Eminent Domain

So, how many of our Fairfax City's residents realize that all of the businesses closing are due to eminent domain by our City Government? Craven's Nursery had no intention of closing until approached and bullied.

Eminent domain has been a part of our legal traditions since the Magna Carta. The needs of society often trump the desires of little old individuals. Do you have a problem with that? Are you still pissed off about Kelo or something? LOL!

Baskin Robbins in Fairfax City was apparently bought/closed via eminent domain.

However, you do realize that owners are offered a fair market value for the property as part of eminent domain, right? The government doesn't come in and bulldoze your property like in the movies.
And in these instances of eminent domain there are large swaths of business being bought out for redevelopment. This is not the case of some small mom & pop joint being bullied by the big, local government.

Go move to PG County, and free up some space for someone that understands this dynamic and progressive area.

The only problem is.... Yes. The City is using the "quick-take/condemnation" method to take everything closed on route 50 because it qualifies (in a week, but technical way) as a public good when VDOT is involved. The route 50 businesses are told their lease is up and they gotta go. The property owners are paid this "fair market" value, but have zero recourse before the land is "taken". They can fight in court later, but just to argue the value.
VDOT is being used as a tool, the law firms in Richmond know it, and the city has more "quick-take/condemnations" on record than ANY other jurisdiction in the STATE OF VA in the past few years.
Yep. It's abuse.

Dude, the stores in places like Fairfax Circle Plaza do not own the property they sit on. They lease it from a property management company such as Combined Properties that DOES own it and is very excited about working with local government to develop the property so that it will become much more profitable.

The government is not friendly about this AT ALL. The property owners get what the government presents as a fair offer and the businesses have to leave.

Dude, these are routine notices re utility and drainage easements associated with road improvements, mostly at 123 and 50, not at Fairfax Circle. In every case, property owners have been offered 100% of the appraised value of the property.

Only they're not offered the fair market value, the don't accept the offers, and other jurisdictions do not use eminent domain to conduct this kind of business.

The circle project? There's another thread on that and it's pretty ugly too.

You're not understanding how this works. Combined Properties is the owner of Fairfax Circle Plaza, and they are giddy partners in and huge fans of the City's plans to redevelop the shopping center.

Your easement panic is meanwhile over a couple of thousand square feet of typically curbside space needed for utility and drainage upgrades as roads are widened and improved to support improved traffic flows. In general, "Quick-Take" authority is a tool to keep projects that are subject to state or federal funding deadlines on track and prevent anti-social individuals from acting to frustrate legitimate public purposes.

in the 80's and 90's news was full of county governments who'd done rip offs using "emminent domain"

people were religious and many couldn't read - didn't have internet or lawbooks, few back then knew the counties were lying about what "emminent domain" is and what were the limitations upon government for using it

i do know fx co gov has been behind shutting down: bars, golf courses, and many other things ... only to be re-opened by OTHER WEALTH soon later. as if planned.
