Ticket for Temporary Inspection Sticker

I got a ticket while my car was parked in DC for an expired inspection sticker but it wasn't expired...one item was rejected and there was a temporary sticker with the void symbol which gives me 2 weeks from the date of inspection to take care of the problem, and the inspection was done just a few days ago. Has this happened to anyone before? I am going to appeal the ticket ($50) and they better dismiss it.

A rejection is valid for the puposes of necessary driving only, doctors, grocery store and back and forth to the repair shop. Yes they can ticket you for what you failed for as it is considered a safety violation

§ 46.2-1157. Last paragraph.

Notwithstanding the penalty provisions of § 46.2-1171, a violation of this section constitutes a traffic infraction. The court may, in its discretion, dismiss a summons issued under this section where correction of vehicle or safety equipment defects or proof of compliance with this section is provided to the court subsequent to the issuance of the summons to appear, but such dismissal shall not operate to relieve the vehicle owner or operator from the court costs provided.

§ 46.2-1158.

A reinspection of a rejected vehicle by the same station during the period of validity of the rejection sticker on such vehicle, however, need only include an inspection of the item or items previously found defective unless there is found an obvious defect that would warrant further rejection of the vehicle.

A rejection sticker shall be valid for fifteen calendar days beyond the day of issuance.

No where in the Virginia Code is there a limitation on when or where a vehicle may be operated during the period that the rejection sticker is valid.

Under the "full faith and credit" clause of the U.S. Constitution, DC has to follow Va. law re the validity of a re-inspection sticker on a vehicle registered and inspected in Va.

So you've confirmed what I've said. Driving on an expired sticker means that you have no valid inspection and are subject to citation owing to it being a driving infraction.

From the Virginia State Police website:

Can I operate my vehicle with a rejection sticker on the windshield?
The validity period of a rejection sticker shall be 15 days, in addition to the day of inspection.

The purpose of a rejection sticker is to replace the approval sticker that was originally on your vehicle’s windshield. It, in itself, places no travel restrictions on the vehicle; however, it does not provide any exception to any statute governing equipment defects.

As an example, if your vehicle was rejected due to a defective exhaust, with a rejection sticker or with an approval sticker, you would be in jeopardy of receiving a summons for operating the vehicle on the highway with defective exhaust.

So please STFU and go back to studying your Regents University law texts.

Obviously, you're still trying to pass that ESL class, eh?

§ 46.2-1157. Last paragraph. Makes clear that even if the inspection sticker is expired and an operator is cited for the expired sticker, if the vehicle is inspected before the court date, the judge can dismiss the infraction.

Why would the General Assembly give more leniency to an expired sticker than a rejection sticker, since a valid rejection sticker proves the operator was diligent enough to have a timely inspection of the vehicle.

The Virginia State Police website is not the law, no matter what the guys in the funny smoky the bear hats think.

Besides, what the excerpted language from the website makes clear is that a even a valid inspection sticker is not a defense to a citation for defective equipment. The defense of that citation would probably require testimony from a mechanic and/or a safety inspector.

BTW, it's your gubernatorial candidate, Bob McDonnell, who went to Pat Robertson's make believe law school.

There is difference between gubernatorial candidate, and a governor.

California had over 30 registered candidates in their special election that included:
a washed up actor, a porn star, a short washed up actor, several people with documented mental illnesses, a howard stern fan, etc..

Unless you include Minnesota in the debate, that throws everything out of wack.

The fact of the matter is that you can be stopped and you can be cited. The VA code proves it and you admit it. What the judge then does is irrelevant. He can dismiss any charge, and he may choose not to. The same is true of any citation.

A fail sticker clearly indicates a non-compliant item that is required by the VSP and that red FAIL sticker is a bullseye to a cop who wants to raise his revenue tally...

Firestring85 was cited for the inspection sticker violation not defective equipment.

You can get a defective equipment citation with a valid inspection sticker. The valid sticker is not defense.

I have to make a drive to Northern, VA tomorrow, but I have a rejection sticker on the window. The items have been fixed, and it is still within 15 days of the inspection, but I am not able to get it reinspected before the trip because it is the weekend. One of my wipers was a special order item that just came in this morning, otherwise it would have been reinspected already.

Could I be ticketed or towed for having the expired sticker on there?

District of Columbia *cannot* properly ticket you for an expired VIRGINIA inspection sticker on a VIRGINIA vehicle. That doesn't mean that they don't do it, but it is bogus.

First of all, not all states even have an inspection program. E.g. Maryland, Florida, Ohio do not have safety inspections. Since VA's inspection requirement is a VIRGINIA law and not a DC law, they have no jurisdiction. If DC mandates inspections for out of state vehicles, then they need to enforce that for Maryland, etc. vehicles as well.

Even if they (DC) try to enforce Virginia's inspection law, the Virginia law specifically exempts cars out of Virginia from Inspection requirements until the vehicle returns to the owner's residence or place of business in Virginia. See Code of Virginia 46.2-1158.01 as well as the VA State Police information at http://www.vsp.state.va.us/Safety.shtm#FAQSafety

My daughter was stopped at a check point in my neighborhood and was given a ticket for an expired Va. rejection inspection sticker . The officer was not nice to her at all , he wanted to know where she was going and where she had been. The officer did not notice that the sticker was still good also he stated that he could impound the car and have her arrested. I took the car to a different inspection station and they found nothing wrong with the car in fact they stated how great a shape it was in since it had new tires exhaust brakes shockes headlights and wiper blades. The first place put a rejection on the car because the emergency brake would not hold the car under full throttle but under idle. What should I do now to get the case stopped or dropped etc.

She got a ticket for an inspection sticker? Go to court date with proof the vehicle was inspected and passed. Judge with dismiss the charge most likely. There are a lot of other factors that may play into this also.
