Just yesterday, I was informed of an incident involving two female seniors at a Fairfax County High School in Northern Virginia.

The two girls were found in a bathroom after school, that reeked of marijuana. Coincidentally, they were discovered by a former teacher of theirs, who reported them to the administration. Minutes before the teacher discovered them, two other girls (who are acquaintances of the girls in question) were in the bathroom as well, and there was no more than 2 minutes between their departure and the teacher's arrival. The girls in question were not found with marijuana, or any tin foil/lighters/rolling papers, - just a plastic water bottle.

My question to you is - How should they be punished? These two girls are currently on school suspension for 10 days, with a recommendation of expulsion. Is this fair?

The teacher, in fact, can be proven (by multiple students who are willing to testify) to be biased - when SHE had the two girls as students, sophomore year, she contacted their classmates and warned them about the 'dangerous influence' of these girls. This teacher was most definitely out of line when she offered up her biased opinion to other susceptible students. She was the girls' AP History teacher (sophomore year). The only evidence against these girls is the teacher's statement and the plastic water bottle with only ONE hole in it,that was found in the trash.

Do you think this teacher's testimony should be disregarded? In making your decision, you should consider the fact that there is NO solid evidence against either of the two. Once again, no marijuana was found, but they have been charged with possession and have been referred to Alcohol and Drug Services.

Here is the personal aspect of this post; I have known these two girls for many years. One of the girls is in 5 AP classes; the other is in a few herself. These girls are good students and even better people; this is truly an unfortunate misunderstanding. If you have any experience with the FCPS school system/regarding its policies, please contribute any knowledge you have that may alleviate the seriousness of this event. These girls are simply a few months away from graduation. With no priors/suspicions of drug abuse by these girls, this punishment seems to be - in all fairness - overkill.

Flushed it? No, they were probably smoking a joint and just ate the remaining amount when the teacher showed up. It's pretty obvious when pot has just been smoked or if the bathroom wreaks from an earlier session.

Also if the girls were removed from the bathroom and still wreaked of pot with red eye's then that's a pretty clear sign they were smoking it or present when it was smoked.

Read the Students Rights and Responsibilities that each student and parent sign at the beginning of every school year. It spells out exactly what will happen to these girls. They will have a hearing and will probably have to go to one of the alternative schools.

You light the weed on the top so that it fills up the 2 liter bottle aboove the water line. Then you take the cap off and put your lips around the opening and inhale as you push down. The result is you get a shitload of smoke shoved in your lungs in a very short time. Called a gravity bong or GB.

Vaporize just burns off the THC from the weed and not the weed itself that produces most the smell. Thus there is virtually no smell and virtually no inhaled carcinogens.

There is a problem with your claim. NYU offers the binding early decision program. Here is what Georgetown's web site says about its early action program:

So, you could not have applied early to both Georgetown and NYU.

I think we already discussed in this forum that FCPS does not need anything mundane like actual evidence or eyewitness testimony to expel students thus denying them their educational rights. No prosecuter in his right mind would take a case this shakey in front of a real Judge who is bound to follow actual laws.

But FCPS does whatever the hell it wants to students (innocent or guilty - doesn't matter) and then proclaim themselves to be "drug free zones". And the higher profile the student is - honor student, athlete -- the harder they fall and thus the bigger example of law and order they become. You check your civil rights at the door when you enter FCPS property.

So, I suggest an appeal of the expulsion and fighting for all its worth. These girls will need a lawyer that specializes in education such as Steven Stone.

But I don't get your post. Certainly there is more evidence than just a water bottle. In fact, there may be confessions, all sorts of direct circumstantial evidence, too (smoke, smell, complaints from others, etc.

I think you intuit the two women are culpable. And you know there is more evidence than you indicate.

What I think you object to is the almost inevitable harshness of the punishment - expulsion. It strikes you as a waste of human capital and potential. And hence it seems unjust. You are likely right. And the system should allow for case by case dealings, but it doesn't. Yet another reason that small school districts (such as seen in northern suburban areas in this country) are better - the schools are truly more accountable to the people who participate. In any event, why not argue this point directly?

Although I believe that young people should absolutely be accountable, I absolutely would suggest here they run to a lawyer, and a good one.

By the way, although I think pot should largely be decriminalized, I think it an absolutely lousy drug to start using. This of course paints me as square, but pot doesn't work well with about 1 in 5 in the population - causing dependency, economic waste and other problems. From that perspective I support the schools being very negative on pot use, but automatic suspension and zero tolerance is not the answer.

First, the chance of a first time drug offender that was not in possession getting expelled is around 1%. There are so many layers of protection in the FCPS system before expulsion that it is very unlikely.

If these two girls are innocent there is way to prove them as close to absolutely innocent as possible.

TAKE A DRUG TEST.

I'm not saying it's right for FCPS to make them take a test BUT if it gives them a chance to prove their innocence - and get on with their school year - in an unfair system then they should avail themselves of it. It would be very compelling evidence to present to the FCPS School Board. Btw, any expulsion can be challenged in court and the more evidence you have of innocence the easier it is to overturn.

I would be demanding a drug test to clear my name.

I've been sitting here for about an hour now trying to figure it out. I know I'm no sicilian, but your figures and assumptions blow my mind. I'm left with no alternative but to say your post is a true testament to how stupid "the sicilian" really is.

As far as i know, according to the law, it is illegal to have marijuana in your posession, but it is not illegal to have just smoked it, or to smell like it (unless you are driving). But then again, when have FCPSchools ever followed the letter of the law. Well atleast they didnt get arrested and have a record from this.

Got to be more to the story.....if they were only standing in a marijuana smelling bathroom, the school would not recommend them for expulsion. If the plastic bottle found on them was being use as a smoking device and it contained residue, or if one or both of the girls admitted their involvement, then they would be recommended for expulsion. The FCPS policy is what is enforced in the school. If you are smoking marijuana then it is viewed as possession since you can't smoke it witout being in possession of it. The state law requires more but that is a criminal prosecution where the school punishment is enforement of policy. Not saying I agree with it.....just stating the facts.
