How close can a driveway be to the property line?

How close can a driveway be to the property line in Fairfax county? Looking at buying a house, but it has a driveway only wide enough for one car, and tandem parking is a pain, also the street is fairly small so street parking isn't ideal either. I could widen the driveway to two card wide, but it would be pretty close to the property line(/right on it)

Contact the Fairfax Department of Planning and Zoning at703-222-1082 or 703-324-1314.

I was under the impression that a driveway could be built right to the property line, but requires a permit and cannot divert water directly onto the neighbor's property.

You can build your driveway right up to the property line unless there is a special variance for the property (e.g. flood plain, designated green space, etc). I recommend that you go about 1 foot inside your property line to allow for any mismarkings of the line. If that extra foot is critical, then look for another house to buy.

Also, there are new rules about the percentage of the lot that is impermeable (not allowing rain to soak into the ground). If you have a small lot you may not even be allowed anymore driveway area.

If the curb and gutter is for single wide enter/exit then that is as big as you can go. Contact Zoning Office for EXACT rules.

You may be required to apply and pay for a zoning study, and the replacement of the single wide driveway entry/exit before you can change the width of the driveway.

Lots of driveways in my neighborhood are single entry --but widen at the two car garage.

And, could you not expand on your house side--rather than the neighbor's side?

Just park in the yard. It is apparently the thing to do in Fairfax County now.

As an FYI there are some grants/subsidies that apply to replacing an impermeable driveway with one that is. From the removal of the old to the installation of the new. It's something that I'll be looking into once I replace mine.

BTW, you CANNOT build a driveway 1 ft from property line, each neighborhood has zoning, and HOA's are often much more strict.

Example, 60 year old neighborhood in Fairfax City, you cannot build within 10 feet of property line, and next door neighbor can still file against plan.

"Build" within 10 feet and put a driveway in up against the property line are two very different things.

Don't know how close it can come and too lazy to look it up for you.
BUT I DO know that there is a LARGE percentage of one's yard that can be paved WITHOUT having to get a permit.

For some that could mean an area the size of a basketball court.
It's percentage, not limited to a set amount of square footage.

This probably doesn't help OP, but the nice thing to do is to leave space if at all possible.

OP could you widen it on the other side?

OP look it up with terms like "fairfax county" "code" "paving" "yards" "driveways" etc.

The question which you have asked raised my interest as well. I contacted the leading Naples property management company to find out the answer. They replied that there are no certain rules or laws what will indicate how close can a driveway be to the property line. Each road demands a unique project based upon which the workers will built it. Many think that each road is similar to one another and this is completely wrong. Probably you should also contact one of the Naples property management company in your area and see what they say.
