Detectives with the Major Crimes Division arrested a Fairfax County employee on Tuesday, March 22. Rakesh K. Kapoor, 54, of Manassas, was charged with felony Obtaining Money by False Pretense following an investigation which stemmed from him allegedly accepting cash for a transaction while working in the capacity as an inspector with the Fairfax County Department of Code Compliance. Kapoor was transported to the Fairfax County Adult Detention Center where the warrant was served.

The Fairfax County Department of Code Compliance does not accept cash payments. If you complain about Code Compliance too much then they are likely to come after you. Code Compliance can also use the police to crack down on violators, and they are very quick to go to the magistrate.

As with many other things in Fairfax County government, a third party audit is needed. The Board of Supervisors needs to spend less time on things like trolley cars and pissing matches with the schools and focus on good government.

Looks like Kapoor was taking cash on the side to prepare (or have prepared) a Special Permit application with all the required documentation/justification that would eventually get approved, by someone. Normally, a procedure for a variance to zoning codes must be followed that puts neighbors on notice and gives them an opportunity to object. For something like this to work, other people in the County Code Enforcement Department must have participated.

All the more reason for a top to bottom of audit of Code Enforcement. If they are shaking down residents, it has to stop. As many victims as possible need to be found and reimbursed. The department also needs to take major steps to restore trust, as right now trust is diminishing rapidly.

Carport only requires 7 feet setback, but an enclosed garage requires 12 feet setback. Typical code compliance violation happens when an existing carport is enclosed into a garage without an approved permit. Residents are vulnerable in a situation like this, because the cost to deconstruct the enclosed garage would be significant plus loss of previous construction costs. An unscrupulous compliance inspector could take advantage of this situation by offering to expedite a *special permit* with cash under the table.

If those property owners paid to the County and had their permits approved I don't see how they could charge them again. This guy is alleged to have asked money to expedite matters. I am just assuming that the property owners would have to pay a separate fee to the County for permits. I am a property owner and have gone to the County countless number of times but have never experienced anything like this.

I would not be so concerend about people having to pay a legitimate fee as a) how many others did this guy hustle and b) how big of a scam was this in that department?

I could also see people being afraid to come forward for fear of inspectors showing up and finding a million little things. To say nothing of inspectors and HOAs.

Illegal activity starts when a homeowner encloses a carport (w/o permit) into a garage. Notice of Violation (NOV) is served regarding 12 feet setback violation. Vulnerable homeowner seeks relief/solutions from Fairfax County Compliance section. Unscrupulous inspector requests cash under the table to fix it. Homeowner paying cash directly to County inspector without contract/receipt is also guilty of participating in an illegal activity.

If you got a permit and paid the Fee to the County the permit is legal. This guy was just collecting a side fee claiming that he would expedite the process. Nothing gets expedited it is a slow process.

Do you have a source for this new information?????: "It is not a Homeowner. It is Commercial." Even if (as you say) this current arrest charge is for commercial, that does not limit an unscrupulous Fairfax County inspector. Vulnerable homeowners caught with a Notice of Violation (NOV) might be tempted to pay illegal cash to make the problem go away.

This is such typical "small town corruption"-greasing the inspector on a permit or zoning issue.

But, in a big place like Fairfax, this gets to be a big problem. Has there been a top to bottom investigation of where Kapoor used to work? Have procedures been put in place or reviewed to stop this from happening again? What about the victims, what is being done to refund them or at least give them an approval or waiver?

Fairfax can spend half its money on schools, money on a new police car design, a study for a trolley but it doesn't do much to stop crap like this.

Wow! I had no idea. Now I really think VA is a police state. $200 in bribes and they lock you up for years. That is really ridiculous. I can see losing his job, community service, restitution but more than that is just taking this thing waaaayyy too far.

So a few people have illegal garage/carports....ooooohhhh, so horrible. No one died or had their head cut off.

He and his team have tackled and cleaned up many overcrowding situations with too many unrelated people living in a house -- all across the County.
