Is there anybody here who lives in an HOA community who has successfully restricted the listing of homes on www.airbnb.com?

Our community has been besieged by AirBnB customers renting a unit in our building for the weekend, throwing a big house-party, and tearing shit up. In all the cases we've been able to collect on damages to the public areas, however it's more than just fixing the damage. We'd really like to prohibit the listing of units in our building on AirBnB and other short-term rental websites. Has anyone had any success with this?

Also, is it possible to put something in your governing docs prohibiting people on the sex offender registry from owning or renting in our community?

We were able to do this because short term rentals are specifically covered in our HOA's CC&Rs. Someone back when our neighborhood was being built back in the '80s had the foresight to envision some shitbag owner running a flophouse out of his unit, so they added the language saying you can't rent a unit or any part thereof for less than six months.

Look through your association's CC&Rs and see if it says anything about short term rentals.

Put a tiny bit of chewing gum on the end of a toothpick. Shove both in the keyhole but not all the way in. Break off toothpick and then push it all the way in. Won't ruin lock but will require locksmith. A couple weekends of locksmith they'll get the picture.

Your condo or HOA covenants or declaration should have a provision that prohibits short term leasing or renting of any dwelling unit. If not your Board needs to amend the covenants via the procedure outlined in the covenants.

If Fairfax County can't combat the already existing overcrowding in rental units already- what makes you think they will enforce any AirBnB restrictions?

When Paco and his 12 friends (all unrelated but they claim to be and cry "discrimination" when called out on it) rent the townhouse next door, the HOA and county are called about it, and nothing happens and it continues for years even to this day- I have little faith making a law about it will end the practice.

Just like guns, just because the sign says it is a gun-free zone doesn't mean criminals will pay attention to that sign and bring in guns anyway.

It isn't that Fairfax County CAN'T combat overcrowding in rental units. It is that they don't want to. It requires the commitment of more than nominal resources to make an impact. In addition that overcrowded rental housing constitutes a large portion of the county's low cost housing which the County business community demands. Shutting it down means either having to provide more actual low cost housing...or...horrors...telling the Fairfax business community they need to pay their employees a living wage.

Also CCR restrictions in HOA communities don't rely on the County as their first line of enforcement. They rely on their own enforcement mechanisms. That's the same nazis and pit bulls that enforce the rules against letting your grass get too high or painting your door the wrong color.
