ADVICE FOR LAWYERS GOT D.I.P AND DISORDERLY CONDUCT

im on probation for a dui and its supposed to end on feb 2010. last weekend i got a drunk in public and disorderly conduct charge. i was not breathalyzed, i left a msg on my probation officers voicemail the minute i got out of jail, telling her i got these charges and i plan to beat them. i also told her i didnt get breathalyzed either. now, in the next 2-3 days i have 3 appointments with 3 lawyers. Mark dycio, jim love, and hunter whitestone ( i wanted robert but pat said he doens't handle small cases anymore) is mark dycio really that unethical of a lawyer? i heard he's good and i had him once, he did OKAY but considering my situation, i dont think there was much for him to work on. im considering hiring him again but im a lil hesitant. he is cocky and thats a big negative for me. but money is not an issue here and i will pay top dollar to get the best representation for this case. i heard Jim Love was unethical too but i also heard he was a good lawyer. HELP

I believe the charge is appearing drunk in public; you do not need to be drunk to be charge. So I don't think the breathalizer matters. DUI and DIP; look in the mirror dude!

wait wait wait. Now you are telling me that there are DUI lawyers who are thieves?!?!?! And, to top it all off, DUI lawyers charging real high without putting much effort into the cases?!?!?!? This must be some sort of joke!

What are the terms of your probation? Is a class 4 misdemeanor really that much of a jam up? Removing a shopping cart from a store premesis is a more serious offense.

standard dui probation terms. no drinking while ur on probation. disorderly conduct is class 1 misdameanor

i was at a bar in annandale..the cops were hiding at the bar next door...my friends were getting into a scuffle and as i was charging at the guy, i got tackled by the cop, i guess when they heard yelling they ran to us. bout 4 of us got arrested with disorderly conduct and 2/4 got drunk in public with it, including me. i was not breathalyzed but i guess i was cussing out loud cuz of the fact i was gettin arrested and i knew i was goin to be in some shit (bad move i know)...and then we just got handcuffed and taken into custody and i spent the nite in jail. that was basically it

You don't have to breathalized for a DIP. It's not admissible in court regardless because it's hearsay evidence. You simply need to "appear drunk in public." It's why it's a class 4 misdemeanor.

Here's a crazy idea. Get drunk in your own home. No one needs to see your dumbass staggering around making a dickwad of yourself.

Public Resources
The VSB Publications & Public Information Office oversees the production of publications for bar members, including the Virginia Lawyer and Virginia Lawyer Register magazines. Both published five times a year, these magazines are distributed to all members of the Virginia State Bar, judges, law libraries, other state bar associations, the media and general subscribers. The Virginia Lawyer contains substantive articles on law as well as regular features, including a report from the president, advertising, and professional notices. Many feature stories come from the state bar’s sections, who provide articles on a dedicated issue. The Virginia Lawyer alternates publication with the Virginia Lawyer Register, which contains matters of regulatory interest, including summaries of disciplinary system actions, rule changes and state bar council actions.

The department coordinates production of more than 20 brochures and booklets on law related issues. These publications are for use by attorneys and the general public, and cover such topics as domestic relations, how attorneys charge, senior citizens rights, intellectual property, advice on home purchases and information about the Virginia Lawyer Referral Service. The department manages and promotes a statewide speakers bureau and the "Law in Society" scholarship contest for high school students. The VSB website is also maintained by the department, which has added such features as current disciplinary actions and real-time access to MCLE and membership data. This was accomplished at no cost to the bar with the assistance of the Virginia Information Providers Network.

A Communications Committee, made up of volunteer attorneys, works with the department to manage ongoing projects and develop new ones. The committee instituted a public education campaign to promote the positive things done by lawyers for the public and individual clients. The campaign was developed at no cost to the VSB by the Virginia Commonwealth University Adcenter and has received widespread acclaim from other state bars and the advertising community. The ads are available to local bar associations for their use and placement in local media.

Giving someone their Constitutionally granted defense is not "Unethical". If you're representing a Terrorist, well, then you're a Traitor, but that's another situation entirely.

You are reading too much into my comments. I am not saying that providing counsel is unethical, just the way they run their business. Look at the billing structure of these operations and tell me if they are ethical.

Oh alright, I got you. I think it depends upon the practice to be honest, as they vary in regards to their billing structure. Yes, I know of rip-off "lawyers", but I know of some very honest and straightforward ones as well.

One example of a rip-off was a friend of mine who had a "Driving without a Valid Operator's License". He called some lawyer that was covered by a plan at the office where he worked, and she didn't know squat about the law. She started by telling him that his charges were a Class II Felony (Which is Attempted Murder for instance), and then she said that she could work on his case for $2,500, but that she wouldn't represent him in court, because there wasn't much she could do in that regard. What a load of BS. I told him that it was a Class II Misdemeanor, and if he paid the worthless Lawyer $2,500, that was $1,000 more than he could possibly owe the court in fines at the MOST. He dumped that lawyer, went to another, and he took up the case for under $1,000, represented him in Court, and had the charges dismissed.
