Why was the case dismissed? I mean, he refused a breath test, how do you get off on that? Pretty hard evidence of that charge, he refused, he was charged, open shut case.

Unless...

The "accuser" (read: arresting police officer) does not show at the trial. That would be conveeeeeeenient. "Sir, your accuser is not here, you're free to go, case dismissed!"

Like we can blame the cop for getting found not guilty. Go sit in General District Court one day and you will see that 30% of the people walk away with no charges. I thought cops were held to a higher standard than the general public. You can't become one if you have a DWI on your record, so how come this guy gets promoted after being arrested for DWI, refusal, and rear ending an innocent sober driver? Isn't a refusal charge an open and shut case (i.e. the refusal in itself is poof)? What about implied consent? Bottom line, he should have been fired the minute he was charged with the refusal.

ok....as mentioned.....the people who are saying that a refusal is an "open and shut case" have NEVER sat in general district court. once you have an attorney nothing is ever and open and shut case.

in addition...actually most police departments will not automatically disqualify someone for a single DWI conviction as long as it was more than 5 years in the past.

i really dislike when people post about stuff like they know, when they dont and it would only take a few mins to actually find....nice work inkahootz

Did the officer get in trouble with his department? Probably.... His punishment could have been anything short of termination.

You CANNOT be promoted during a period you are being punished. Fairfax promotes officers based on time so his time just happened to come up after the event.

He must not have been in his punishment period so he was allowed to be promoted.

You have to be convicted before you lose your OL for a year for refusal.... like most other citizens who get a good attorney..... you can plea to other charges and have some dropped.

I have seen this in court with citizens... nothing new. Hell.. OJ can even kill two people and get off.

Funny how people get bent out of shape wen a cop is involved in something.

Citizens.... from all walks of life can break the law and/or make mistakes.

Cops are held to a higher standard. They are not paid extra and get no bonus for being an abuse sponge.

They must take verbal abuse by citizens and are expected to not break the law.

But EVERYONE breaks the law. Did you get married before banging your girlfriend? Did you go down on her and give her oral? Both of these examples are against the law!!! But we have all done it.

Speeding??? Who has not gone over the limit?? Cops also make mistakes in judgement as do all humans.

Now the important thing is this.... MOST cops do not break the law just like MOST citizens do not break the law. But there are a few that do.

Unfortunatly.... some citizens like to post that ALL COPS break the law and this is not the case.

Cops that do break the law are held accountable and will be punished by their department. They do not require a citizen lynch mob to help out.

I spent a night in FFX county jail for a crime that I didn't commit. The deps were assholes, those honkies assume every inmate is guilty.
