So over the weekend, I rode about 30 miles around Fairfax County. Nobody honked, cut me off, acted like a fool, etc. In fact, it was pretty peaceful.

Still, the nicest drivers are the ladies in their mid-to-late 20s, right on through mid-50s. Brunettes and darker hair, usually. And they always smile, so thank you.

Still expecting the pickup drivers, SUV drivers, and BMW drivers to be on the careless side, and while I was expiating the worst, they actually were pretty well behaved. Thanks again.

So to the trolls on FFXU who like to talk tough, either your mom had chores for you, and kept you busy, or perhaps that was your mom smiling at the intersection. Either way, I survived my trek around the county, which again, is mostly on the trails, with some road crossings.

Rush Hour, 123, cyclist held up traffic for a solid two miles while he huffed-and-puffed his way up the hill.

You assholes are some of the most inconsiderate, self-centered, passive-aggressive cocksuckers in society. If it wasn't for the civil courts, none of you would dare to set one wheel on a road designed for 4000lbs, four-wheeled, 300hp vehicles. Not. One. Wheel.

Even still, there is always someone out there who doesn't give a shit about the law, or going to jail. I guess you guys just hope you never run into someone like that? Or do you think you smug sense of superiority is worth being martyred for?

Agreed, very inconsiderate. Just because they CAN take the lane, doesn't mean they should. What, they were going 9-11 mph up the hill. I can see why one would get upset, following that.

As I said, I try and stick to the trails, but sometimes ride the wide, paved shoulders. Bike lanes are a better choice, and I certainly respect traffic. Perhaps I am the exception?

And as pointed out, a lot of brunettes or other ladies with dark hair seem to wave and smile as I ride. Late 20s-50s, keep smiling :)

As far as location of my next ride? Sometime this afternoon, on the Parkway trail, somewhere between Fairfax and Springfield. Not sure of the time though, but if you are as tough in real life as you are on the computer, I’m sure you’ll be trolling.

I didn't run any stop signs or lights in my 20 mile ride today.

Also, nobody acted like a jackass or came close to being a douche, throughout the ride. Although one guy in a new GMC Yukon Denali made a turn on right, cutting off a guy walking in a cross walk. Driver didn't didn't care, based on smug look. I was about 100' from the intersection, but saw it all.

There were about a 1/2 dozen cyclists out in the late afternoon. Not nearly as many as I would have thought, given the nice weather.

Also, as I crossed through several intersections as I rode the pathways, several more smiles and waves. 50/50 split between blondes though tonight, and dark haired ladies. :)

As for NOVA being unsafe for bicyclists, maybe it's not as unsafe as people make it sound out there. But, go ride your bike for a year in Portland, Seattle, Boulder, Golden or Denver and then come back to NOVA and tell us how safe/unsafe it really is here.

Pay up your insurance, you're going to need it because when you're riding a bike and you're hit by a car, your body isn't really influenced by whose fault the accident is. Pain is pain. And I always maintain plausible deniability with my victims.

In closing, paint code on my M5 is #264. You may want to call Munich now and have them fly over a few gallons. It's a factory color but, it's a special order. Those hausfraus need a few weeks to churn up a batch.

I didn't back up any traffic, as I was on the paths (mostly), so not sure what is angering you so much. Relax, take a deep breath, and give cyclists a break.

While I stick mostly to the trails, I do cross the roads at many intersections. To the lady today in the Audi SUV w/ UFL plates, appreciate the wave and smile. Same with the brunette in the dark blue Honda minivan. Keep smiling :)

Great question. I don’t want to be presumptuous, and really do appreciate their smiles. I’ve got an athletic physique, and do smile back, but don’t want to think they’re being anything more than just nice. Ya know.

One thing to clarify, it’s a bicycle I’m riding. I do have a motorcycle, too, but it’s an open-class sport bike, not a hog.

This is an interesting subject.

Here in DC, it is legal for bicycles to ride in car lanes like any other vehicle, and a fairly large number of people do it.

I can concur with another poster in saying that here it is quite common for
bicycle riders to take advantage of the right to ride in traffic, but to then break the law by running lights and stop signs. That's pretty offensive.

I admire their bravery. I stick to the sidewalks exclusively, not wanting to get run over on my bike.

I seem to recall hearing on the radio that some VA republican was refusing to build more bike trails.

I dated several women in northern VA, so I have seen quite a bit of car traffic, getting worse and worse over the years. Evidently your politicians granted permission for developers to build obscene numbers of new housing units but neglected to make those developers pay for the increased road infrastructure that would be needed to accommodate the huge influx of cars.

Shot yourselves in the foot for sure there Fairfax.

Gasoline, car payments, insurance, oil, repairs, maintenance, parking tickets, depreciation. owning a car can be a nightmare. It's nice to have bus and train service in the city.

However, maybe soon this won't be a problem any more. No more commuters on the beltway.

Major government agencies will be relocated to underpopulated and depressed
cities like Cleveland and Detroit. Plenty of housing and existing infrastructure there. Cheaper to live, lot less traffic and hassles. Cheaper for the agencies to operate, saves taxes.

Her response, "okay, you are really cute"

But, like I said, she was seemingly married, so I took the compliment and moved on. Nice, nonetheless.

Stay away from busy roads. I ride 110-220 miles per week with the long rides of 50 mi on the WO&D trail. Even on the bike trail you have crossings to deal with and they are quite dangerous. ALL the road crossings on the WO&D have pedestrian yield crossings with the broad striping and yellow signs - the law says autos must stop if a pedestrian (or bike) is in the act of 'taking the crosswalk' Id say about 75% actually do stop. It only takes one to kill you though. Caution is advised.

On the road there is a lot of anger. I assume everyone is very pissed off at life and a rider is an easy place to project anger. Im on the side of the road usually going 17-30 mph. Ive been a foot off the curb in the parking lane and had people lay on the horn. People are just angry. I almost always gesture for people that have honked me or flipped me off to pull over - they never ever do. Not in decades of riding has one single coward pulled over. That says a lot right there.

When you get to high school, you may have the chance to take driver's education. There, if you are attentive, you might get the chance to read the actual Virginia Code.

A bicycle rider at a crosswalk can walk his bicycle across OR he can ride it across, and have the same expectations that drivers will yield right of way. In Virginia Code §46.2-904 “A person riding a bicycle, electric personal assistive mobility device, motorized skateboard or foot-scooter, motor-driven cycle, or electric power-assisted bicycle on a sidewalk or shared-use path or across a roadway on a crosswalk shall have all the rights and duties of a pedestrian under the same circumstances.” So to recap: bicyclists are treated as pedestrians when on a trail and at a crosswalk.

I am in it for the fitness, but impressed by the kindness of the waves and smiles.

Last night, one lady in her GMC Acadia stopped as I approached an intersection and waved me across. Nice smile, too.

Then, I guess because it was GMC SUV night, another gave me a wave. Both had darker hair. Rode 12 miles last night.

My heart is healthy and I feel great for riding.

But there are STOP signs on all trail intersections that cross roads. which means that as a cyclist/pedestrian you MUST come to a complete stop before entering the intersection/crosswalk WHEN IT IS SAFE TO DO SO. you just cant ride out in front of cars and expect them to stop for you.

TLDR: arngy, don't be a bully. Sheet metal is on your side, but judges' opinions are not. The opinions of you, me, and the friends of the W&OD website are not important here. Documented judges decisions are important.

For a driver who has not completely forgotten high school driver’s education, a crosswalk SHOULD be all he needs to see to know that he has to yield or stop for a pedestrian or bicyclist at that crosswalk. Virginia Code and Virginia court decisions for the last 80 years firmly support pedestrians and bicycle riders’ priority “at” crosswalks.

Certainly a wishful driver may prefer that motorized vehicles had precedence over an individual wanting to cross at an crosswalk without a signal, but such a driver is being a bully and using sheet metal to intimidate, and probably acts knowing that there are few tickets handed out to those who ignore crosswalks, and perhaps knowing that a pedestrian has limited legal recourse if that pedestrian hazards himself by being hit at all.

Pedestrians gave up some rights to use the road, so drivers could go faster between crosswalks and intersections. In exchange for letting drivers go faster, pedestrians received priority at crosswalks. There was a massive social/legal shift in driving rules of the road in the 1920's and 1930's as speeding cars killed thousands of pedestrians, mostly children. Peter Norton's book Fighting Traffic has an interesting review of the many changes in how Americans came to view the streets.

A driver sees STOP signs on side roads and reasonably expects cars there are going to remain stopped and not enter the intersection ahead of the driver on the priority road. But wait, you are in a car approaching a trail and there’s a crosswalk painted on the roadway and a stop sign facing the trail users. Who has right of way? If you are not quite sure, you are far from alone.

One VDOT survey reported vast uncertainty on who has right of way at WO&D style crossings. Of those responding in a survey, 63 percent thought motor vehicles have the right-of-way; 28 percent thought trail users; and 8 percent did not know.” (pg 61 of Best Practices in Traffic Operations and Safety: Phase II: Zig-zag Pavement Markings) Those numbers are almost unbelievable, but in light of Northern Virginia crosswalk experiences, those numbers may reflect the chasm of misunderstanding and lack of law enforcement support.

Who has right of way? Generally the pedestrian/bicycle rider should expect drivers to yield right-of-way at crosswalks, but the law also imposes a major responsibility on the crosswalk user not to hazard himself by entering in front of traffic too close to stop. Since Virginia is a contributory negligence state, if a pedestrian is hit, she may have real problems collecting civil damages in proving that she followed that part of the law. To repeat, a pedestrian in the hospital with severe injuries MAY have to pay for all her own medical expenses if she is hit, and the driver may have to pay for a new fender.

In one Fairfax County crash (Russ v. Destival) referred to the Virginia Supreme Court in 2004, the jury essentially decided in favor of a driver who did not see a bicyclist in a sidepath along Braddock Road and eased his car out into the crosswalk, hitting and injuring the bicyclist who was proceeding through the crosswalk without having fully ascertained the driver had actually yielded the right of way to him. The jury determined the bicyclist acted with some degree of negligence in his crossing at the unsignalized crosswalk. As the court described it, “The right to proceed is to be tested by whether a person of ordinary prudence would attempt it.” Peers on the jury are car drivers.

Virginia Code §46.2-924 specifically uses the phrase “at a crosswalk,” in other words the area where the pedestrian is waiting to cross, and not just the striped portion in the roadway.

Traffic lights or police direction indicate right-of-way at many intersections. If there is no signal, Virginia Code §46.2-924 instructs “the driver of any vehicle on a highway shall yield the right-of-way to any pedestrian crossing such highway:
1. At any clearly marked crosswalk, whether at mid-block or at the end of any block;
2. At any regular pedestrian crossing included in the prolongation of the lateral boundary lines of the adjacent sidewalk at the end of a block;
3. At any intersection when the driver is approaching on a highway or street where the legal maximum speed does not exceed 35 miles per hour.”

A bicycle rider at a crosswalk can walk his bicycle across OR he can ride it across. In Virginia Code §46.2-904 “A person riding a bicycle, electric personal assistive mobility device, motorized skateboard or scooter, motor-driven cycle, or an electric power-assisted bicycle on a sidewalk, shared-use path, or across a roadway on a crosswalk, shall have all the rights and duties of a pedestrian under the same circumstances.” So to recap: bicyclists are treated as pedestrians when on a trail.

At a crosswalk Virginia courts have held “the pedestrian has a superior right — that is, the right to cross from one side of the street to the other in preference or priority over vehicles — and drivers of vehicles must respect this right and yield the right of way to the pedestrian. The pedestrian’s right of way extends from one side of the street to the other. It does not begin at any particular point in the intersection nor does it end at any particular point. It begins on one side of the street and extends until the pedestrian has negotiated the crossing.” (Marshall v. Shaw. Supreme Court of Virginia, 1955)

“The duty of a motor vehicle driver on approaching an intersection is to keep a vigilant lookout for pedestrians between curbs on the traveled portion of the highway, and when pedestrians are negotiating the crossing, or about to step from the side into traffic lanes, to operate his car at such speed and under such control that he can readily turn one way or the other, and, if necessary, bring his machine to a stop in time to avoid injury to pedestrians.” (Sawyer v. Blankenship, Supreme Court of Virginia, 1933)

“At intersecting streets where there are neither traffic lights nor traffic officers, the pedestrian has a superior right — that is, the right to cross from one side of the street to the other in preference or priority over vehicles — and drivers of vehicles must respect this right and yield the right of way to the pedestrian. The pedestrian’s right of way extends from one side of the street to the other. It does not begin at any particular point in the intersection nor does it end at any particular point. It begins on one side of the street and extends until the pedestrian has negotiated the crossing.” (Lucas v. Craft, Supreme Court of Virginia, 1933)

Social norms prevent someone pushing their shopping cart in front of a frail older lady in a grocery checkout line, in full knowledge that if she fell she would possibly break bones. Current driving social norms do seem to permit a driver to bully that same pedestrian at a crosswalk. Calling motorists bullies is nothing new. Questions of who had right of way and right to use the streets and highways were only a little easier when everything moved at a walking pace. The next quotation is now only of historical interest, before pedestrians were pushed from the streets in exchange for priority at regularized crossings like crosswalks, but a 1919 Virginia Supreme Court ruling held:

“The pedestrian and the automobile have equal rights upon the highway, but their capacity for inflicting injury is vastly disproportioned. It follows also from this that the driver of an automobile cannot be said to be using the highway within his rights, or to be in the exercise of due care, if he takes advantage of the force, weight, and power of his machine as a means of compelling pedestrians to yield to his machine superior rights upon the public highway designed for the use of all members of the public upon equal terms. . . . If there is anything in the argument of priority, man was created before the automobile, and, to paraphrase a quotation from Holy Writ, man was not created for the automobile, but the automobile was created for man.” (Core v. Wilhelm, Supreme Court of Virginia, 1919)
