Today I couldn't believe the audacity of a motorcyclist on Old Lee Hwy in Fairfax City. He was riding one of those crotch rockets, weaving in and out of traffic, tailgating, and driving 30-40 mph over the speed limit. Where's a cop when you need one? Glad to slam the brakes on this fool though, as he deserved it. Next time the door will be opened as he passes.

You may not be aware of this, since most people seem to throw their door open into traffic thinking it's everyone's else's responsibility to "drive safely" or whatever, but it is illegal to open your car door into traffic.

That means when you are parked on the side of the road, it is illegal to open your door while cars are approaching. If someone hits your door, it is YOUR fault, and you are responsible for all damages or injuries.

If you open your door on a motorcycle, you're probably going to be charged with attempted murder, or malicious assualt or wounding, or something.

BTW, the way the law is written in DC, technically you aren't even allowed to exit from the vehicle on the side that is in traffic, you are supposed to climb over to the passenger side and exit on the curb side, or something.

Murder, assault = intentional crimes.

Absent an admission by the person who opened the car door, it would be virtually impossible to establish more than mere negligence, particularly in the case of a motorcycle, which is harder to see than a car.

That one is hard to prove though. Absent some way to prove that you did it intentionally to cause an accident, the law is pretty clear that hitting someone behind is usually the hitting vehicle's fault.

You could always say "but didn't you see that dog run out into traffic?" (or rabbit, or squirrel, etc.)

Besides, good luck trying to out-brake a motorcycle. He'll be at a complete stop and have both of his feet on the ground before you even come to a complete stop.

Except for when they tailgate you from 1 foot behind your bumper. I've never understood why bikers think they can tailgate but they get so pissed when you ride close to them.

It's the same concept as the braking distance differences between a fully loaded tractor trailer and a car.

If you're tailgating the truck, no problem. If he's tailgating you, there's a problem.

If you're tailgating anyone though, there's still a chance for a huge problem regardless of who is tailing whom.

Yeah, they have a hard time writing laws that don't contradict other laws or that don't explain the alternative to not doing what they are making illegal.

They also have laws against flashing your brights, yet they have laws that say that an overtaking vehicle on a four lane divided highway has the right of way upon visible or audible warning.

Sure, but you can ride a few feet off a tractor trailer's bumper, and he can lock up his brakes and you'll still stop well before he does.

Same with motorcycles. That guy could be burning tire marks into your bumper, practically, and if you slam on your brakes, he's going to stop well before you do. (well, obviously if he's touching your bumper, anytime you jam on the brakes you're going to fuck him up, but you get what I mean.)

I've ridden motorcycles for over 25 years, and have always made a considerable effort to not tailgate, recklessly speed in trafffic, I never split lanes, etc. I always signal my lane-changing intentions, and let people merge in (doing things like this ensures that I'll get to my destination in one piece, as well as not making enemies of bikers), but all it takes, though, is one clown like this to ruin it for all the other motorcyclists. You didn't say, but no doubt the guy was wearing just a t-shirt and jeans.

I also ride with an ambulance, and you know what, the odds are good that I'll be seeing this same guy as a patient some night...

The road is for motor vehicles. Sure, technically a motorcycle is a motor vehicle, but it's not right for all of us who drive cars like normal people to have to get all defensive in our driving because some asshole is riding around on his motorcycle in the middle of a busy highway. If you so much as tap a guy on a motorcycle by accident with your bumper, he's finished. And then the next three years of your life will be tied up in legal bullshit. Not to mention the guilt you'll have to live with the rest of your life, all because some idiot was riding his glorified tricycle in heavy traffic. I understand you have every right to ride your motorcycle. But personally, I hate it. If I were president of the world, I'd have them outlawed. Bicycles too. But that's a whole other issue. Fucking faggy grown ass men peddling around in traffic on their faggy little Huffy bikes. Fuck them. I give the finger everytime I pass by a cyclist.

I ride with a full face helmet, jacket with armor protection, and gloves with kevlar knuckles...always funny thinking about some road rage punk getting out of his hybrid Prius ready to tangle...

1. VA state law permits bicyclists to use roads with equal rights as motorists. The exception - we are not allowed on limited-access highways.
