Difference between Class U & O Misdemeanor?

Class "U" means you are "under" or on the bottom in jail. Type "O" means you are "over," or get to be on the top in jail.

U is an undefined misdemeanor, while O is a county ordinance usually showing a class U.

Then it had to have been a local ordinance violation, because Commonwealth Violations are all numbered (If the crime committed in VA is a Misdemeanor, then regardless of what locale it occurred in, it's still governed by Commonwealth Code).

However, the only exception that I know of is for the first time Possession of Marijuana, which is dictated to be an Unclassified Misdemeanor by the Code of Virginia. In other words, you'd have to be busted with a relatively small amount, and have a previously clean record.

What agency arrested you for DWI? If it was Fairfax PD, more than likely you were charged under the county ordinance which mirrors the State code. If a Trooper arrested you, you were charged under the State statute.

18.2-266 is the DWI statute, and it is a Class 1 misdemenaor.
Generally speaking, ordinances cannot be classified as felonies or misdemeanors. They can be punished as one, hence the "U" or "O" designation.

If you get the class U in Va (like for 1st time pot poss. w/ rel. clean record) - if you don't want to have to go thru the license suspension and 6 month to 1 yr programs, plead no contest and ask to discuss sentence w DA or court advisor BEFORE the judge delivers the verdict. Many times you can plea down to a much lesser designation like paraphanalia which in many cases is just a simple local fine of $50 to $100 instead of hassles and expensive fees like the $1200-$1500 VSAP program, license reinstatement fees, etc.

I was charged with class 0 misdemeanor 2nd dwi. I was sleep behind the wheel, parked at a gas station. I told him I was having Medical black out's. He still charged me. What is going on?
