Question about the sample ballot

On the sample ballot I received Question 1 seems confusing. See below.

Should Article 1 of the Constitution of Virginia be amended to prohibit any agreement or combination between an employer and a labor union or labor organization whereby (i) nonmembers of the union or organization are denied the right to work for the employer, (ii) membership to the union or organization is made a condition of employment or continuation of employment by such employer or (iii) the union or organization acquires an employment monopoly in any such enterprise?

( ) Yes

( ) No

What does this mean? I was under the impression that Virginia is a "right to work" state, meaning one cannot be compelled to join a union to work for an employer even if some or all employees of that employer belong to a union. Does this ballot question above codify that into the Constitution or is this to remove our status as a "right to work" state?

They're trying to change that by putting this in the state constitution. Vote No.

That still doesn't answer OP's question. Change the constitution to include that we're a right to work state or change the constitution to no longer be a right to work state.

For Question 1 on the ballot:

If you vote YES, you are forbidding unions from making membership in the union a requirement for getting a job in the state. So that keeps VA a Right To Work state.

If you vote NO, you are allowing unions to make union membership a requirement for getting a job, which can be imposed at the time of an agreement between an employer and the union.

Voting YES keeps unions from being able to negotiate for this requirement.

Virginia is now a right to work state. That means that you cannot be forced to join a union in order to be hired or to keep your job. It also means an employer cannot contract with a union to be its sole source for employees.

Virginia is a right to work state by statute. That means if the legislature ever decides it doesn't want to right to work, they can simply pass a new law repealing the right to work law. The purpose of the amendment is to make it harder for Virginia to stop being a right to work state. If the legislature decided it didn't want to be right to work, it couldn't simply repeal the law. The legislature would also have to amend the Virginia constitution.

Vote YES. This way Unions cannpt force you to be a member and pay mandatory dues in order to be hired for a particular job.
