First, let me refresh your memory. The Starr investigation led to 15 defendants pleading guilty to more than 40 crimes.

Second, if the entire basis of the Trump investigation is tainted by the misdeeds of a few bad apples, the investigation is not legitimate.

Of course a sitting president can be indicted. It isn't going to happen though, at least not to Trump. A criminal prosecution of a sitting president or a major party candidate for president would be a profoundly political act. It could de-legitimize the judicial system far more than it already has been. It would be far better to pursue a sitting president using the political machinery of impeachment than the judicial process.

You must be new to this country - we had this thing called 'Watergate' as soon as the Supreme Court ruled that a sitting President could be indicted our then President Nixon resigned. He was a criminal.

SCOTUS did not rule that a sitting President could be indicted only that he must honor a duly authorized subpoena.

You can rest assured that no such precedent or ruling exists supporting your assertion.

In Clinton v. Jones, the Court only ruled that separation of powers does not mandate that federal courts delay all private CIVIL lawsuits against the President until the end of his term of office.

They made no such ruling on criminal court cases.

Ken Starr says yes you can indict, long time Department of Justice policy says no. It's hardly a settled matter.

The justices have never said whether the president can be indicted, nor whether the president can be subpoenaed for testimony. Only the Supreme Court can answer these constitutional questions definitively.

Did you read anything I wrote? I suspect not. Sentence #1 starts out "Of course a sitting president can be indicted." Everything else was addressed not to the theory of whether a sitting president could be prosecuted, but the practicality of doing so. As bad as you may think Donald Trump or Hillary Clinton are, can you imagine the political outcry if someone tried to use the criminal machinery of the judicial system against them?

When I see a post like this, I have to wonder what's going on
in the mind of the OP. Looks like they are gobbling up misinformation,
and believing anything that seems to confirm their desire to bring
down Donald Trump.

What do they think happens if their dreams come true?

It's not like the election will be overturned, or that Hilary or Obama
are coming back. You LOST, and IT'S OVER, and the Republicans are going

Regarding this particular issue of indictment, Giuliani is not really
the person saying that the President can't be indicted. He's agreeing
with the decisions that have come down from SCOTUS, and with the official
policy of DOJ since 1973, and with Constitutional scholars such as Dershowitz.

Trump can be impeached while in office.
Not going to happen.

Trump can be indicted after he leaves office.
Also not going to happen.
