guy and told him he would be sending a check, who cares about how often David uses his computer. You're either sending a check or you're not. Now that David knows about the warrant (three weeks later) he's a check writing, and excuse making, fool. Typical criminal behavior.

If David wants to minimize his problems, he should arrange to meet this "customer" at a police station in his town in Pennsylvania, pay him in cash, get a receipt, and turn himself in at the police station.

If David doesn't fix his problems, sooner or later he'll get stopped and arrested. And if he's out of state, he might expect to sit in jail for weeks before he gets transported up to PA.

I sent him an email asking some info. all he told me was that supposedly the police went to talk to my ex landlord and got the information off the check that my brother wrote for me to the landlord.(thats true my brother did write a check s thats accurate) Thats where he sent the check. My license goes back to my brothers house. The police supposedly showed up at the landlords house but not my license address, Also I have asked him to give me the officers name or what the charges are and he just ignorce those responses. He said he will drop the charge once he gets the check and he also told me that I have until the 7th , why would he give me a due date if he already filed the charges?

It is probably for his own purposes... if he has a cutoff date and you ignore it or don't make it, then he can assume he'll never see the money.

The point is that you've already screwed with him. You claim that it took three weeks to send out the check because you have limited access to the Internet, but that hasn't seemed to be a problem since you started this thread.

I'll admit that the buyer sounds like an idiot (his English skills are worse than yours). But if you put yourself in his shoes, perhaps you'd understand his position a bit better. After all, you held his $2000 for three weeks. Of course he doesn't trust you. Why should he believe you now?

No it doesn't take a genius, but it does require a little bit of common sense. If he has a legal problem in PA, why does he need to post a question about it on Fairfax Underground (which is in VA)?
I would think he could call the court house, or police station, or if that is out of the question, seek legal advice from an attorney.

Have you contacted the JAG yet to see if there is even a warrant outstanding? That takes all of one min to do. They will check because they dont want to get caught having knowledge of a wanted marine and then look bad that they didnt do anything.
Its simple, if there is a warrant they will take you into custody if not dont lose sleep over it.

The best thing for you to do is to pay the guy in cash, then turn yourself in up in Pennsylvania. It's possible that there is a warrant, but it's not in the national system yet. If you show authorities that you are willing to be mature and responsible -- you probably won't get thrown in jail. If you let more time pass, they'll probably get approval for extradition, and one of these days you're gonna get yourself arrested and your car towed on a traffic stop. Good luck!

If you have really sent the check I would simply stop responding to the person, other than restating the date you sent the check. After a while you'll have the canceled check, and if you are later arrested for not paying for something you'll have an email from the guy stating what he felt he was owed and a canceled check to match it.

And I agree with G above... eBay has a number of perhaps well-meaning but nevertheless bad buyers and sellers. The buyer was dumb for sending a check for that much to a seller, and you should have thoroughly inspected what you were selling before listing it. In any case I'd call the cops too if if didn't have my money FedEx'd back. I wouldn't stop at the local police either... I'd be in the post office filing mail fraud charges as well.

But I would stop responding the the guy. If this gets into a larger legal mess you want fewer statements from yourself in writing, not more.

You really should post this on ebay's message boards. There are people with much more experience with issues like this on that site. Personally, I think the buyer is full of it and is trying to scare you.I've read a similar stories many times on ebay's boards. You never answered the question on whether you sent the buyer's refund with any sort of tracking and delivery confirmation.That's important.

Only have electronic contact with the buyer via ebay's messaging section and forget directly e-mailing him--he can always claim he didn't receive your email but can't deny a message in his ebay "my messages" section. Stick to the facts, tell him you were unavailable for x amount of time, realized the one of the items was defective, and that you had issued a refund for x amount and mailed it to him via x mail service. Save copies of all correspondence. You could also pull his contact information from ebay and call him directly. A phone call can often go a LONG way.

This all said, you shouldn't be selling anything on ebay if you consistently are away from a computer--especially for three weeks at a time. You should have at a bare minimum posted this fact (your lack of availability) in your auction listing. No contact for that long for a purchase of that amount would understandably freak a buyer out big time. For car stuff, stick to craigslist or something like that and save yourself and a potential buyer a similar headache.Shame on the buyer for paying you by check. Paypal sucks but at least the buyer could have filed a non performing seller report and gotten a chargeback.

Ive read your posts, and I have a couple question
This sounds suspicicsouly like a scam a couple years ago Ive heard of.

1. Did you cash the check?
2. Did the check clear and you have his approx $2000 in your bank account
3. the check you sent back to him... Was it one you wrote, or his old check.
4. and 4th , why the hell did you cash the check before you shipped his goods..you sound a little suspect here buddy.

Do you really think just any jack ass can go into a police station and say.. I want a warrant issued for so-and-so. NO .. NO they can not..other wise I would have got a warrant issued for you on general gullabilty.

He would have to take you to court and then get a subpeona issued,
then if you didnt show up, then a warrant would be issued,
then if you didnt show up to that, you would be tried in absentia
then there would be a real arrest warrant issued to the federal DB

this guy is fuckin with you .. Just make sure he is not pressuring you to pay him back with money you never had of his.. This is why you use pay pal..

Oh and by the way.. reciept of monies with no intent of providing goods/services while using the USPS as the instument is a FELONY.. ie Mail fraud... a Federal offense.

I sorry but this story does not add up.. try again .
