Can a police officer give you a reckless driving ticket for doing doughnuts on private property even though they were not there to witness it?

I dunno, but if you admitted it, that might be enough.

It's like I've read about speeding tickets, if the officer asks, "Do you realize you were driving over the speed limit?" and you say, "Well, I know I was going a little over the limit," boom, that's it. You've admitted you're guilty.

I was TRYING to endanger anybody. The cops weren't even there to see it happen so I don't understand how they can charge me with something that they did not see happen.

Further to Mr Captcha's point, if the private property you were driving on does not fall into one of the three listed categories, and you were indeed charged with a violation of § 46.2-864 (rather than some other charge), then you would seem to have a good shot at beating the ticket.

Does your ticket indicate the specific code violation you were charged with?

Well, if you look at the language, it doesn't matter if you were trying to endanger anybody or not.

There are a lot of things you can be charged with even though the cops weren't there to see it.

cops are dicks, nothing new.I was in a similar situation, no wittness, etc got a reckless ticket. Went to court and defended myself. I asked the pig if he saw me crash(it was a single vehicle crash), he said no.Then I asked him if he had a witness, he said no. The judge dropped it to improper driving. Paid a $50 fine, and the ever so awesome court fees. But that was a lotttttttttt cheaper then a reckless fine, and a reckless ticket going on my insurance.

How do you know someone didn't call you in? Are you sure no one saw anything and do you think the officer is going to tip his hand to you right away? I would think if you laid down rubber and left marks that would certainly be fairly damning evidence as well.

Waste your money and get a lawyer if you'd like. Everyone on this web site thinks they are some kind of magicians or something. It's really hard to polish a turd, but I guess some of the more unscrupulous attorneys would lie for you.

Sometimes just coming to court, dressing nicely, and admitting what you did was stupid and was a mistake while showing true remorse has more bearing on a judges decision than someone trying to pull one over on the system by looking for loopholes.

I think that cops should keep order, not punish people for not following the speed limits, or having fun. As long as nobody gets hurt i don't see a problem. I could have been doing the doughnuts out on the street and putting other peoples lives in danger.

So the next time you do it thinking you are incredible at doing donuts in private parking lots and you DO hurt someone, they should then just treat you like you were only an idiot this time?

If you go to court on it, you might be better served to dress nicely and just tell the judge, "Yes sir, I did it - I wasn't being too smart I now realize. I realize now if I had lost control I could have hurt someone and I was wrong."

Ummmm, stopping people from doing doughnuts in parking lots in pretty much "keeping order," dontcha think? Wouldn't it be a little chaotic if parking lots were full of people doing doughnuts and having "fun?" There's no way you are more that 16 years old is my guess. Just more evidence that the minimum driving age should be raised to 18.

§ 46.2-852. Reckless driving; general rule.

Irrespective of the maximum speeds permitted by law, any person who drives a vehicle on any highway recklessly or at a speed or in a manner so as to endanger the life, limb, or property of any person shall be guilty of reckless driving.


You weren't driving on a highway. So that law clearly doesn't apply to you, and you did NOT violate it.

On the other hand, § 46.2-864. Reckless driving on parking lots, etc., that Mr Captcha posted above only applies to certain kinds of private property (NOT including residential private property).

So see if you find a lawyer who will do a free initial consultation.

You could have a winning case, or something life Tef where it's dropped from reckless to improper.

No, I am not 16 years old, I am 24. So fuck you, who the hell are you to judge me. 10 years ago if somebody was doing doughnuts nobody would have said anything about it. The world today scrutinizes everything and blows every little thing out of proportion. You can tap somebody on the shoulder and they can charge you with assault, I personally think that is bullshit and that we need to live in a country where you can make a mistake once.

I see nothing wrong with doing a couple of donuts in an empty parking lot when nobody is around or lighting up the tires once in a while.

Can the cops charge you with robbery if you steal something on private property and they weren't there to see it? What if you kill someone in their own private home?

Clearly, 24 is the new 16. 10 years ago, you were 14, and you knew even less than you do now. You'd get busted for doughnuts back then just like you do now.

And you are free to make mistakes in this country, dumbo. More than in most countries. Just know that if you act like an idiot, you can expect to be treated like one.

The Police have to witness it to give you a ticket, unless the Property is not your own however, and if the owners press charges.

Sorry, I knew several people when I was in High School who got reckless driving tickets for doing just that. One of them in a fucking box truck turning around in a church parking lot next to the furniture store he worked at, and he wasn't doing donuts, one of the back wheels had a bad bearing or something and would squeel during hard turns. That was back in like 1986.

1. Show up and plead not guilty
2. Ask officer if they witnessed or have evidence that this crime has been committed. If they mention they have a written statement from a neighbor, etc., question their integrity as a credible witness.
3. This should be extremely simple to beat since it was on private property and there were no witnesses, but you have to do some homework if you want to beat it without a lawyer.
