This poor 9 year old boy was killed by pure negligence and a criminal level disregard for common safety around children. FCPD says "no charges expected to be filed" WTF!
At the very least the Principal and the adult in charge at the time of the reckless endangerment should be fired.
Imagine sending your beloved child to school every day and winding up with that child's head crushed by machinery because of purely incompetent staff members of the FCPS. I can't imagine the pain those parents are going through right now. How do these FCPS people sleep at night?

#3 despite that: these "partitions" have been in operation in fairfax county for DECADES and i've seen one and been warned of them during operation (to stand clear), being operated by a teacher not a janitor i should add.

back when the systems were first installed (mid 80's or perhaps late 80's i'd guess) there were no "minimal force" necessary limitations (that door slide easily and the motor be weak), nor were there any system (like in garage door openers) to cause a moving door to reverse direction

the engineers were wrong, the manufacturer is WRONG, and i told the school that 30 years ago

Motorized partitions normally have two switches, one on either side of the partition. Both must be held on to activate the panels. These switches are always keyed devices on those I've seen and used.

Did staff member ask a student to help operating the panels?

Actually the boy died during the SACC program, which is not run by FCPS. It’s run by the County so if anyone is held responsible, it should be them. The school administration has very little to do with the program.

They have little to do with the operation of SACC, however SACC is FCPS' vendor. They submitted a bid to provide aftercare services on school property. SACC and its personnel are ultimately responsible here...and FCPS bears some responsibility for the horribly selected and installed accordion door system as illustrated in other posts above.

Every sliding door partition system I have ever seen has a electric switch operated by a key and I have seen hundreds. If indeed a push button switch existed, that's a law suit in a school, even a high school.

Sliding curtains are different, these are light weight, sliding partition doors are heavier and more solid. But in a school, always a key switch, never a push button

Fairfax County does not maintain school buildings or write specifications for any schools even if any county programs may be housed in a FCPS school. FCPS does, they have a new school construction dept and a contract renovations dept for their schools plus school maintenance operations and custodial . This is entirely the schools problem, but it all comes out of the same pocket, yours.

The Board of Supervisors have nothing to do with these issues other then provide the schools their budgeted money and get bond referendums for new construction/renovations on the ballots for citizens to decide. There are 2 separate sets of specifications for architects, one for the county, one for the schools.

were there glass ceilings in Fairfax in the 80's or not?

when i was in school it seemed the Head Janitors (there was only one, the 1980's one man job: a building) were ALL BLACK. if you spoke to them casually - perhaps asked a question - they knew their shit and were friendly - but also too busy to say much more

it seemed whenever work was done that was not (a one man job), two white guys in a dually arrived

there was no "hispanic lady with a job deciding who's hired to do criminally un-necessary labor in every school because ...." AS I SAID - it was all done by one person (not including cleaning, i didn't say cleaning - though the janitor did some of that i'm sure)

OP already told you. The original design was that "responsible staff" had a janitor's key when necessary and that the person didn't allow any child anywhere near the door when it was moving. (a key was necessary).

The doors were not operated after students were dismissed: not during a class.

any teachers leaving the door in operating mode (not requiring a key - only a button) would have been reprimanded, )or operating the door before a class was dismissed, which i simply feel sure they were told to do)

In complex litigation, if anyone were responsible it would be the Teacher herself. However due to (xxxxx) the parents enjoy the right to sue the County and the county would then have the "job" of finding the woman and recovering the awarded money.

Judges are not magicians and are NOT LEGALLY allowed to sign papers as if they are:

#2 the Judge could not award more money than the teacher would be able to be sued for. you cannot bleed a turnip.

#1 the limit for accidental death is $10k (for injury part only) to prevent awards for death leading to criminals targeting children for deaths

i'm from the old school thinking that accidents are not crimes, they are just accidents - possible grounds for reprimand or training

it's assumed an accident if there is nothing to gain (if the award is a maximum of $10k, that's assumed nothing)

actually the class was dismissed as i approached a teacher operating a accordian door in the gym and i was taking a short-cut "normally open". the teacher had only just put the key in as i approached.

there were like 30 FEET clear on a slow moving door and she hadn't even pressed the button yet when she asked me to stop. i could have turtled and still made it - or ran, but she'd have neither.

but the teacher, teaching me a lesson stopped me and answered my eventual questions of why. (seen above, minus the according part she knew of)

i have to guess she was educating me, as a few teachers were likely to do.

she also made me go the long way. going the long way for a kid is like forEVER!

The prohibition on using the room dividers is not limited to schools -- I discovered this the hard way this week at a non-school-related Fairfax facility.

And it means that normally where you had 2 or more rooms with the dividers, now you only have 1 big room. Which is a problem if you had planned to be doing unrelated things in those two rooms, and there are no other rooms to move to.

The guys in the duallies are not janitors, one is a licensed tradesman like a plumber, HVAC man, electrician and the other is usually a semi-skilled helper. Much to the dismay of the teachers those tradesmen get paid more than most of the teachers.
