Has anyone ever got pulled over in Fairfax for flicking a cigarette out the window? Welp it just happened to me...I see it all the time and I am beyond annoyed that it's considered littering??

Thats not too bad. I spent the night in jail up in Michigan because I got caught driving with a empty washer fluid reservoir. They would not release me till someone paid the $350 fine.

A) Don't smoke.
B) If you do smoke, don't throw your stupid butts all over the place. Do you just flick a weed onto your floors and carpets at home when you're done with it? Probably not, so show the same sort of sense out of doors. You can even learn how to field-strip a butt for those times when no reasonable receptacle is nearby. It's not hard. You can do it.

Truth is butts are very nasty, like shit nasty. People flick them out the window because an ashtray full of butts will destroy the value of your vehicle - the smell will never come out of the car. So people litter. I understand the but is literally on fire so I see how keeping it in the car is a bummer but throwing it away is reckless too. Littering is against the law and Im glad you got a ticket. Find a solution that doesnt involve littering.

The worst things these assholes do is flick their butts out the window while driving only for it to end up somewhere in the grill of my car. I then have to smell their cigarette shit until I come to a stop and the cigarette falls to the ground.

In reality it takes a cigarette butt anywhere from about eighteen months to 10 years to fully biodegrade. Gave the guy a break

Be thankful it did not start a fire.

About 10 years back a man was driving his SUV over a long bridge in California. He threw his lit cigarette butt out his car window. The cross wind on the bridge blew the butt back in his vehicle through the open back window.

His back seat caught on fire. By the time the guy realized that his vehicle was on fire, the fire was too big for him to put it out. He stopped on the bridge & jumped out of the vehicle.

When fire engines arrived, his SUV was already completely destroyed, a burnt-out hulk. Poetic justice some might say.

Driving north on 95 in North Carolina one time, I ended up in a bottleneck. The two leftmost lanes were closed because firefighters were fighting a brush fire in the median. It was most likely started by someone who just threw a lit cigarette out the window.

Good luck in court.

No, the charge will not likely get dropped. You wont go to jail, but you will get convicted and a fine. Easy to prove, you littered. See it all the time. A lot of judges will lecture you too.

I see it all the time because I am in court every day. And most people react the same way you do. Doesn't go over well. If you wouldn't throw it on the ground in your house, don't do it on the road. Easy rule. And it depends on the judge. Some of them will kill you (as in max fine), others might not. But do not expect it to get dismissed. And again, most judges will give you a little lecture to get the point through to you. Which you may need if you think you didn't do anything wrong (or not knowing how to spell ridiculous).

Your driving record has nothing to do with this. This is a criminal offense and you will need to list this on any applications for employment going forward that require disclosure of misdemeanor convictions. A guy applied to a company I used to work for and didn't disclose a noise violation ticket from 10 years prior (he thought it was just a ticket, not a criminal offense) and they fired him as soon as his background check came in for "non-disclosure"
